    “Today, we are releasing a report that details the prevalence of sexual assault and misconduct at The University of Texas at Austin. The data is drawn from the Cultivating Learning and Safe Environments (CLASE) survey that the University of Texas System conducted at 13 UT institutions across the state last year.

    The results of this survey of our students are of tremendous concern to me, and I know these findings are deeply troubling to every member of our community. This survey reveals a problem in our university, as well as society, that has existed in the shadows for too long.

    CLASE found that 15 percent of undergraduate women at UT Austin reported that they had been raped, either through force, threat of force, incapacitation or other forms of coercion such as lies and verbal pressure. Furthermore, 28 percent of undergraduate women at UT Austin said they were the victims of unwanted sexual touching, and 12 percent experienced attempted rape.”

    This could prove a bad move for OU. They’re going to win the conf much less frequently (never?), so they can’t sell that in recruiting, and if you think they’ve played dirty historically, they’re going to see what next-level versions of that look like. Alum support in SEC is much different, in fall there is football & hunting, nothing else comes close in priority. One of our companies has had block of tix to LSU games for decades, so have somewhat inside perspective, at least there. Whole ‘nutha level of recruiting tactics. NIL may change things, b/c now above board(ish), but back to OU, doubtful they can compete w/ $. Time will tell. Frequent conf championships v. rarely/never winning one will likely have an effect.

    It seems likely there was a two-way fight, but we do not know that at this point.

    Conduct unbecoming can be as simple as not having the judgment to extract himself from the situation in a manner that avoided embarrassing UT. Alleged fight or no fight. Assuming arguendo that she was the aggressor and the only person who acted violently in any way (and, I think that’s highly unlikely), he still didn’t extract himself from the situation, resulting in his arrest & mugshot photo & video. Even if DA ultimately dismisses charges, still doesn’t undo conduct unbecoming. I thought dismissal of Beard & of charges would both happen, I also continue to think there’ll be a settlement to avoid discovery for all. I suspect there’ll also be a settlemt btwn Beard & his (presumably soon-to-be-ex-)fiancée, to avoid her suing & airing Beard dirty laundry, compromising future coaching opportunities. I’d add that now that Minton chose the aggressive path, politically motivated DA may be more not less apt to press charges (not that DA’s are political or anything). All stupid and unnecessary. Still undefeated, it seems- can even make you flush your dream job.

    That doesn’t mean she did, in fact act logically. The judicial system is chock full o’ situations in which grown ass people do not act logically in situations like this or in situations of domestic discord, in general. 

    Once we accept that people act illogically in similar, or even calmer, domestic situations, everything you built on the foundation of her actions necessarily being logical just collapses in on itself. And that’s leaving aside the dubious assertion that he assaulted her “regardless of who initiated it.”

    Of course, both parties can be guilty of assault, regardless who initiated. I’d say likelihood that fiancée assaulted him, he didn’t respond violently, but she called 911, despite his non-violent response, is asymptotically close to zero. Are you suggesting that, or are you suggesting violent response from him, but it was pure self-defense? Either way, I’d say those would be less probable/logical explanations. Net-net, if you’re paid $$$, just don’t screw it up. It’s pretty easy to avoid “conduct unbecoming” and should be even easier to avoid a felony. I stand by my prediction- there’s a compromise buyout so all can avoid discovery/litigation, and he’s gone. Beard pays soon-to-be ex-fiancée & gets NDA, and everybody goes their own way. DA likely does nothing (or probation at most), recognizing that with fiancée changing her story, apt to be reluctant witness. We’ll know soon.

    IMO, the correct decision is clear. W-L record & how players or others feel is irrelevant. Logic says cops didn’t get called, absent Beard having acted violently. Why would she (or one of his kids) call (I don’t recall if police report said she or one of his daughters called)? They’re not getting divorced, there’s no child custody dispute to leverage by calling, and there’s zero upside to 911 call. She’s going to burn the whole thing down & end her meal ticket by calling 911 over nothing? That fails the logic test. Maybe he broke off their engagement, and she lost it, but even then, you don’t call 911. And, there’s nothing in the report to indicate that as the catalyst. If simplest explanation is the obvious one, you have the 2nd(?) highest paid state employee domestically assaulting his live-in fiancée, regardless who initiated things. Proving “conduct unbecoming,” the part “A” of grounds for termination with cause, wouldn’t be hard (police report & pinstripe video would likely be enough), and Beard would risk torching his career, if he chose to go through civil litigation and the discovery that’d entail. What are the odds there’s nothing else ugly between these two that would come out from Lubbock or ATX days, given this incident? And, Belmont wouldn’t want their HR history aired either, which would be his counsel’s likely scorched-earth strategy. Because of that, I think it settles financially, and he’s gone. We’ll know shortly.
