    There has been a robust gray market for computer chips and other technology for a long time. Many are brand new chips diverted from normal supply chains. There are also lots of fake chips being distributed around the world. I'd guess the gray market is exactly where a restricted country would look to purchase their items.

  4. I've been on and off about buying a Tesla since right before the pandemic. One of my motivating factors was the amount I had to drive, but now I'm fully remote. The tax incentive back on the table has me considering a 3 or Y. I have several friends with 3s and one with a Y and they love the vehicles.

    One question I have, pertaining to a youtube video I watched, is the true range you get from the vehicle. This guy was saying his 3 always fell well short of the range indicated by the vehicle. I.e. it said he had 120 mile charge left but he could get 70, etc. Does the range indicator hold true? Also, he lived in a cold environment (I'm in Texas so not a huge concern) and said that just zapped his range. Any thoughts are appreciated, I'll hang up and listen.

    The principal can’t press charges, so I don’t know why people keep wanting that. The principal can have the situation  investigated by an SRO. Giving the parents the option is pretty standard because some parents don’t want their kid interviewed by a cop or potentially to have to testify in court with the aggressor present. I have had MANY parents that only want their child dealing with school administrators for the school related consequences and do not want them talking to cops. If you press charges that will 100% happen.

    "Pressing charges" is some sort of tv fiction. Victims of crimes don't press charges in Texas. Criminal charges are between the offender and the state of TX. The principal has an obligation to report to a law enforcement officer per their own policy, if one was not involved here. The law enforcement officer, with probable cause, is obligated to turn the case over to the DAs office who chooses to file a criminal complaint.

    I understand the desire for some victims of crimes to not want to prosecute, but those conversations should happen once the case hits the DA's office, not some decision made at a school admin level. It can also create some pretty significant exposure for the school if they don't report the crime, particularly if its contrary to their written policy.

  6. Page 3 of the round rock student handbook places an obligation on the admin to report it, like someone said, tell them to do their job.


    Reporting Crimes (Page 3)
    The principal or campus behavior coordinator and other school administrators as appropriate
    shall report crimes as required by law and shall call local law enforcement when an
    administrator suspects that a crime has been committed on campus.

    This is where I'm at. Asking do you want to press charges, like someone suggested above, is the school asking if you want them to get the police involved. I can't even comprehend how failing to report an assault on campus is not contrary to policy. They need to do their job as an admin and report to the policing function who then should be obligated to turn over the case to the DA, regardless of whether you want to "press charges". Otherwise, they are failing to protect the students safety and well being.

    She'll likely be put on juvenile probation which will require a bunch of stuff that sucks like meet with a probation officer, drug testing, school attendance and performance requirements, curfew, etc. The purpose is to make sure they are being good kids and hopefully deters another episode. If they violate conditions of probation, the judge could extend the probation or order confinement in a juvenile detention facility. 

    Oh, and if this all happens, and the kid gets probation, ask the DA's office (victims services, the prosecutor, etc) for restitution for the costs associated with your ER visit...this is something the judge can order as a condition of probation.

    Assuming this is Texas, it is assault which is indeed a Class A misdemeanor. Yes, press charges, I don't even know why they are asking the cop should just file the case.

    Nothing happens to minors in juvenile court (she'll probably get probation), unless she's had other convictions, but they will have to go through the process which hopefully deters the kid from doing it again. 

    Statute is below and fairly simple. Bodily injury in Texas is defined as physical pain, illness, or any impairment of physical condition.

    CHAPTER 22. ASSAULTIVE OFFENSES

    Sec. 22.01. ASSAULT. (a) A person commits an offense if the person:

    (1) intentionally, knowingly, or recklessly causes bodily injury to another, including the person's spouse;

  11. The entity will want to be made whole. The criminal matter, if guilt is determined, has two punishment options which are pen time or probation. A condition of probation can, and would in this situation, have payment of restitution in the full amount according to a schedule falling within the term of probation. 

    If restitution is a condition of probation, and a payment is missed (or any other condition of probation violated), a motion to revoke can be filed and the individual can be sentenced to pen time. If they are sent to the pen under any circumstances, the restitution is no longer on the table in the criminal matter as there is no probation.

    SOL for insurance fraud under the TX code of criminal procedure is 5 years. They were charged with fraudulent securing of document execution which has a 7 year limitations period (this of course from the time of the offense). It's also important to note that this is a first degree felony based on the monetary value.
