“There’s no real clear-cut winner on this. It’s almost like a law school exam question. It’s designed to have ambiguity,” said Villanueva.

I dunno. Sort of seems more like straight up murder to me.

Is knocking on a door really unlawful entry? I was not aware there were laws against knocking on doors. So if you knock on a door you are exposing yourself to being legally killed?

I am somewhat doubtful that is true even in Texas.

It should.  But "stand your ground" laws are pretty fucking aggressive the other way.

I mean, they should be re-titled "gutless fucking coward who wants to shoot first and think later" laws, but the fact remains the bar is just barely higher than "I decided I was scared, and that's enough -- I have a perfect defense."

Yeah. I don't see any legal basis for killing somebody for knocking on your door. I cannot imagine that would generate much interest in law school. If that is ambigous then society as we know it is dead.

Surely a crime needs to be in the act of being committed before you can "stand your ground"? You can't just have feelings and therefore kill somebody.

You'd think that.  And there have been convictions of folks who shot someone just for turning onto their driveway or knocking at their door.  But these stupid fucking "stand your ground" laws have just emboldened WAY too many people, and set up a fucked up value system: everything and everyone is an immediate threat, and shoot shoot shoot shoot, that's the only rational response to every "threat."

Set up a fucked up calculus, get fucked up results.

Notice how the article doesn't even mention who murdered her.

Have to protect him.  Note that this is in fucking Indiana, one of the most racist states in the union.  All presumptions must go in favor of the homeowner, who was surely just defending himself against someone who was likely a dirty illegal gang member rapist drug dealer boat captain terrorist.

I guess that’s one way to get rid of door to door salesmen, especially you window sales fuckers

If these laws were enacted with a limitation to applying them to sales types....I'm listening.....

Literally in "Whitestown."  Looks like a suburb of Indiana, that is going from cornfields to cookie-cutter housing development.

The ABC story has a little more detail, including that it was shortly before 7 AM.

is that why there are no black people A Christmas Story?

But it could have been antifa or MS-13...knocking on your door...in the morning...in suburban Indiana.

Who are we to judge the homeowner's fear?

You're going to have to be more specific.

Brisket, all due respect, but you seem to just gloss over the fact that she was well-aware she was brown at the exact time when she knocked on the door.  Seems like there is a willfulness element in there.

Yeah.  That's when you gotta really be ready for a home invasion -- the time when people start their day.  That's, like "home invasion planning 101."

Also, this is perfection:

Quote

"We are working closely with the Boone County Prosecutor's Office to ensure every aspect of this case is handled with care and diligence," police said, noting that an update will be provided next week "due to the complexity of the investigation."

"The complexity of the investigation."  That's cop-speak for "we gotta find a way to blame this on the brown person."

If this fuck gets off unscathed, you can then legally shoot Door Dash, FedEx, UPS, DHL (laugh), Amazon, your neighbor's kids selling popcorn, your OWN maid service, and of course door to door sales people with no fear of consequence.

And holy fuck, you better watch your kids on Halloween.

I'm putting my faith in fucking Indiana to do what's right here and lock this dickhead up. I like Halloween too much. (ya ya ya, "I hate to break it to you" replies incoming... I get it)

Between our culture's absolute fetishization and worship of guns, to the point where you're a commie pussy if you DON'T use one, to most of our media feeding constant scary shit to whites and olds especially ("they're coming for you!  Venezuelan gangs!  MS-13!  THEY'RE RIGHT OUTSIDE, RIGHT NOW!), to the open demonization of all browns....shit like this happening, and continuing to happen, is inevitable.

From 2007, and still relevant.

Legally, I believe that's called "assumption of risk."
