Yep, this isn't about winning a legal battle.  It's about constructing a reality distortion field around Trump so that stupid people continue to believe in him.

As usual with the Dotard, it's mostly performative. 1. Take the offensive, no matter how absurd the position. 2. Change the public dialog and distract from the real issue. 3. When the Motion is dismissed, rail about the rigged system.

It's not about actually getting a favorable ruling. It's about maximizing the role as victim.

I don’t know about selling, but they definitely know something that is a Big Fucking Deal, and Trump definitely crossed a red line with them.  I don’t feel like it’s as simple as him refusing to return the documents.

There have been reports that the MAL surveillance tapes (obtained through subpoena) showed boxes being removed from the storage room - after their return had been requested. That's a pretty BFD.

So you are contending that the reason employed by “aggiehawg” from the Texags politics subforum may be unsound? Please let Billy Liucci know immediately. He would not want this kind of thing reflecting poorly on his enterprise.

Aggiehawg claims to be a retired lawyer with significant appellate experience. I wandered over there quite a bit during the post- election litigation orgy. Her takes were always laughably bad. She probably thinks Pence still has the power to ignore the electors.

I have seen former FBI agents comment on the Twitterverse that FBI agents have a Top Secret clearance.  Doesn't mean that can look at all types of classified docs though.

You are correct. One requirement for eligibility to be a Special Agent:

    • Be able to obtain a Top Secret Sensitive Compartmented Information (SCI) Clearance.

    I learned something new today.

  5. A thought has occurred to me concerning the search and seizure, and I haven't seen it discussed anywhere. The assumption is that some of the records retained by Trump were classified.   But FBI agents would not have security clearance to see classified documents. But FBI agents would not have security clearance to see classified documents. It would seem that someone with a much higher security clearance, such as an intelligence official, would have to be present for the search. Has there been any reporting of such officials being there?

Here's what I read earlier this morning, but I can't find now:

He never returned the boxes.  As recently as June, investigators came to Florida, met with Trump's legal team, and were literally shown the boxes, which were located in a basement.  The DOJ wrote a letter asking that the boxes be store in a more secure fashion, so somebody added a hasp and padlock to the door.

The shit was there, and the feds knew exactly where it was.

15 boxes of documents were returned and indexed. The implication is that there were more. There are reports that in June the agents saw records that were marked as top secret.

  7. So am I right that there are two separate strands to this? 1. Misuse of classified documents. 2. Possession, concealment, destruction, etc. of government records.

The first would be far more serious, but might be clouded by his assertion that he declassified them before leaving office.

The second would be an easier standard to prove, would apply regardless of the classification status of the documents, and could result in disqualification  from office per the statute quoted upthread.

I’m kind of surprised, given only 10 signed the actual damages award. But this reflects that Bankston & Co. did a hell of a job showing Alex is an asshole. The jury wanted to punish him. They just didn’t think the plaintiffs actually suffered $150M in damages. At least that’s my theory.

It's possible that the 2 holdouts wanted to award more in actuals.

"Please disregard" creates no legal duty, from the posts and threads I've seen here.

Sounds like a response from someone who doesn't know the Rule and is either too lazy or too busy to look it up.

On a different note, has there been any discussion of whether AJ is covered by insurance and, if not, why not?  I would think any merits personality would have liability insurance for defamation and the like.

was it an appeal or a mandamus that was refused on the grounds that there remained an adequate remedy at law?

Petition for Mandamus, denied with no opinion.

His number one argument on appeal will be that death penalty sanction, and I'm sure that will result in an important appellate opinion on that issue one way or the other.

Not positive, but I think that appeal has already happened and the Court of Appeals affirmed.

Shouldn't Jones have fought against the liability instead of forfeiting, if he wanted to argue that the victims weren't actually hurt by him? Isn't all that conceded at this point?

The default judgment on the intentional infliction of emotional distress claim automatically determined that the parents had suffered severe emotional distress. I believe the jury was so instructed. By itself, that is almost a blank check for the jury to fill in.
