Wouldn’t the First Amendment defense be one of a few possible federal questions that the Supreme Court could rule on after the state appeals have been exhausted?
-
Disney needs to make a cartoon of Mickey Mouse outsmarting some Troll that looks exactly like DeSantis.
-
Excuse me if this is a stupid question but I have zero federal appellate experience.
If a jury makes a finding of actual malice, and this case gets appealed to the U.S. Supreme Court on a federal question, is there any way for the U.S. Supreme Court to disturb that jury finding?
Also, could Fox have removed this case to federal court? If so, then why didn't they?
-
What's surprising to me is how easily DeSantis appears to have been out-lawyered. Doesn't this make him objectively look like he doesn't know what he's doing?

Some people like using guns and they look for reasons to use them.
Also, I don't know about New York, but in my experience an awful lot of Texans think that you can legally kill someone who is "trespassing" on your land.

I like to point out to them that when Trump started barking about the election being rigged and stolen, he had no evidence, and that makes it a lie. That some evidence, if credible, developed later to support his lie doesn't make him any less of a liar.

I've been doing research, and nuclear warming is like all life as you know it stopping instantaneously and every molecule in your body exploding at the speed of light.

Yeah it should only be legal to kill them on purpose
That's never been the law.

On why he bought Twitter: Musk admitted that he went ahead with the $44 billion acquisition because he believed he would lose his legal case to try and back out of it.
Wait, I thought that Elon Musk had all the leverage and Twitter couldn't afford a long trial. Or something like that.

18,000 cattle dying like that should be a crime.

I'm all for legalizing marijuana but why tax it? It's not like Texans don't already pay enough in taxes.

We need to think about the real issue here, which is how many Americans are not killed each day by guns. Why focus on the negative?

There was a period of my life when I went to the Llano Public Library every morning to use the free Internet, and back then it certainly got a lot of use.

I had forgotten about those "Republic of Texas" guys. I seem to recall a guy I knew at UT who was into that during the mid 90's. He was an albino.

“This was an evil act of targeted violence,” said Louisville Mayor Craig Greenberg, who knew one of the victims, at a press conference. He noted that he is himself the survivor of a workplace shooting, and that another shooting occurred near the bank at the same time, hammering home the shocking regularity of gun violence in America.

That link includes a link to the person's LinkedIn page. Don't understand. Alabama grad with a master's degree in Finance, 23 years old, just starting his career. Guy had his whole life ahead of him, but chose to go down this path.
Why do you think he had any real choice?

I thought they were talking about sump pumps. I know it's been raining a lot in California.

Yeah but who the fuck are you?

I don't understand these last few pages and I don't care enough to put in any effort.

Okay you PLO experts. Last night I played a live PLO hand, 8-handed, $1/$2 and we had agreed to three orbits with $5 mandatory straddle. I have about $500 and I'm the effective stack. I was invited to this home game and I don't know anybody in the hand but they all seem to know what they're doing.
I'm in the straddle with QQJT, suited Q of diamonds. Early position min-opens to $10, Button calls, BB calls, I call.
Flop is A-K-6 rainbow with 6 of diamonds. check, check, check, Button bets $30, which I view as strength. I call hoping to turn the nuts against a strong hand.
Turn is a 6 of spades, so now K of spades and 6 of spades are on the board. I do not like this card and I check. Button also checks.
River is Q of spades giving me a decent boat, but losing to quads, AAA66 and KKK66. I can get called with smaller boats and maybe a backdoor flush.
Is this a mandatory value bet and fold to a raise? If so, how much should I bet?
I did not bet because I am a nit. I checked, he bet $50, I call, and he shows A-x of spades for the nut flush. He also had a K, so he bet two-pair on the flop.
He made this easy for me by only betting $50. If he pots it am I ever folding QQQ66? I think he bet the river thinking I'm betting all my full houses.
What do you think of his play?

This angers me. I grew up dirt fucking poor and without welfare I would have starved as a kid. It's simple economics -- food is cheap and the returns are high. I think these same motherfuckers would have wanted me to suffer from malnutrition. I'm 47 now and have paid god knows how much in taxes. It's been a pretty good ROI just from that standpoint.

Well, government regulations that he doesn't like.

I saw a sovereign citizen in a local property tax case once. The judge shut him up real quick.

I did not take federal courts but I did take Prof. Rabban's First Amendment class at UT. How did the U.S. Supreme Court have jurisdiction to reverse the Alabama state trial court's verdict based on the First Amendment in NYT v. Sullivan?
