    Go ahead and decide that Trump is a slightly smaller piece of shit than Hillary, and vote against the bigger piece of shit on that basis - I understand that decision, and have understood it all along (I disagree as to which was the larger piece of shit, but I fully understand that it was a debatable point).  But when you then try to convince yourself and the world that the slightly smaller piece of shit you voted for is really a delicious steak, don't be surprised when we treat you like the deranged POS that you clearly are.

    Correct.  I never had to get the jury instruction, though.  Once his client pleaded the 5th in depo (several times), I reminded opposing counsel of that fact (that I was likely going to get a jury instruction).  Case settled pretty quickly.

    The GOP sold its soul to Trumpism.  So now Trumpism owns 80% of the shares of GOP, Inc.  Act in a way that 80% of the shareholders disagree with, and you will be kicked to the curb.  AND...if what you care about most is your cushy job at GOP, Inc. (as opposed to, say, fulfilling the purported mission of GOP, Inc.: serving the country), then you'll just do what makes the shareholders happy.

    Anyone who'd read any history on the space program knew they made it back alive.  The movie wasn't about the "if" -- it was about the "how" and the "who" that took care of that "if" in the first place.

    But they usually don't.  Because, you know, innocent people don't typically do that.

    If we are in a civil case, and I ask a witness a question, and the witness then responds with "I refuse to answer the question on the grounds that it may incriminate me" -- then every person in the room knows that you are hiding what you BELIEVE to be criminal conduct (and to be clear, you are within your rights to refuse to answer on that basis).  But every reasonable person concludes that "yup, this guy did something illegal."  I've had that exact scenario happen.  As a civil litigator, it's solid gold.

    Cohen pleading the 5th in a civil case is either the dumbest tactical move ever made (so, you have a point -- let's not put that past him) or an admission that he's engaged in what he (and his lawyers who are advising him) believes to be criminal conduct.

    And, of course, what Mojo Hand said.  In fact, an attorney witness pleading the 5th in a civil case would be strong evidence to support such a warrant (remember, while the testimony invoking the 5th cannot be used in a criminal trial, it CAN be the basis for procuring a warrant).

    Look, when I take a road trip, what I hope for is an uneventful trip with a late arrival and not a scratch on me.  That's what we all hope for.

    But now, we're in the following position: because I was looking down at my phone to text someone, my car has careened off the road.  In order to learn my lesson, we should hope that I can't just gently correct, get back on the road, and cruise along as if nothing every happened.  But we should also hope that I don't die, because then there's no good outcome.  Instead, let's hope that I really fuck my car up and scare the shit out of myself, so I never, ever, ever text while driving again.

    We've been intent on driving off the road at full speed for a while now.  If we suffer no consequences, we'll just keep doing it...until the consequences are fatal.  Let's fuck up the car pretty goddamned bad and bust our lip on the airbag.  Let's suffer enough so we say "okay...not gonna do THAT stupid shit again."

    Does he abuse his power by ordering employees to do his bidding, regardless of legality or ethics?  Check.

    Does he view the treasury as his own personal slush fund, to be abused for personal purposes and gain at every turn?  Check.

    You get to hate him for policy reasons.  You get to hate him for competence reasons.  You get to hate him for ethical reasons.  About the only things he's avoided so far are sexual deviancy and animal abuse.  But....Oklahoma....so, don't bet against those quite yet.

    Mueller is like a doctor doing a checkup on the President and he discovered cancer EVERYWHERE! 

    If Cohen pleads the 5th, that's big.  Really big.  And NO, that's not admissible in a criminal proceeding against Cohen, that's not why it's big.

    First, it's big because it may well validate the warrants on his office.  Remember the lawyer types telling us that the "crime-fraud" exception is what would allow for a warrant to be executed on an attorney's files?  Cohen pleading the 5th tells us "yep, and that basis was legitimate here."

    Second, it's big because, while pleading the 5th is not admissible in a criminal proceeding against Cohen, it's ABSOLUTELY admissible in a civil case.  In fact, it's beautiful, solid-gold evidence in a civil case.  When your opponent admits to being a criminal, on the record....well, your case just got a lot easier.

    Third, if Cohen flat-out KNOWS that he's implicated in a crime, and he KNOWS the DOJ now has the evidence it needs to convict him (see the results of the recent raid), then he has incentive to flip.  Big question as to whether he will.  But the prospect of 20 years of federal time has a way of persuading a man to change his loyalties.  We shall see.

    I tried really hard to be mad at the boy.  But shit, man....throwing a sticky eyeball at the ceiling?  Who WOULDN'T try that?
