    Oh, hai.

Ok, he was a socialist! 👹  Probably still is, but realizes he can't get very far on that, because then all this poisonous rhetoric might be on point.

I don't disagree that we have too gotdamn many laws.  But this would not appear to be one of those cases.  First, the census is a Constitutional imperative of the Congress (Art. 1, s. 2), so it's not subject to federalism concerns.  Second, the law in question was super easy to find.  It's in Title 14 US Code, which deals with the census.  Then it's section 141.

So, she appeared to know more about the census statutes than anyone else in that room, including the dumb motherfucker in charge of the census (but he's rich so he must be smart!).  Good for her.

Speaking of that dumb corrupt motherfucker Wilbur Ross, somehow Trump stumbled on a fantastic Undersecretary of Commerce for Intellectual Property/Director of the USPTO.  No idea how that happened, but I'm glad it did.  Obama's second appointee was a google hack and was terrible, but his first one was pretty good.

Also, I think this exchange is demonstrative of the degree to which Congress has abdicated its responsibility to agencies.  Granted, the census shouldn't require much oversight, but the fact that a freshman rep, a month or two into the job, is the only one that knows the reporting requirements, is very telling.

Yeah, probably better off not saying anything. David can be kind of an asshole. But the man puts out some great 'cue.

There were two dudes cutting.  I didn't get a good look at the other one, but this guy was somewhat short, skinny, and grey, short haired.  If forced to guess, the other cutter was hispanic.  I suppose the owner was cutting?

Also, as alluded to, I got four slices and only the last one had a really monster fat layer, so I was less disappointed overall.  Also wish they had whole japs.

Also, I have never been big on the hatch chile thing.  The mac n cheese had a hint of smoke, I suppose they roast the chiles in the pit?

Just saw Lori Laughlin is out on 1 Million in bail.

Admittedly, I am not following this in depth, but how the fuck is the bail for paying bribes to get your kids into college 1 million dollars?

It keeps coming up, but bail is primarily to secure appearance at trial (and secondarily to detain dangers to society, which typically means bail to high to meet).  Because her husband is Italian, presumably there is a more legit flight risk than your average defendant and the million each is to make them flinch before fleeing.  One might also argue that the $250k that the rest of them seem to be getting is excessive and out of proportion..

    Quote

    (f) With respect to each decennial and mid-decade census conducted under subsection (a) or (d) of this section, the Secretary shall submit to the committees of Congress having legislative jurisdiction over the census—

    (1)
    not later than 3 years before the appropriate census date, a report containing the Secretary’s determination of the subjects proposed to be included, and the types of information to be compiled, in such census;
    (2)
not later than 2 years before the appropriate census date, a report containing the Secretary’s determination of the questions proposed to be included in such census; and
    (3)
after submission of a report under paragraph (1) or (2) of this subsection and before the appropriate census date, if the Secretary finds new circumstances exist which necessitate that the subjects, types of information, or questions contained in reports so submitted be modified, a report containing the Secretary’s determination of the subjects, types of information, or questions as proposed to be modified.

  6. I like talking about AOC for the same reason I like talking about Elizabeth Warren.  They're putting forth some ideas on real problems.  Warren's generally strike me as more realistic and probably higher priority issues than what AOC goes off on, but I can't think of any GOP politicians that are putting forth real, actual ideas.

    TMZ:

Lori Loughlin's daughters are not letting USC decide their fate, because they will NOT be returning to the University for fear of bullying ... sources connected to both daughters tell TMZ.

We're told 19-year-old Olivia and 20-year-old Isabella have made the decision to withdraw from the University. Our sources say they have the full support of their parents, Lori and Mossimo Giannulli, both of whom have been indicted in the college bribery scandal.

Our sources say the family feels certain, if the girls went back to USC, they would be "viciously bullied." So, the decision has been made.

As we reported, the indictment claims Lori and Mossimo paid $500,000 to have their daughters designated as recruits for the crew team at USC ... despite the fact they did not actually participate in crew. Mossimo allegedly sent action photos of their daughters on rowing machines to Rick Singer, the ringleader of the alleged scam, and he presumably sent them on to USC.

We're told Olivia and Isabella never really wanted to go to USC. Our sources say they liked the concept of school principally because of partying, and had their sights set on Arizona State University. That's why Mossimo sent an email saying he wanted to get his daughters "into a school other than ASU!"

Our sources say Olivia in particular "is a mess, despondent and feeling like it's the end of the world."

We're told Olivia and Isabella will "lay low" and not try and enroll in another school ... at least not for a long while.

We need to revive the old 3:16 "model/actress/whore" or m/a/w.  It seems to fit most of these social media twats.

And is it really "bullying" if you are a) an adult and b) deserve it?

In this case being pro-defendant is pretty explicitly pro-trump, my dude. Pretty sure anti-government is also pro-trump, in line his "burn it all down if it doesn't enrich me" ethos

Gorscuch maybe not, but Kavanaugh is a fucking toadie and will do whatever is in the GOP's best interests. That's why he was selected and why the GOP was willing to let a perjuring piece of shit on the Supreme Court. You know that just as well as the rest of us, but can continue to pretend otherwise if that floats your boat.

I'm not pretending anything, but it's clearly fodder for the conspiracy nuts.  Eliminating the dual-sovereign rule is I think pretty clearly pro-defendant, there's no other way to spin that.  Kavanagh and Gorsuch are at least superficially pretty anti-defendant.  Superficially, you might think a conservative court would not eliminate it, but I am not 100% sure on that.  Either way, they are only two votes.

Well it was about 40 minutes in line. Heading home. Slightly disappointed that they left a huge fat cap on the brisket so 3 thick slices made a pound. I didn't have the balls to ask that it be trimmed. Looks really good tho.

Really fucking good.  I rarely order sides to go but the hatch mac n cheese looked good and is.  The three slices (four total) with moderate fat are outstanding brisket, hard to imagine anything better.  The one with the monster fat cap is good, but crumbly (getting toward the end I guess), fat is rendered, but just too thick to contemplate, really.  Between the sausage and that one slice, the package was dripping grease by the time I got home.

Sausage (Texas Spice) is excellent but almost too greasy, if there is such a thing.

I notice some flavor profile (clove? coriander?) in the brisket crust that is probably related to what you find objectionable on the ribs, c-man.  I can see that, but it isn't strong enough on the brisket to be a problem.

    Bullshit.

Here's a direct copy/paste from the 2018 Texas GOP platform:

Homosexual Behavior: We affirm God’s biblical design for marriage and sexual behavior between one biological man and one biological woman, which has proven to be the foundation for all great nations in Western civilization. We oppose homosexual marriage, regardless of state of origin. We urge the Texas Legislature to pass religious liberty protections for individuals, businesses, and government officials who believe marriage is between one man and one woman. We oppose the granting of special legal entitlements or creation of special status for homosexual behavior, regardless of state of origin. We oppose any criminal or civil penalties against those who oppose homosexuality out of faith, conviction, or belief in traditional values.

Definition of Marriage: We support the definition of marriage as a God-ordained, legal, and moral commitment only between one natural man and one natural woman.

State Authority over Marriage: We support withholding jurisdiction from the federal courts in cases involving family law, especially any changes in the definition of marriage.

Is there or has there been a plank in the Democratic platform that flies in the face of established settled law like this (or abortion for that matter)?  If there is, or was, I suppose it had to do with gun control.

I had been getting sick and tired of GOPs tilting at social windmills for quite some time.  When it lost all credibility on fiscal issues, I was done.  Then came Trump.

    It's pretty disheartening.

  13. Well it was about 40 minutes in line. Heading home. Slightly disappointed that they left a huge fat cap on the brisket so 3 thick slices made a pound. I didn't have the balls to ask that it be trimmed. Looks really good tho.

  14. Edit: it seems that perhaps NY courts do not interpret "same offense" in the constitutional way, but it also seems very unclear. Perhaps this is where there is some leeway for the prosecution.

Also the dual sovereignty rule, which is I think a bad one, is currently under review at the USSC. You conspiracy nuts can go apeshit on whether Kavanagh and Gorsuch are going to rule "in Trump’s favor" with an uncharacteristically pro-defendant decision.

Cy Vance appears to deserve some past criticism and caution seems warranted but here's some input from a former Fed and NY prosecutor:

--- On #3, because the jury hung and the defense sought a mistrial, those charges are highly likely *not* to be subject to #NYS's expansive "transaction test" for double jeopardy. /2

--- On #1 and #2, question is whether the federal counts and NY counts have at least 1 different element (they do), AND whether they were "designed to prevent very different kinds of harm or evil." /3

--- For falsifying business records, there's a very good argument (likely correct) that that charge was to prevent a very different harm/evil than federal bank fraud, since no federal analogue was charged. (Counterargument is false records charge requires "intent to defraud"). /4

--- For #1, bank frauds for which Manafort *was* convicted, it's a tougher road for @manhattanda. Argument that DA will have to win is that mortgage fraud was designed for different harm than bank fraud. /5

That is a poor analysis on almost every level. Guilty is not required on the face of the statute. Type of harm has little or nothing to do with typical DJ analysis. It's elements of the offense and evidence in support. Maybe NY state law is aberrational in that respect.

Now if they address separate transactions from the federal indictment, that is a different kettle of fish.

  16. Line is insane as is parking. Fuck. I am going to be pissed id they are out of anything.

Forgot how much I hate lines.

  17. Ten50 is Larry Lavine isn't it? He must be old af because I went to hs with his kid who was a freak.

What's the reced sausage at cattleack?

  18. Thanks, this is for like a pound of brisket and some sausage, take out.  Not trough quantities.  There are several decent reviews of Ten50 right in this thread.

Does Cattleack have a separate take out line or any sort of accommodation?
