Yep, he's giving the green light to discriminate against my deaf daughter. I've never been on his "team" and have always been opposed to discrimination against LGBTQ folks, but this is like the "first they came for the socialists..." thing. It now directly hits my immediate family and always has a few gay friends.

This is indefensible. Fuck him and anyone who votes for him.

Gov. Greg Abbott’s office recommended the change, board members said, because the code’s nondiscrimination protections went beyond protections laid out in the state law that governs how and when the state may discipline social workers.

 

Are state certification boards expressly prohibited from creating board rules governing the actions of licensees that are not otherwise explicitly authorized in the state law? I do not believe that to be the case, but may very well be wrong.  Seems to me that there are rules described in various board's codes of conduct that go beyond the statutes, but haven't look at any of those laws in a long long time.

Seems to me that the board should have some latitude, and let the courts resolve the matter if a licensee objects to one of the rules.  In this case, it appears that the social workers are largely against this change, and it is a top down change from the gov, rather than something coming from the practitioners or the board.

Well, lets back up and analyze this.

  • As private citizens, social workers are constitutionally entitled to discriminate on whatever basis they want.  That might violate a federal or state law, but not the constitution.
  • If the social worker is employed by the government, either state or federal, or accepts government funding or otherwise acts under color of law, their actions may be unconstitutional.
  • So, apparently Texas has no general law that prohibits private citizens, or social workers from discriminating.  
  • There is a state law that governs licensure and regulation of social workers.  That law does not make it illegal for social workers to discriminate.
  • The same law creates the State Board of Social Worker Examiners, which is permitted to enact a "Code of Conduct" for social workers, and discipline them for violation of it. 
  • The Code of Conduct prohibited this type of discrimination and subjected licensed social workers to discipline for violating it.
  • Abbott sought the removal of the anti-discrimination provision from the Code of Conduct because it was "inconsistent" with the licensure law.

Complete bullshit.  But not unconstitutional.

Yeah, the whole idea of letting the Board create social-worker-specific rules, including a code of conduct, is to let those with profession-specific knowledge decide how to govern and regulate the profession.

It's not inconsistent with the law creating the Board unless it is something the law says the Board cannot do, or something that mandates what social workers must do.  The law doesn't say the Board can't have anti-discrimination rules, nor does it say that social workers must discriminate.

It's not "inconsistent" with the law.

It is inconsistent with Greg Abbott's Trumpy, asshole-conservative pandering desires.  Another instance where Greg Abbott knows better and does it anyway.

There's a special place in hell for him and his ilk.

Abbott is pretty active and always seems at risk of overstepping the legal bounds of the governor.

I think Abbot is really just doing his best to hold on to power.

He can see the demographic shift ramping up in the state.

it may be craven, but it’s the political situation that fell in his lap. 

He’s got his back against the wall and is trying to roll with it.

Its really not all that special or different than any other sitting governor in his situation would do.

Yeah, I quite doubt that the anti-discrimination provisions were highly unpopular in the LMSW community.

Now, I could see that maybe some social workers aren't very plugged in to certain communities or issues and may refer away to someone more competent for that type of client, but I don't see that as discrimination.  Might provide cover for discrimination.

There are plenty of Republican/conservative social workers in this state who ignore the things they are taught that they don't agree with politically.

I for one am glad our governor decided to address this absolutely critical issue. Making sure social workers can discriminate should absolutely be a top priority during these times.

Greg Abbott is a sad, pathetic piece of shit and if you support him, you are too.

If he just shut up and said "blah-blah economy, blah-blah keep everyone safe during COVID" and every month or so throw in a jab to Adler, he'd not have to worry about a thing.  But he's putting his career in jeopardy to save good ol Ted.  I don't get it.

His guns position probably makes him difficult to win a statewide now.  Things can change but unfortunately may need a tragedy to motivate public opinion change.

I've always assumed one of the Castro's, but have been wrong.
