  1. Page 3 of the round rock student handbook places an obligation on the admin to report it, like someone said, tell them to do their job.

    Reporting Crimes (Page 3)
The principal or campus behavior coordinator and other school administrators as appropriate
shall report crimes as required by law and shall call local law enforcement when an
administrator suspects that a crime has been committed on campus.

Commits an assault (see glossary) under Penal Code 22.01(a)(1).

Since there's 4 pages, I assume someone has said this, but ... tell the school to do their fucking job and file a police report. There's no reason that should be your responsibility. You and your son don't need to have any involvement. If the police come to question him, just say he doesn't remember. He thought he fell. Had no idea he was pushed until the principal called you. Tell them you heard there was a video and that's all you know. If your kid gets bullied because of it, tell him to have a prepared response. Something like "fuck off, I don't even know who you are."

This is where I'm at. Asking do you want to press charges, like someone suggested above, is the school asking if you want them to get the police involved. I can't even comprehend how failing to report an assault on campus is not contrary to policy. They need to do their job as an admin and report to the policing function who then should be obligated to turn over the case to the DA, regardless of whether you want to "press charges". Otherwise, they are failing to protect the students safety and well being.

I don't know if putting her in "the system" will do anything but introduce her to even worse criminals and deviants. But it's what she deserves.

She'll likely be put on juvenile probation which will require a bunch of stuff that sucks like meet with a probation officer, drug testing, school attendance and performance requirements, curfew, etc. The purpose is to make sure they are being good kids and hopefully deters another episode. If they violate conditions of probation, the judge could extend the probation or order confinement in a juvenile detention facility.

Oh, and if this all happens, and the kid gets probation, ask the DA's office (victims services, the prosecutor, etc) for restitution for the costs associated with your ER visit...this is something the judge can order as a condition of probation.

BTW, the security officer didn't say the exact charge but did say it would be a Class A misdemeanor

Assuming this is Texas, it is assault which is indeed a Class A misdemeanor. Yes, press charges, I don't even know why they are asking the cop should just file the case.

Nothing happens to minors in juvenile court (she'll probably get probation), unless she's had other convictions, but they will have to go through the process which hopefully deters the kid from doing it again.

Statute is below and fairly simple. Bodily injury in Texas is defined as physical pain, illness, or any impairment of physical condition.

    PENAL CODE

TITLE 5. OFFENSES AGAINST THE PERSON

    CHAPTER 22. ASSAULTIVE OFFENSES

Sec. 22.01. ASSAULT. (a) A person commits an offense if the person:

    (1) intentionally, knowingly, or recklessly causes bodily injury to another, including the person's spouse;

    In almost every market.

First time caller, long time listener. This can go into the stupid question bucket, but looking for a simplified response if any. Does the group here expect TX home prices will start to drop significantly in the coming months? Or do you anticipate the market has reset and this is the new normal? I know there are a lot of factors at play with supply/demand, building, rentals, interest rates, etc but would there be a general outlook of prices coming down or staying near the same. Thanks.

  6. The entity will want to be made whole. The criminal matter, if guilt is determined, has two punishment options which are pen time or probation. A condition of probation can, and would in this situation, have payment of restitution in the full amount according to a schedule falling within the term of probation.

If restitution is a condition of probation, and a payment is missed (or any other condition of probation violated), a motion to revoke can be filed and the individual can be sentenced to pen time. If they are sent to the pen under any circumstances, the restitution is no longer on the table in the criminal matter as there is no probation.

Statute of limitations for insurance fraud or similar (however it's charged) is five years.  I can't remember if there's something akin to the discovery rule on the criminal side of things, but we're six years out.  I'm sure there's some way they're saying it's tolled.

SOL for insurance fraud under the TX code of criminal procedure is 5 years. They were charged with fraudulent securing of document execution which has a 7 year limitations period (this of course from the time of the offense). It's also important to note that this is a first degree felony based on the monetary value.

I tried to look up his age on Google. I couldn't find it. He's been at Texags since 1997 (25 years) so he must be older than 45.

I think somebody is having a mid-life crisis concurrent with arrested development from his college years. Weird guy. And he sounds like an idiot whenever I hear him on the radio.

His mugshot info shows he is 48.

    Ummm, seriously?

    All. The. Damn. Time.

Traditionally “feminine” hobbies and pastimes are continually scoffed at.

Find a video of teen girls and women losing their shit at a BTS or Harry Styles concert and I’ll show you a bunch of men laughing at them and calling them psychos.

And women who enjoy traditionally “masculine” hobbies and pastimes are scorned and ignored by men who enjoy the same things, at best, or threatened and harassed, at worst. See, the way the internet responds to female football fans or Gamergate.

If the Finnish PM was a young man doing the same stuff, there would not be this kind of backlash.

All that hates gonna burn you up.

Less is more.  Use only about 1/8 tsp of ground cinnamon and nutmeg.  Do a lattice top crust.  Unless you are good with homemade pastry, use Pillsbury Already Pie Crusts.  Dot the top with 4 Tbl of butter.  Bake for 30 min at 425 and 15 at 350.  For the apples, Granny Smith is my favorite.  5-6 thinly sliced depending on the size. 1/8 tsp of cinnamon and nutmeg.  Dash  of salt and 2 tsp of lemon juice and 4 Tbl of flour and 1/4 cup of water.

You forgot the cheese...make sure you get a melt as well.

I'll freeze celery before it goes bad, if only to use it to make stock later.

This. I keep a large ziplock in the freezer with all sorts of left over veggies, or even ends, that would get tossed. I use that with a chicken carcass for stock (like that rotisserie one noted above), good stuff.

Right I'm saying whoever is getting tagged with those charges could look at intent to distribute simply because there's a gun along with the drugs. That much weed is a hard sell even with the gun. I wasn't aware of the amount when I commented.

I see what you're trying to say, but that simply isn't how the law works.

Delivery means you are actually busted intentionally or knowingly delivering marijuana. The term "deliver" means to transfer actually or constructively.

The gun in and of itself plays no part (though under some fact pattern it could, but its not an element of the crime).

There was also a gun charge. Weed is one thing - having weed and a gun is no bueno.

But - like I said - it's a trivial.amount of a drug that is being prosecuted less and less so it doesn't really matter.

Under the TX penal code, its only UCW if you are in possession of a firearm while committing an offense above a class c misdemeanor (among other things that aren't relevant here). The passenger is (likely) saying I was in possession of the gun and weed, so there you have it.

Once those two things are out of the way, the DWI with a BAC under .06 goes away no problem. Note the BAC, even under the legal limit, is not dispositive of DWI but that's not important here.

According to KBTX the charges were dropped.  I can't copy the link on my tablet, but it is in the Sports section of their website.  Of course, the aggy University Police made the arrest, then dropped the charges, so...

My first thought when I saw the charges was whether there was a mercenary in the car to take the fall. Did the other guy get charged that night as well? If so, that typically happens because neither guy said that's my stuff, denied knowing it was there, etc and they both get taken in.

If the other guy did NOT get charged initially, and is now getting the case, then that is super shady.

Either way, nothing to see here, mercenary takes the fall, Jimbo runs a clean program.
