The victim was already dead by the time he was granted bail. What they apparently didn't know was that the sperm donor had been abusing the child beyond the treadmill crap, which although horrific in itself is not a fact pattern that supports a murder charge.

Bail reform doesn't often make the difference between bail denial and the setting of bail. It does often reduce the exorbitant bail amounts for lower level offenses.

Isn't a lot of this going to be judge and prosecutor dependent, forum dependent, and fact dependent?

Some judge's are easier on bail than others.  Some prosecutors take it more seriously than others.  Some defendant's present better than others.

Doesn't most of it land on two issues?  Flight risk and danger to community?

And doesn't this guy likely pass the flight risk test?  His bail issue would be "is he a danger to the community?"

And somehow someway they didn't, or couldn't, demonstrate to the judge's satisfaction that this guy's release could jeopardize the 6 year old's safety?
And if they had successfully done so, couldn't a bail condition be no visits with minors?

With all that, judge could have said

    1.  Not a flight risk.

    2.  Not a danger to community except his own child.

Bail set at $1, but no contact with kids?

I get to monday morning qb this one but, kinda seems like this would have saved child's life.  Shouldn't we monday morning qb things when 6 year olds die?

Before all the people saying they want to kill Jews? I know racism is bad, but man our priorities are fucked.

Its just like, my opinion, man, but at least the "kill the Jews" crowd has cloaked themselves in the cause of the oppressed Palestinian people, whether you buy that or not, up to you, but probably something like 50% of America will give you a pass on that one.

Monkey guy, what's he going to say - "I was doing the monkey dance in the face of a black woman in support of Israeli sovereignty?"

Lets see how that works out.

I see this a bit differently and will provide an example of how I view these protests which I think is more accurate.

Let's say there is a 2nd amendment protest scheduled. I support the 2nd amendment. I want to go to this rally. The point of the rally is to specifically voice discontent with State policy regarding an upcoming bill before the state.

First, I learn they are holding the rally on a campus. (I would ask the founders why it's not at the capital). Next I find out a lot of students are planning on joining. (This would seem odd to me as 2nd amendment rights don't tend to be popular among college students, so I'd ask why)

Then I find out these students are primarily fraternity folks. Hmmm.. well...

As the protest starts the plan changes from a protest to deciding to take over a building on campus.

Beyond that, the "college students from fraternities joining" are Proud Boy folks.

If I elected to STILL attend said rally (which I absolutely wouldn't and would actually be against, for the record) I could, hypothetically argue I'm not a racist, and I'm just here because I support the 2nd amendment. However, my attendance is likely going to get me labeled a racist, criminal and idiot.

Rightfully so, even though I don't specifically support those, I'm showing up and being a part of a rally that commits criminal acts and DOES support them.

Granted, I could argue the rally got co-opted, but if I knew before or saw during any of these developments, then the resulting issues regarding my reputation are entirely on me and fully deserved.

Oh, and nobody even knows or is aware of the bill that I was against to start with regarding the 2nd amendment. Nobody is even talking about it. They are talking about the Proud Boys and their criminal activities, with which I'm now associated.

    That's on me.

I guess my takeaway is that, if you get in the crowd, you likely own whatever destination that crowd reaches, even if you didn't intend it.

Here's where I think we're headed, we've been here before.

Saturday night, we all go out to take one side or the other and

    or

They bleeped out his words but I'm pretty sure Foster in Austin said something to the effect of "the people that actually hate us are too big of pussies to do anything about it [me carrying an AK down Congress avenue]."  I guess he was wrong.

    Rittenhouse both sides had guns.

    Foster both sides had guns.

Shields are classic. So is running straight into the cop who is larger and falling on my ass to be arrested. Then  you have him getting away, to be put into a bear hug by some dude watching and handed back to the cops. Buddy comes, cop says something immediate "its cool Bro" hand signal.

    Clip has it all.

They spent a lot of time on those shields and then, in a moment, shield gone and you're on your ass being handcuffed by the fascist pig oppressors.

I guess that's a free shield for some bystander.

But I would also argue that claiming the majority of these protestors  are antisemitic is fucking laughable. There's one side currently subjugating/annihilating the other right now, and it ain't those poor folks in Gaza. That's what people are protesting.

    Ok, I'll bite.

If there was a pro-nazi protest at UT, and I went and joined the protest and screamed and waived flags and fucked with people, what would you call me?

    and then

If there was a pro-Putin rally at UT, and I went and joined the rally and screamed and waived flags and fucked with people, what would you call me?

    and then

If there was a pro-Kim Jong Il march at UT, and I went and marched and screamed and waived flags and fucked with people, what you you call me?

I'm guessing I wouldn't survive that stretch without being almost uniformly labeled a nazi, fascist, communist, geoncidist, war criminal, and probably some other shit.  Rightfully so.  You march with the nazis, I'm calling you a nazi.

So, if you go and protest and what not and you're protesting for a group of people that voted for leaders that say things like "Israel has no right to exist," (and I don't have a citation but it's out there), I think it's fair to say you're "anti-those people."  If you don't want to call it "antisemitic," then why don't you try on "anti-jewish" or "anti-Israeli."

From where I'm sitting in Texas, there's not much difference.  You want the people that won the war and got the land to give back the land and go the fuck away, or die, and you'll protest and maybe more to accomplish the goal.

There are plenty of Christians who are non-practicing Christians who are Christian by profession or by association without being Christian in practice.

When you figure it out let us all know.

And carry this wisdom with you as your guide:

There's a dad across the fence who is teaching his kids to throw and catch baseballs. Let's call him Dr. Jekyll. Normally he's all hubba-bubba bland suburban comity and I'll toss balls back to his kids who lose them in our yard.

But once Serious Bidness Throwing Practice starts, he changes to focused Psycho Killer Dad and that's when I like to walk up to the fence, call his name until he stops practice, and offer him an old baseball that we found elsewhere. He looks like he wants to fight me every time . I've done it twice so far.

My daughter stills tells stories about 11 year old soccer and her nutcase coach. Guy was a 5'3" tall rage-aholic.

I'm going to add to my to do list today "think of ways I can help RD fuck with his asshole neighbor."  If I come up with anything clever I'll post up.

yes, of course (to your delight).  Still, it's not antisemitic to criticize Israel , or even the desire to destroy Israel.  To the main point -- hating Jews has got ZERO to do with the protests.

we have all heard "anti-Zionism is not antisemitism". Many Jewish intellectuals also believe this.

the argument is about hating Jews and being hateful of Israel is automatically antisemitic. It's zero, nor was that ever the cause of the several wars. It's Israeli propaganda, works well, against the backdrop of western Judeo-Christian culture + hatred of Arabs / Muslims.

a lot of being pro-Israel is because on the other side is the hated Arabs / Muslims (muzzies!).  One can easily turn the argument around and say it's all about hating Arabs.  Does American culture have a fondness for Muslims? Will Israel be happy to exploit this fondness?

What the hell is wrong with you?

it's tribal warfare, Jew tribe vs. Arab tribe.  Many nations are formed by one tribe overpowering the other, that's history and that is what we see today. But it's not simply because they are Jews, it's because they are the enemy tribe, easy.  Jews wanted to establish their ethnostate on top of the native Arab population, so we had war.  Doesn't mean the war was based on antisemitism, but this idiocy is based on deeply ingrained western cultural concepts. Your final sentence makes you down to AA ball -- no I don't hate Jews.  My remedy is a 1 state solution where the Jews take over the west bank (which they already have) but give the Arabs full citizenship as do the 2 million Israeli Arabs. Then it's over.

There is no Jew hatred by me, I want them to take everything in a formal annexation.  Duh.

If the game is "one tribe overpowering the other," isn't that what we have now?  Seems like the tribe with the Blue Star on their flag is beating the ever-loving shit out of the other tribe.  Those Blue Star guys seem to be winning by a lot.  Right?

Cops love to blame someone else for their own failures. Every time we hear about some guy murdering his whole family, and for many mass shooters, it turns out that the cops had investigated them multiple times and simply ignored substantial evidence of criminal activity and refused to arrest them. This kid's mom reported the dad for abuse over 100 times and the cops only arrested him once before the kid died? That's on them.

I've learned that there is something special about a father and son.  Sons seem to me to really want to please their fathers and be admired.  They want dad to affirm them.  Kid probably died wishing he had tried harder to please dad.

This poor boy got two things from dad, physical abuse and emotional cruelty.  It's terrible.

Not a fraternity guy myself but had some friends that were KA's at Southwest Texas State University and I'm familiar with their experiences and practices.

It just occurred to me that some fraternity guys were sitting around on a couch watching all this stuff unfold and they came up with a grand idea:

"Let's make the pledges go fuck with the protesters."

After much planning, beer and bong interaction they came up with "pledges, assemble - you are to go defend the American flag in the middle of this protest at all costs.  If that flag comes down we're going to haze you fuckers until you die."

Then fraternity guys sat back on the couch and watched their glorious plan unfold.

These fraternity guys weren't defending the flag out of patriotism, they were doing it out of fear of hazing bullshit and retribution and, the only way they were letting go of that flag was if the Palestinians made life worse than the expected hazing.

This story is everything that is great about America.

try to post something on topic and I'll respond.

Your post about the French migrating to England sucks too.  Somewhere, somehow, we're all immigrants.  Leaving Podunk shit town Texas to go to Austin made me a migrant.  Go back far enough in my family tree and we probably lived somewhere in Ethiopia or Kenya, just like the rest of you, who are all descendants of original homo sapiens, making us all immigrants.  I could make some argument for ancestral entitlement to some place all the way from South Texas to North Africa.  And probably there is someone that lived there before me and/or after me that could make an argument too.

You tried to wordsmith the phrase "massacre all the Jews," into "There is no antisemitism in this entire conflict, never has been never will be."

    I think that was bullshit.

I think what you really want to say is "Palestinians have an ancestral right to the land and anyone that gets in their way should be subject to eviction. Even if that requires violence. Jew, redneck or Oklahoma fan, you don't care - if they're on "Palestine," forcibly evict them."  But that's already been said and you want a hot take.

You don't hate Jews because of their genetics, you hate them because they're holding the thing you want.

This is almost certainly total bullshit and it's really annoying that they just printed uncorroborated copaganda in this story.

I don't know man.  It certainly appears that New Jersey passed bail reform - at least the Courts seem to say as much here

Criminal Justice Reform | NJ Courts

Surely the bond judge considered... the law, when granting bail.  Maybe you just don't like the fact that bail reform laws resulted in more people receiving bail.  Seems to me like when more people receive bail, sooner or later one of them is going to do something criminal. That doesn't make them special. Normal people commit crimes (everyday), why should people out on bail be any different?

Bail is a constitutional right but, if I'm the judge that lets a child-abuser out on bail and that person goes on to kill the child, I'm losing sleep.  For a long while.

Internet says NJ doesn't have death penalty.  Would this be a capital crime/death penalty case in Texas?

  17. These cops in LA have some badass gear.  What do you think one full set of kit, from the helmet to the boots, gun, taser, armor, patches, backpack, goggles the whole shitaree cost the taxpayers?  I'm guessing at least $50,000 which means, because government bidding was involved $125,000 is the real number.

These guys look like something from a futuristic movie.  Their shit is way nicer than those Delta guys in Blackhawk Down had.

the original 1948 Arab-Israeli war -- the Arab commanders openly stated they wanted to massacre all the Jews.  I would argue even that is not antisemitism, because the Jews are the enemy but they are not the enemy simply because they are Jews.  Hiroshima and Nagasaki were not murdered due to Asian hatred. There is no antisemitism in this entire conflict, never has been never will be.  It's a rookie mistake and a really easy one to overcome.

So, if I say "I want to "massacre all the Jews"," I'm not really saying kill people "because they are Jews," but instead, I'm saying "Jews are the enemy - massacre all?"  I think you outsmarted me on this one.  Maybe try removing the letters "JEW" from your post and replace it with another racial or ethnic term, and see how it plays.  I'll help you get it started:

"The English commanders openly stated they wanted to massacre all the French.  This is not anti-French, because the French are the enemy but they are not the enemy simply because they are French."  "There is no anti-French in this entire conflict, never has been never will be.  Rookie."

    I think your post sucks.

  19. Friendly reminder.  The last time we went through a bunch of unrest and turmoil, we got actual life-endangering violence.

    This guy:

Texas Department of Criminal Justice Inmate Search

Now resides in Brazoria County and doesn't have to worry about things like bills or income taxes anymore.  I bet he would do things differently if given a chance.

    This guy:

Garrett Foster: Protester Killed In Austin BLM Shooting (rollingstone.com)

Well he's experiencing Valhalla now.  I'm sure it's glorious and all.

I for one would like to see people behave with some decency.  I don't like you or your politics, you don't like me and mine, fine - fuck you - but can we not destroy things including human lives?
