In MN, lesser included offenses can be found by the jury. So, you can charge with second degree, they can choose to convict on third degree.
I think the only danger in overcharging is if you go so far out on a limb you lose credibility with the jury. But I do not see that being an issue here. Seems pretty textbook second degree murder based on the video.

What about Prosbiec, who made an actual false report, causing police resources to be diverted looking for his completely made up terrorist cell....and after it was amplified by numerous other mouthpieces, including you. Should he face legal consequences for making a flat-out fake statement to divert police resources and create fear and unrest? You know that knowingly and intentionally propagating false information to propagate fear and violence is actually terrorism, right?
If you want to start prosecuting media members for false reports and fake news, I am not sure we have the prison space. And I am not sure it is legally actionable unless you make the report to law enforcement.

Cool.
Does the factual reality of that arrest and the fictional story you posted yesterday affect your belief in the right wing news outlets pushing Antifa as the source of violence?
Sent from my Pixel 3a using Tapatalk
Yeah. I think that issue is now settled and Antifa has nothing to do with the rioting and looting. None at all.

Anyone want to take bets on if he plays game 1?

Any comment you would like to add about the arrests made yesterday by the FBI alleging three men connected to right wing extremist groups plotted to incite violence with Molotov cocktails?

I hope they are punished to the full extent of the law.

Well there was also the issue that the claims made in the tweet were so preposterous that it should have merited some google/news confirmation.
That's fair. I will be more careful going forward.

My brother and I worked together one summer during high school at Luby's. It was the most time I've spent with my brother since, so Luby's will always have a soft spot in my heart. I received a free LuAnn every work day, and I never grew tired of the food. My go to : LuAnn baked white chicken with cornbread dressing, cranberry sauce, fresh green beans and candied yams with a jalapeno cornbread.
I think many of the people that don't like Luby's, don't know what to order there. I've never ventured away from roast beef with au jus, whole bird turkey on Thanksgiving (not that turkey breast roll stuff), baked chicken with stuffing, chopped steak, fried chicken, chicken fried steak, and chicken fried chicken. I know liver and onions is very popular as well, but not for me. If you order anything else, sure you're going to be disappointed. Their ribeye is hot garage and would be thrown away at a Golden Corral. It shouldn't be on their menu.
If we're shouting out cafeterias, Cleburne Cafeteria on Bissonnet in Houston. Best cafeteria I've ever eaten at. Everything is good so you really can't go wrong, but I usually order one of the daily specials. Superb fried chicken.
I probably eat there once a month with my extended family. It is good. I think because it is family owned and operated. If it was a chain, not sure it would work.

Props on actually coming back and admitting a mistake.
but I’ll ask you the same thing I asked @stone oak ...are you at all alarmed at how easily you’re manipulated by false information? Given, without a shadow of a doubt, that some of our global enemies are actively propagating false info to try and weaken our country, are you at all concerned you’re falling into their hands?
I think that is a major problem. And the propagation is not limited to our global enemies. I should have checked who that guy was before I posted his report. He had a blue check, so I was giving it more credence than probably I should have.

I would wait until the end of the year to say Sweden did not work out.
It is possible they reach herd immunity and are not smoked by a second wave. Too early to tell.
One thing is clear to me, we need to figure out how to protect nursing homes better. Because it seems like half the deaths, no matter the state or country, are in nursing homes.
