  3. Not really, but - you are correct. With this DA prosecuting, this DA has a horrible case. I am waiting for him to pull a rabbit out of his hat. The cross-exam needed to tell a story. It's didn't. It was a mess (for many reasons and factors in play in the courtroom).

  8. Mediocrity must be the way it is in Wisconsin Courts. Both legal teams need to practice with exhibits. The judge is difficult for lawyers trying to get into a rhythm, but practice makes perfect. This is a weak cross-exam, in my humble opinion. It should be a machine gun attack of questions - with nothing open ended. It is so rare that a defendant testifies (it's generally a horrible idea) that the DA appears to be out of practice.

  10. These attorneys (both sides) are rather clumsy/clunky when it comes to presenting evidence. They are not focused on what a jury wants to see and hear.

  20. Energy prices (as discussed earlier) are fungible. We don't see the energy scramble in the US, but Europe and Asia are worried about Dark Winter due to supply problems. Energy price spikes have been a harbinger of recession or early red flag on the risk of recession in the past. We will/are feeling it in the US. And I agree with you - our industrial policies are mismatched with our capacity. The global economy is shaky. With rising conflict with China, supply chain problems may continue as we transition away from China. Just another brick in the wall of worry.
  21. Establishing intent to cause death or serious bodily harm. It's an element of the charges the prosecution must prove.

Question regarding defendant's decision to exercise right to remain silent and question regarding impermissible character evidence (prosecutor claimed propensity to act in accordance with prior acts and evidence should come in because the defendant put his character into evidence with his testimony (a big reason not to have a defendant testify). Just typical criminal trial tactics.
  23. Remember the jury was not in the room to see this. That's intentional. When an attorney draws an overly intrusive judge (judge wants to be a star; judge has predetermined guilt or innocent unknowing; judge wants to do everyone's job), these conflicts occur. Occasionally, one can change the judge's mind. These high visibility cases bring out the worst in some judges. But I do believe this judge is doing his best to ensure a fair trial. He is just caught in a moment that I imagine he regrets. The job for the attorney is to give the judge an avenue to save face and adjust.
