    A possibly more complete video.  The kid was a little aggro with him Mom, but didn't deserve anything like the treatment he got.

    Spitting is nasty business and probably deserves some kind of charge, a misdemeanor.

    But deputy aggro was completely out of line.  And no longer has a job, according to that story.  The initial mall cop was out of line too.

    A point of reference:  one can defend oneself, legally, with a proportionate response in an assault situation.  That is not an excuse of provocation.  Provocation is almost never a legal excuse for anything.  Cold cocking a seated cuffed juvenile is not justified, legally or any other way.

    If this were in Texas (it's not):

    It would be an assault by the kid on his mom (class C offensive contact or A for bodily injury if she suffered some level of physical pain)

    It would be an assault by the security guard, aggravated assault if the kid suffered serious bodily injury, for which there appears to be no legal justification.

    The kid spitting on the cop is felony harassment of a public servant.

    The cop punching the kid in the face is in no way justified by what the kid did. He is sitting on the ground handcuffed and the force used cannot be justified as either self defense or force being used to make an arrest. He should be charged with assault and/or official oppression and lose his peace officer license. I've handled many harassment of public servant cases and never once has a cop beat the defendant's ass for it. That cop's behavior is inexcusable.

    The original charge of UCW is a misdemeanor.

    Next court date is 2/20

    I spent 02-07 there and other than a few long-running local institutions, it was mostly just cheap hole in the wall joints and college bars. Every time I go back (usually 1 weekend a year), there's something fresh and new and some old bar or restaurant I used to go has been torn down or converted. 

    Had some brews there last night. They have a good food menu and the beers are tasty.

    I attribute much of San Marco’s growth to the outlet malls. Does that sound accurate to everybody? 

    No it is the school enrollment has skyrocketed to 39,000 and growth along the 35 corridor

    Apparently the FBI has evidence regarding the known partial DNA samples that may eventually help solve the crime, which they inexplicably refuse to share with Travis County prosecutors for “privacy” reasons and because they claim it “probably” won’t help. This begs the question as to how they know it “probably” wont help. Maybe it will, maybe it won’t. Maybe we should test that out chief. 

    This case has stunk from the beginning and the smell of it gets worse every single day.

    I am somewhat slightly personally torn because for the families sake and for justice sake I want it solved, but am also afraid what it may ultimately lead to and the damage it may do to my own town’s reputation for not having solved it much earlier and for what really might have happened. But ultimately I say fuck that and the latter is immaterial, solve it and let the chips fall where they may.

  7. Years ago I was in court, before the cases against the boys had been shown to be false, and I was sitting in the gallery talking to a client. The judge called the docket and lo and behold on the other side of me I was sitting next to Forrest Welborn. 

    It took everything I had to not ask him if they did it.

    A warrant for a DNA database wouldn't be issued.

    The 4th Amendment requires that the place to be searched or the thing to be seized in particular is or contains evidence of a crime......not speculation that searching hundreds of thousands of things (DNA profiles) might reveal evidence of a crime.
