And that’s the thing that’s far-reaching. There’s a lot we’re learning. There’s a lot we didn’t know.”

The guy who was thrown out of my poker game was the one who always volunteered to color everyone up. He was helping himself to a couple extra thousand chips each time.

This is a weird one.  Not a new story in Minnesota, it's been circulating for a while, yet none of the investigating by the Minnesota media was able to corroborate it and there's no police report of anything.

Someone is hiding something.  The video and those texts need to come out.

I know the burden of proof in these falls on the defendant, and they are guilty until they prove themselves innocent, but doesn't it seem possible, MAYBE in this case that he's innocent? 

 

Discussed at length on prior threads, but as a male, and the father of a son AND a daughter, all reports need to be treated objectively.  Don't immediately discount any person's allegation, and treat it as credible for the purposes of investigation.  But likewise, every man accused is entitled to a fair shake and fair process.

If there's no corroborating evidence.....then it's gonna be pretty hard to pin anything on an accused, and it should be.  If some of the texts, or the video exists, then they've got something.  If another woman treated similarly comes forward, they may have something.  But right now, they have an allegation.  And anyone can make an allegation.

An allegation the weekend before a primary (tomorrow) knowing it would blow up at just the right moment reeks of politics.  Including tagging one of his opponents in the facebook post that she immediately began sharing.

I agree with this 100%, however it conflicts with 99% of the #metoo movement's thoughts.

Well, defining that "movement" is a tricky thing.  Is the most vocal contingent of that movement one of "believe the accuser, no matter what?"  Probably.  But most women I know 1) are pleased that the tolerance of sexual harassment shenanigans is being tossed in the garbage, but also 2) reasonably wary of mere allegations.  They aren't for changing the burden of proof -- they're just for actually applying it, and giving accusers fair weight (as opposed to simply dismissing them, or conducting "investigations" designed to exonerate a powerful male figure).

My daughter has a friend who has made a credible allegation of sexual assault against a male.  And while my daughter is quite activist in supporting her friend, she acknowledged that, absent any evidence, a mere allegation shouldn't be enough to toss a male out of school, etc. -- because she thought "well, what if some girl said this about my brother?  Anyone can SAY this stuff -- shouldn't we require a bit more than that before ruining his life?"  It's not a comfortable place to be thinking, but she gets it.  And I think most of her peers get it.  And my wife and most of her peers get it.

The movement is still burning hot.  Let's see where it ultimately ends up when it settles down.

That's fair. Unfortunately, most movements (these days, anyway) are defined by those screaming the loudest.

Hipster Houston is in the middle of a huge #Metoo scandal. Omar Afra, founder and editor of Free Press Houston, and then the co-founder of Free Press Summer Fest and Day for Night (a winter weekend concert series / visual arts fest) has been accused of macking on two women against their consent. So far as I can tell, neither of the complaints against him rise to anything like actual rape -- one woman says he tried to make out with her, after she had a few drinks with him, and then went back to his apartment and smoked a joint or two. In her version, he rammed his tongue down her throat. In his, me made a face-lunge and got the Seinfeld pullback. 

The other accusation is so vague I can't remember the details. 

Meanwhile, leading the charge against Afra in no small part is his former right-hand man, Dutch Small. Dutch, Afra's former publicist, is gay, and even as he is crusading against Afra, stands accused of drugging straight dudes who wake up on strange couches with their britches around their knees. He is just kind of ignoring those accusation, and even went on local TV news the other night, wearing a fucking clip-on manbun and looking all meth-sheeny, and claimed that Afra sexually harassed him too. Some balls on that Small kid...

And it's going down the line of other former Free Press employees. The art director and another staffer are accused of getting a 16-year-old girl drunk and high night after night, and one of them then going on to rape her for years. 

All kinds of wild allegations are flying around on Facebook. Afra has stepped down at his paper and as head of Day for Night. Small has left Houston -- he's taking his potshots from afar. No criminal charges were ever filed -- nor any suits, yet, but I believe it's safe to assume there are plenty of interested lawyers hovering over this carnage about now.

My take: Omar was a sleaze but is not a rapist. And he's been such an asshole for over a decade, he has no reservoir of goodwill. He frequently didn't pay his employees, freelancers or creditors, and they've all been looking for a reason to pounce on his ass. Why not #metoo?  And yeah, as a married man, he is at the very least a cheatin' dog, and as a boss, he stands accused of dangling job offers / concert tickets / various hipster perks out there along with his dong, so there's that. 

And Jesus, that Dutch kid is just fucking out of control. 

But through it all, there's a very disconcerting mob mentality. All you have to do is throw an accusation out there on the Internet, and you are instantly welcomed into the sorority of "survivors." Any questioning, no matter how mild, of anybody's account brands you as a victim-blaming Neanderthal.

Houston's annual Day for Night festival has cut ties with its founder Sunday after the allegations surfaced of his sexual misconduct.

Omar Afra has been removed from "any ownership or involvement in Day For Night from this day forward," the festival posted on its Facebook page Sunday.

Afra, meanwhile, pledged to "fight back against allegations that are patently false."

Afra, 40, is also publisher of Free Press Houston and has worked on festivals the publication put on, including the Free Press Summer Fest and the Westheimer Block Party. 

The allegations were initially made public Friday by Amanda Hart, who published a Facebook post about Afra, who she worked with at Free Press Houston, Summer Fest and Day for Night.
 

"I have personally seen him cultivate a toxic work environment where people are manipulated, mistreated and abused emotionally," Hart wrote.

She attached several screenshots of text messages which were allegedly exchanged between Afra and a woman who says Afra assaulted her. A second woman also came forward with allegations against Afra years earlier.

The festival's creditors "were shocked and saddened" to hear the accusations, Day For Night's Facebook post said Sunday. "We stand with all victims of abuse."

In December, the Day for Night festival featured a long list of performing and visual artists, including Nine Inch Nails, Thom Yorke, Solange and Pussy Riot, at the old Barbara Jordan Post Office on Franklin Street.

 

On Sunday afternoon, Afra posted a statement on his Facebook page, announcing that he will step down from his positions at Day for Night and the Free Press.

"I can't begin to say how saddened, shocked, and embarrassed I am for the developments over the last several days," he wrote, adding that his wife and children have been traumatized and that he has received death threats.

In his Facebook post, Afra called the accusations a "coordinated attempt," but also acknowledged that he had "veered away from what I knew was right and caused pain to those around me including family and friends."

"There's a lot more that's going to come out about this," Afra said on the phone Sunday. He said that the allegations against him do not constitute sexual assault.

 

"I am focusing on my family; I am trying to keep it together for them," he said.

Afra said in the post that he has been in therapy for a year and is trying to get back on the right path.

There's no word yet on the future of the festival, which was last held in December.

"Out of respect for these alleged victims, any announcement about the future of Day For Night will be made at a later date," the festival's Facebook post said.

The Italian actress and director Asia Argento was among the first women in the movie business to publicly accuse the producer Harvey Weinstein of sexual assault. She became a leading figure in the #MeToo movement. Her boyfriend, the culinary television star Anthony Bourdain, eagerly joined the fight.

But in the months that followed her revelations about Mr. Weinstein last October, Ms. Argento quietly arranged to pay $380,000 to her own accuser: Jimmy Bennett, a young actor and rock musician who said she had sexually assaulted him in a California hotel room years earlier, when he was only two months past his 17th birthday. She was 37. The age of consent in California is 18.

That claim and the subsequent arrangement for payments are laid out in documents between lawyers for Ms. Argento and Mr. Bennett, a former child actor who once played her son in a movie.

The documents, which were sent to The New York Times through encrypted email by an unidentified party, include a selfie dated May 9, 2013, of the two lying in bed. As part of the agreement, Mr. Bennett, who is now 22, gave the photograph and its copyright to Ms. Argento, now 42. Three people familiar with the case said the documents were authentic.

The Times has tried repeatedly since Thursday to get a response to the matter from Ms. Argento and her representatives. She did not reply to messages left on her phone, sent by email and sent to two of her agents, who agreed to forward it to her. Carrie Goldberg, her lawyer who handled the matter, read email messages from The Times, according to two people familiar with the case, but she has not responded. A woman who answered the phone at Ms. Goldberg’s office on Friday said the lawyer would not be available to discuss this article.

Mr. Bennett, who lives in Los Angeles, would not agree to be interviewed, said his lawyer, Gordon K. Sattro. “In the coming days,” Mr. Sattro wrote in an email, “Jimmy will continue doing what he has been doing over the past months and years, focusing on his music.”

In an April letter addressed to Ms. Argento confirming the final details of the deal and setting out a schedule of payments, Ms. Goldberg characterized the money as “helping Mr. Bennett.”

“We hope nothing like this ever happens to you again,” Ms. Goldberg wrote. “You are a powerful and inspiring creator and it is a miserable condition of life that you live among shitty individuals who’ve preyed on both your strengths and your weaknesses.”

But for Mr. Bennett, who as a child actor charmed Harrison Ford and Bruce Willis and earned the nickname Jimmy Two-Takes because he rarely flubbed his lines, the 2013 hotel-room encounter was a betrayal that precipitated a spiral of emotional problems, according to the documents.

The fallout from “a sexual battery” was so traumatic that it hindered Mr. Bennett’s work and income and threatened his mental health, according to a notice of intent to sue that his lawyer sent in November to Richard Hofstetter, Mr. Bourdain’s longtime lawyer, who was also representing Ms. Argento at the time.

Ms. Argento, who lives in Rome, subsequently turned to Ms. Goldberg — a prominent lawyer for victims of online attacks — to handle the case. (Mr. Hofstetter is now handling the estate of Mr. Bourdain, who killed himselfin June. Although Mr. Bourdain helped Ms. Argento navigate the matter, neither Mr. Hofstetter nor Kimberly Witherspoon, Mr. Bourdain’s longtime agent and now a spokeswoman for his wife, Ottavia Busia, from whom he was separated, would comment for this article.)

Mr. Bennett’s notice of intent asked for $3.5 million in damages for the intentional infliction of emotional distress, lost wages, assault and battery. Mr. Bennett made more than $2.7 million in the five years before the 2013 meeting with Ms. Argento, but his income has since dropped to an average of $60,000 a year, which he attributes to the trauma that followed the sexual encounter with Ms. Argento, his lawyer wrote.

In October, a month before Mr. Bennett sent his demand for money, The New Yorker published an article by Ronan Farrow that included Ms. Argento among 13 women who accused Mr. Weinstein of harassment and rape.

Ms. Argento, whose father, Dario Argento, is a noted director of Italian horror films, began her acting career as a child. She went on to win two David di Donatello Awards, the Italian equivalent of Oscars, and has directed films, written a novel and recorded music.

After she spoke out about Mr. Weinstein, Ms. Argento quickly emerged as a powerful voice for women who have been mistreated by men. In May, she gave a riveting speech at the Cannes Film Festival in which she called the festival Mr. Weinstein’s “hunting ground.” She said he had raped her there in 1997, when she was 21.

The relationship with Mr. Weinstein continued for years afterward and sometimes included sex, The New Yorker reported. Ms. Argento, who had acted in a movie Mr. Weinstein produced, told the magazine that she feared angering him. It was a complicated situation in which she said she felt powerless. “After the rape, he won,” she told Mr. Farrow.

Mr. Weinstein has pleaded not guilty to six felony counts in New York, including first-degree rape; none are related to Ms. Argento. His lawyers have said their relationship was consensual.

Mr. Bourdain, long a fan of her father’s work, met Ms. Argento when he was shooting an episode of his CNN show “Parts Unknown” in Rome in late 2016. The two became a couple, and Mr. Bourdain became her champion as she emerged as a leading figure in the battle against sexual assault and harassment, speaking at conferences and at Harvard.

For Mr. Bennett, seeing Ms. Argento present herself as a victim of sexual assault was too much to bear, his lawyer wrote, and called up memories of their hotel reunion. “His feelings about that day were brought to the forefront recently when Ms. Argento took the spotlight as one of the many victims of Harvey Weinstein,” Mr. Sattro wrote in the notice of intent to sue.

Ms. Argento, who is divorced and has two children, was both a mentor and a mother figure to Mr. Bennett, the document says, and the two were intermittently in contact as he grew up. “Jimmy’s impression of this situation was that a mother-son relationship had blossomed from their experience on set together,” Mr. Sattro wrote.

Mr. Bennett began acting at age 6, when he was cast in a commercial for a Dodge Caravan. He went on to appear in dozens of other commercials, and secured roles in several television shows. His prolific movie career started in 2003 with “Daddy Day Care,” which starred Eddie Murphy.

Mr. Bennett was 7 when he was cast in “The Heart Is Deceitful Above All Things,” a 2004 film Ms. Argento directed, starred in and helped write.

The script, based on a book by the pseudonymous writer JT LeRoy, depicts the grim relationship between a drug-addicted prostitute played by Ms. Argento and her son, played by Mr. Bennett and two other young actors. Ms. Argento’s character dresses her son as a girl to lure men, and the boy is ultimately raped.

In interviews and subsequent social media posts between the two over the years, they referred to each other as mother and son.

On May 9, 2013, the day they met for a reunion in her room at a Ritz-Carlton in Marina del Rey, Calif., she posted on Instagram: “Waiting for my long lost son my love @jimmymbennett in trepidation #marinadelrey smoking cigarettes like there was no next week.”

Mr. Bennett responded, “I’m almost there!:)”

Mr. Bennett, who has an eye condition that prevents him from driving, arrived at Ms. Argento’s hotel room that morning with a family member, according to his notice of intent.

The document lays out Mr. Bennett’s account: Ms. Argento asked the family member to leave so she could be alone with the actor. She gave him alcohol to drink and showed him a series of notes she had written to him on hotel stationery. Then she kissed him, pushed him back on the bed, removed his pants and performed oral sex. She climbed on top of him and the two had intercourse, the document says. She then asked him to take a number of photos.

Later that day she posted a close-up of their faces on Instagram with the caption, “Happiest day of my life reunion with @jimmymbennett xox,” and added that “jimmy is going to be in my next movie and that is a fact, dig that jack.” That post and others were included with the notice of intent, along with three photos apparently taken by Mr. Bennett that depict him and Ms. Argento in bed, their unclothed torsos exposed. (Only one of the photos taken in bed shows both their faces.)

The two had lunch, and Mr. Bennett headed home to Orange County, where he lived with his parents. As he was driven home, according to his claim, he began to feel “extremely confused, mortified, and disgusted.”

But a month later, on June 8, he sent Ms. Argento a Twitter message, “Miss you momma!!!!” that included a photograph of an engraved bracelet she had given him to commemorate the movie. (His Twitter account has recently been shut down.)

That same month, he confronted his mother and stepfather over the state of a trust into which some of his earnings as an actor had been deposited, according to a lawsuit he filed in Orange County Superior Court in October 2014.

Mr. Bennett claimed his parents had barred him from the family’s house and kept his possessions, and over the years had cheated him out of at least $1.5 million in earnings. He said he was broke and two months behind on his rent. The case was settled in December 2014, but the terms were not disclosed.

In the agreement between Ms. Argento and Mr. Bennett, she agreed to pay him $380,000 over the course of a year and a half, starting with an initial payment of $200,000 that was made in April, according to a letter to Ms. Argento in which her lawyer, Ms. Goldberg, outlined the terms of the deal.

The agreement does not prevent either party from discussing it. In the letter, Ms. Goldberg explained that California law does not allow nondisclosure agreements in civil contracts involving the types of allegations made by Mr. Bennett.

One alternative, Ms. Goldberg wrote, would be to work around the California law by using New York lawyers and arguing that the laws of New York govern the agreement.

“Ultimately, you decided against the non-disclosure language because you felt it was inconsistent with the public messages you’ve conveyed about the societal perils of non-disclosure agreements,” she wrote to Ms. Argento.

“Bennett could theoretically tell people his claims against you,” she wrote. “However, under this agreement, he cannot sue you for them. Nor can he post the photo of the two of you.”

“At the very least,” Ms. Goldberg added, “he is not permitted to bother you for more money, disparage you or sue — so long as you comply with your obligations in the agreement.”

Although it is unclear whether Mr. Bennett and Ms. Argento have spoken since the payment was made, Ms. Argento seems to remain supportive. On July 17, she added a “Like” to a moody portrait of himself he had posted on his Instagram account. The account has since been scrubbed of much of its content.

The emails -- just filed in the criminal case and obtained by TMZ -- were written between April 2013 and February 2017 by the woman who claims she was raped by Weinstein on March 18, 2013 in NYC.

One of the emails -- written April 11, 2013 -- says, "I was able to talk to [redacted] today and will be connected with [redacted]. :) Thanks, and I hope to see you sooner thank (sic) later ..."

On April 17, the email reads, "It would be great to see you again, and catch up!"

Another email on Sept. 11, 2013 says ... "Miss you big guy."

In January 2014, she wrote, "Your the one who makes it look good with your smile and beautiful eyes!!"

And, on July 10, 2014, she emailed, "There's no one else I would enjoy catching up with that understands me quite like you."

And then there's this on Feburary 8, 2017 ... "I love you, always do. But I hate feeling like a booty call. :)."

Throughout the email chain over the years, they go back and forth talking about meeting up. At one point, she asks for a Soho House membership referral ... she wanted to be a member and use him to get in.

The emails were attached to a motion to have the rape indictment dismissed based on prosecutorial misconduct, because the emails were allegedly withheld from the Grand Jury and would prove exculpatory.

Weinstein says the alleged misconduct is so egregious, it taints the entire indictment involving all 3 accusers and he is asking the judge to dismiss all criminal charges.

Actress Asia Argento reportedly denied sexual assault allegations levied against her and said that her late boyfriend Anthony Bourdain paid her accuser Jimmy Bennett because the then-couple considered him “dangerous” after he asked for financial assistance.

“I strongly deny and oppose the contents of the New York Times article dated 20 August 2018, as circulated also in national and international news,” Argento said in a statement given to reporter Yashar Ali. “I am deeply shocked and hurt by having read news that is absolutely false. I have never had any sexual relationship with Bennett.”

On Sunday, The New York Times published an article claiming that Argento was accused by child star Bennett of setting up a sexual encounter with him in California when he was 17 – below the age of consent in that state – and she was 37.

Argento – one of the first prominent women to accuse disgraced movie mogul Harvey Weinstein of sexual assault – went on to say she was linked to Bennett by “friendship only” which ended when he made “an exorbitant request of money” amid financial problems. Argento said her then boyfriend, CNN star Bourdain, decided to pay Bennett.

It'd be terrible for her to go through this and actually be innocent. I can't help but think that it was unfortunate that we allowed #metoo to adopt for us the standard that if the accuser says it happened then they are defacto guilty. It's understandable though.  We never expected anyone other than Bill Cosby or white males to be accused

This is one of 4 photos Bennett, now 22, took in a Marina del Rey hotel room back in 2013. The then 37-year-old Argento and Bennett are on a bed shirtless, their heads on a pillow and their arms entangled. Sources tell TMZ the pic was taken after the 2 had intercourse. It's a crime in California for an adult to have sex with a person under 18.

Bennett later threatened legal action and, in April, Argento settled with him for $380,000 ... which her boyfriend, Anthony Bourdain, paid.

Argento released a statement Tuesday, saying, "I have never had any sexual relationship with Bennett."

Mario Batalie.... come on down???

BOSTON (AP) — A Massachusetts woman says in a lawsuit filed against Mario Batali that the celebrity chef forcibly kissed her and groped her in a Boston restaurant in 2017.

According to media reports, the suit filed Wednesday in Superior Court in Boston seeks unspecified damages for "severe emotional distress" including anxiety and self-doubt.

The suit alleges that the 28-year-old woman spotted Batali in the restaurant in April 2017 and tried to take a photo. The suit says Batali invited her to take a selfie with him then, without asking for permission, repeatedly kissed her face, rubbed her breasts, grabbed her buttocks and put his hands between her legs.

Neither Batali nor his representatives immediately responded to emails for comment sent to his website and production company on Friday.

Several other women have previously come forward to allege sexual misconduct by Batali.

Sounds pretty shitty of him if true, but you can sue and get paid for "self doubt?"  Who knew?

I keep thinking that a lot of these dudes are just assholes all the way around. If they had some reservoir of goodwill around them, if they had paid their employees well and respected them, a bad date ending in a failed make out or an Xmas party tit-swipe wouldn't be code red, but they've done a bunch of other shit, too, and that is really what they ate getting roasted for, and shit, they deserve it.
