    I'm sure the CFO and anyone who didn't report all this as income will get wacked, but I'm not sure how fringe benefits makes it back to Donald.  Trump didn't force them to not report this as income on their tax returns, and he also didn't prepare (or likely even sign off on) the company's tax and informational returns.  Maybe there is some "conspiracy to commit tax evasion" or other avenue to get at him, but that would require some documentary evidence he was involved in some material fashion and seems pretty unlikely.  The risk here is with the company and the individuals in question.  The DA is clearly trying to rattle their cage to get them to flip on Trump.

There is no grey area here, and it is not the sort of thing that anyone who works in tax/benefits would miss or confuse as being non-taxable.  If companies don't intend to sell or raise money (and thus, undergo diligence), they'll sometimes take aggressive tax positions banking on the risk of audit being low, but this isn't "aggressive" - it's just straight up illegal.  The statute of limitations (e.g., how far they can go back and assert tax) is typically 3 years, except in cases of a substantial understatement of income, in which case it is 6 years.  If fraud is proven, I think it is unlimited?

    I spoke with a source on the Texas side and the Longhorns talked with Banks and his family today. I was told the conversation went really well and there’s still confidence from the staff on where they stand. There’s obviously something off about this whole situation, but confidence on that side hasn’t changed. (Mike)

     

    So did he tell Texas he's coming, or nah?  That question seems like it would have come up since he's announcing so soon.  What could he have said to have given them confidence without telling them he's coming?  This recruitment has a super weird feel to it and we don't seem to win those.

    Well, of course, but these are negotiated documents, particularly the credit facilities that have the capacity to bankrupt a large company.  Borrowers that banks will lend hundreds of millions of dollars to absolutely have some leverage.

I think that twitter thread is a little overblown.  Granted, the Trump Organization may not have had much leverage when the loans were negotiated (or it may have had a ton if the facilities were entered into when Trump was president), but my understanding is that these documents are generally pretty borrower favorable. No one wants to enter into a loan which can be called at the drop of a hat. 

    I'm not sure what loan covenant this would even trip - I've never seen an agreement where an entity represents it hasn't been criminally charged.  Perhaps compliance with laws?  Doesn't that typically have an MAE qualifier?  Plus, the lenders may not call the loan even if they could, because Trump can't pay them.  Better to keep collecting the monthly payments that jeopardize the whole thing, I would think.  I'm only vaguely familiar with credit facilities/loans, so someone please tell me if I'm way off base.

I'm not totally clear on the status of the Johnson Amendment (I think it is still technically on the books?), but I once went to a church service while visiting my grandmother in small town west Texas where the pastor compared the "persecution" of Trump to Jesus.  It's basically impossible to enforce/police, but if you're getting a tax break from the government, you should not be a political vehicle.  I'm sure the IRS ignores 99% of cases because it would immediately be put on blast on Fox News ("IRS stormtroopers audit freedom loving small town church over its Christian beliefs and free speech").

This worries me.  The fact that the operator reached out to the US about a Chinese plant, knowing how that would go over with the Chinese government, tells me there is more to the story than meets the eye.  And whether there is a serious issue or not, the US isn't going to publicly acknowledge anything is wrong at this point.

    Top contenders are beginning to emerge for Austin (Texas) Westlake Top247 2022 quarterback Cade Klubnik.

    “I’m still taking my time and learning a lot more about schools every day,” Klubnik told 247Sports before going in on the programs coming at him the hardest. “I would say North Carolina, Florida and then Texas pretty hard and then Clemson, too.”

    It's easy to see why those schools are pushing.


    As a junior, the 6-foot-2 1/2, 178-pound Klubnik threw for 3,495 yards and 35 touchdowns with another 583 rushing yards and 15 more scores in leading his team to a state championship in the Lone Star State’s largest class. The four-star prospect elaborated on the programs mentioned.

    Regarding the Tar Heels: “I think they've got a ton of potential coming up in the next few years. What they’ve done the past few years with Coach (Mack) Brown I think it’s pretty cool and pretty promising what they can do in the future. Coach (Phil) Longo and Coach Brown I’m definitely pretty close with now and I’m talking with them probably once or twice a week.”

    Regarding the Gators, Klubnik talks often with Dan Mullen, Garrick McGee and Tim Brewster: “They have the potential to be something great. I’m liking them a lot right now and it’s pretty cool learning about them more every day."

    Regarding the local Longhorns where new coach Steve Sarkisian landed a pledge from touted signal-caller Maalik Murphy over the weekend: “They’re still saying they really like me and wanting me. They’ve still had a lot of communication and I’m still just learning more about it every day. I’m liking what they’ve done at Alabama the last couple years and I’ve done a couple Zooms watching ball with them and it’s been pretty cool to see their style of offense and their ability to take shots downfield and not be afraid to play to win.”

    Regarding Clemson, which has yet to offer: “I like them a ton. We’ve had a good relationship since June. Definitely a really good relationship with them. I love their culture and their school and the people there. Just the consistency of success in the football program is one of the big things I look for and the people that drive it every day. I like it a ton and all aspects with them.”

    Klubnik does not have a timetable for a college decision.

    “I think when I know, I’ll kind of know,” Klubnik said, reiterating these are the top contenders for his signature. “I would say kind of these schools unless something new comes, I’m not sure anything would.”

    Klubnik has 30 offers to date. He is tabbed by the 247Sports Composite as the country's No. 6 pro-style passer and No. 155 prospect overall.

     

     

    Can't wait for the inevitable Wescott headline "Klubnik picks X over Texas, others" when he goes somewhere else because we landed Murphy.

    This makes me wonder if the 25th hasn't already been invoked.  Not saying it is likely, but there are some signs.

    Nailed it. Guys like Lincoln Riley, Ryan Day, Matt Lafleur, and Kyle Shanahan have showed that you just can’t have success as a HC who calls plays. 

    Sure - but it didn't work out for Tom, and "revamping" the offense was a major reason we hired him.
