True but the burden is on the prosecution.

And I get that limiting the # of years would create injustice as well.  I just don't see it being feasible to ask witnesses to reliably state what happened 20 years ago.  At best, its a memory of a memory by now.   You might recall your testimony more than the actual event.  Or recall what you've read about the case.

Yep, the party with the burden of proof suffers the most under a belated retrial scheme, but I like that allocation of risk.

And, the state doesn't have to fight every appeal so that the process takes 18 years, either.  I am frequently appalled at the stances DAs take when the injustice in a trial becomes manifest.

The state holds all the cards, if they want to risk postponing a retrial by fighting, that's fine.  They have plenty of other alternatives.

  2. There is/was a doc on SHO called The Trade that offered some glimpses into this world.

A part that stood out were these Mexican women that seemingly just opened their homes to be used as drug mini-warehouses.  Apparently, the dealers would drop off the drugs and pick them up for redistribution from a bedroom in the house seemingly at will.  The women were paid, and unclear how much, but otherwise didn't know much about what was going on, other than knowing full well that it was a drug stash.  They didn't seem to be Griseldas or living a high-flash lifestyle, although probably better than their education/skills would permit.

Agree that nothing on the podcast convinced me he was innocent, but they produced enough info that I questioned whether he was guilty.   However I fully admit that I don't have strong feelings on the matter either way.

I do disagree with a system that allows for retrials 18 years after the original trial.   I don't think anyone's memory is solid enough to withstand questioning after close to 20 years.   The state should just get him to plead guilty for a lesser charge with a sentence of time served.   Both sides can declare victory and move on.  Otherwise they will waste taxpayer money on a new trial that will most likely result in a not guilty verdict.

I get what you're saying about retrial 18 years later.  But the alternative seems to be some sort of "finality of judgment" rule that says you can't reopen or retry a case, under any circumstances, X years after judgment is entered.  That kind of thing is OK for civil litigation, I suppose (it has to be over at some point), but seems really out of place to me in criminal litigation.  Many criminal appeals and writs are denied on "finality of judgment" grounds and it's pretty lame to me.

And, as you note, from the prosecution standpoint, 18 years later is a significant handicap for witness availability and reliability.  Could be for the defense, as well.

  4. It's really hard to tell.  While McRaven apparently did not endear himself to the lege, it is impossible to achieve flag rank without fair political acumen, at least at the federal level, which I assume may be a different game than Austin-level.  Tillerson might have precisely the same problem.

I'm not sure it's fair to judge Tillerson on his stint in a very dysfunctional administration.  I suppose you could judge him for accepting a position within that administration, though.  Then again, who really expected this shitshow.

Other than optics, not really sure what his Russia ties, or lack thereof, have to do with the position of Chancellor.

This happened when we were in school.  It just wasnt all over the internet and kids kept their mouths shut.  Seems most of these teachers are getting caught from phone usage.

I very much tend to believe there's nothing new under the sun as far as deviant, weird, or evil behavior.  We just know a lot more about it thanks to the media and now technology.

Not sure if that's good or bad.

  6. I mean, yeah, you let a guy with exquisite taste like Jerry Jones have your merch/gear franchise, what do you think is gonna happen?  Fuckin Patterson.

That said, I do have an old-school white longhorn logo t-shirt that's fine and a synthetic hoodie that's fine (both gifts), but the hoodie is black.  I could live a long, contented life without ever seeing black Longhorn gear again.

  7. Could be yes.  Also, a federal priority for some unknowable political reason.  Some FBI agent(s) is parlaying this into a higher profile.  Note how often the news will trumpet "Sex Trafficking" and how peripheral are the actual crimes most of the time, e.g. a small-town hooker/john sting (where no doubt some of the hookers were trafficked), this.  They never seem to find cargo containers full of Eastern European or Asian women or the people who do that.

  8. Yeah I was having a brain cramp caused by changing browsers.  I had been defaulting to fluid view in Firefox and switched to Safari, where a cookie/site pref wasn't set.  I couldn't remember what I had done.

Fluid view is pretty cool with the ability to include/exclude forums.  Solves that cloak room problem if you are so inclined.

  9. While this guy was no doubt no good on many fronts, I find it somewhat amusing that the feds have him on "sex trafficking."  I'm sure it's not too difficult to shoehorn his various malfeasances into the sex trafficking statute.

But this isn't what people think of when they think of sex trafficking and it isn't what international humanitarian organizations have in mind, either.  The fucking FBI and their "comstats."

  10. On the desktop site, I am using "unread content" as a substitute for the old board's "what's new" (I think that's what it was called), that is, just to see what is current or hot.  However, I think it excludes threads that I have posted on.  I see how you can customize the feed there, but I don't see a way to include threads I have posted on (I see how it can be ONLY threads I have posted on).

I believe this is the same as "newspaper" view on mobile.

Is there a way to get newly posted-on threads without excluding those I have posted on?

There is also the "fluid" view that may be doing what I want.  In fact, I think it does, but can anyone confirm?  And is "fluid view" available on mobile? Oh, I see that it is.

Looks like "fluid view" is what I want to use to replicate "what's new" on the old site?

    TIA.

I couldn't figure out how to get to the settings without signing up for a Samsung account which is fucking bullshit if that's actually the case. But if wasn't my phone and I spent 5 minutes messing with it while trying to eat dinner. If it's easy I'll pass along the instructions to my friend who is technology challenged. Thanks for the info.

Have to buy the dev a cup of coffee to remap while locked, but pretty easy.  There are others, also.

I see, I just think competition is the solution to protect customers rather than government regulations. The big companies pushing it seems to me they have lobbied to get things in there that will stop them from having competition.

To me it's fucked that there is only one provider where I live for fast internet. Do the satellite based 5G through the government and give it away for free, fuck the cable companies.

I mean, you are aware that the only entities pushing against net neutrality are, in fact, big companies?  Big companies who stand to profit immensely from being able to prioritize traffic?
