  2. On the 247 site, like clockwork, there are various threads popping up lauding Max Johnson. So far, and by far, my favorite is one titled: Miami Loses To Max Johnson here is the OP text: "Johnson doesn’t have the touch, arm, or athleticism that Weigman has, but his head is cool and he recognizes what he needs to make the play. We also just play different with him. Play action, boot, movement before the snap. We do that for CW and he goes up a level. Max at least was able to get a goal line heavy set play off without having to constantly check the line" I will give Tarp credit. He drove by on the thread and said only "This is the worst take ever"

  3. It's like someone has never heard of the fleet of electric boats that's been cruising around Newport Harbor for....seriously, what, 30 years now? Electric boats are not exactly new tech. He's a fucking idiot, a complete fucking moron. Seriously, if you support him in any way, if you would even think of voting for him, you need to own the fact that you are on team "the dumbest man alive." Really glad someone got around to posting this. Some FACTS that DalTx apparently needs to hear repeatedly: 1) Summary Judgment IS a trial. It is a trial in which the judge determines "questions of law on which there is no issue of disputed material fact." My practice involves a shitload of these: the facts are not in dispute, what happened and what was said/done were done in the open, and aren't in dispute. What they MEAN, legally, is what's in dispute -- and that's for a judge to decide. 2) When a Summary Judgment DOES depend on some facts (e.g., even if they aren't disputed facts, they do need to be in the record), the party making the motion submits those facts. Maybe those facts are a) a copy of the signed contract, b) a copy of the letter from the other side saying "we're not paying you for this month's delivery, and c) an affidavit from my client verifying that indeed, he did not receive payment. Depo testimony is also commonly used. Presuming those are undisputed facts, then the court will consider the legal question presented by those facts. 3) Facts CAN be disputed in a Summary Judgment proceeding. In my example above, see my example of the affidavit saying "nope, I never received payment." But maybe the other side disputes that -- THEY submit an affidavit that says "That's not true, I paid you. See the attached check and bank record indicating my $10k payment for your August invoice." That fact is now DISPUTED, and my Summary Judgment motion would be DENIED. 4) DENIAL of a summary judgment motion doesn't mean that the non-moving party won their case. It means that they survived this procedural challenge, and the question now goes on to a full trial (yes, with cross examination etc.). What this means re: TRUMPCO: The DA presented a motion, saying "these are the facts: a) these are the representations made, and b) these are the actual values/dimensions of the properties/assets at issue. BASED ON THOSE UNDISPUTED AND UNDISPUTABLE FACTS, the elements of our NY fraud case are established." Trumpco HAD EVERY RIGHT to dispute any of those facts -- things like "that's not what was actually said," or more likely "that is only part of what was said, here's the full disclosure with the detailed valuation numbers," and "also, the actual values/dimensions of the properties are not what the DA says they are" [it seems they made a halfhearted attempt at this, but it's functionally impossible to create a "disputed factual issue" on objective measurements]. Trumpco had every chance to put on evidence that would save their case. They didn't even have to prove their position, they just had to raise a QUESTION of fact, by introducing "more than a scintilla" of evidence. Trumpco failed to do so, even when given the chance. That's what summary judgment is, and what it means. You fucking dumbass.

Nobody is actually saying there is zero possibility that an appellate court might overturn all or part of the ruling, as none of us are experts in this narrow field of New York law and there seems to be many moving parts in this, each part subject to potential reversal or partial modification. But if it is overturned - it won’t be because your “opinion” was “correct”. Because so far, you have not put forth anything even remotely resembling an “opinion”. Here is an example: you can say it was improper because the judge wore a button-down blue shirt and the court had a fringed admiralty flag. If the ruling on the motion is ultimately overturned in whole or part, that does not mean you can rooster around and crow that your “opinion” was “correct” all along. Because your frankly embarrassing musings on what does not constitute evidence (and why cross examination transforms stuff into legit evidence) will not be the reason that this order is overturned, if it is overturned. You will get no credit.

  8. I kind of felt like this would happen. We’ve all seen it before. You can even see a little of it here. You can really see on the OU and ATM boards. What’s that? Everyone in the media starting to convince themselves that Kansas will not only play Texas tough, but they’re going to pull the upset. They’re going to pull the upset because they have: a dynamic qb; an opponent in Texas that still doesn’t know how to win (nevermind this is being mentioned as something in favor of Kansas!); and apparently a resurgent defense. Nothing has changed. Daniels has been known to be the KU starter. Texas knows it has to focus every week to achieve its goals. Kansas’ defense, while still shitty, had nowhere to go but up. But, hey, America loves an underdog and the media enjoys talking Texas, whether as a blue blood or a villain or both. It’s all bullshit. Texas is going to roll these guys. Then we get to hear the build up about an angry and resurgent OU out for vengeance as a 9.5 point underdog heading into the RRS. Look at the advanced efficiency statistics!!

  10. Sarcasm isn't very effective when you don't sufficiently understand the material you're discussing. Yes, summary judgment is used to resolve purely legal issues. However I'd say its primary use is identifying those cases where there is no genuine dispute regarding a material fact (i.e., a fact that matters). Further, in order to oppose summary judgment, one has to present actual evidence indicating a dispute of material fact (yes, summary judgment requires consideration of evidence, which generally has to be capable of being converted into an admissible format). Mere allegations that the matter is disputed isn't going to do anything. This is pretty basic and black letter law. From the order, it appears Trump's legal team made a very poor effort in providing such evidence, relying mainly on poor legal arguments or unsupported conclusory statements, e.g.: There is no factual dispute here. Trump inflated the square footage to 300% of its actual value. His purported dispute of fact was that maybe math isn't math and a building's measurements are subjective. That is stupid. And it was never going to be sufficient to defeat summary judgment.

  11. Regarding some of the outstanding targets: -ATM feels great about Bussey but OU thinks they can close him. OU posters are bizarrely confident on this one given that no one besides their mods think they have a chance. What I have been told is "he could have picked ATM any time and given them a boost. why hasn't he?" but my response to that is that Black could have done the same for Texas and we feel fine on him, right? -The aggie moderators are hinting that they might have the lead on Solomon Williams after he visited for the Auburn game. The posters are fawning over him, as they should. If Texas actually leads and locks him up this weekend, the whiplash those posters will have as they play down Williams as a recruit will require chiropractic help. -Sure seems like there could be some interesting developments both this weekend and at the Cotton Bowl with guys not completely on the radar, but I know very little about what those developments will be.
