    A federal judge Tuesday indefinitely postponed the criminal classified documents trial of former President Donald Trump, a court filing shows.

    The trial on charges that Trump willfully retained classified national security records after leaving the White House and then hid them from federal authorities was scheduled to start May 20.

    But U.S. District Judge Aileen Cannon wrote in Tuesday’s court order that it “would be imprudent” to finalize a trial date “at this juncture” when various pre-trial issues have yet to be resolved.

    Cannon pointed to pending questions about how classified information will be handled in the high-profile trial of the former president, and “additional pretrial and trial preparations necessary to present this case to a jury.”

    To move forward with the trial in May would be “inconsistent with the Court’s duty to fully and fairly consider” those issues, she wrote.

    “The Court therefore vacates the current May 20, 2024, trial date (and associated calendar call), to be reset by separate order following resolution of the matters before the Court, consistent with Defendants’ right to due process and the public’s interest in the fair and efficient administration of justice,” Cannon ruled.

    Nobody needed hindsight to recognize the problem with a decent replacement if she held on too long-  and her age and the type of cancer that she had pretty much takes away the need for hindsight.  People were screaming about it at the time.  Anyone here who has tried to pry an elderly parent out of their home for their own good will cosign that it is almost impossible for them to do it of their own volition.  Same deal with the stakes being much higher.

    But please don’t act like the Turtle’s plan was unknowable when he had already publicly stated that his goal was to defeat anything that Obama wanted to achieve.

    I agree with you.   That is more a comment about the legal elements on appeal - and not for whether or not a jury convicts Trump.   But my experience is that one of the 12 jurors will get the fact that they are there to determine whether Trump paid off people to avoid negative publicity - and then improperly wrote it off as a business expense.    Whether the mushroom got wet? I don’t think that will win or lose the case.

    I don’t think it makes any difference if they actually had sex, but it makes a huge difference that she will say that they had sex - hence the payoff. 

    Because even if she didn’t have sex with him, Trump knows she can place him in a hotel room with her alone - and that she is a porn star.

    To be more accurate, our Buckeye friend’s analogy should include the fact that if Sawbonz does not step down now, there will be a great chance that the next hospital administrator will replace him with someone who treats his patients with leeches and blood letting.

    Look, I tried to explain the ex post facto issue. High school civics anyone? And I remind you that this is criminal contempt.   That means the full force of all the constitutional protections afforded a criminal defendant are in play in a criminal  contempt proceeding- including any ex post facto issues - and absolutely including the fact that you’re looking at the highest bar possible, beyond a reasonable doubt. The fact that you want Trump in jail more than you want his hopeful conviction(s) to be upheld is a bit shortsighted.

    I get that because you are not a lawyer you miss a bunch of the competing nuances of law and procedure and prisoners rights - and statutes and case law governing a trial court’s ability to impose criminal sanctions - and the court’s desire to protect innocent jurors and court employees from MAGA fanatics - and a judge who was put on a novel criminal case with an ex President wanting to do everything within his power to protect the chance of a verdict being overturned on appeal.   I get that you want a simple black-and-white resolution to the shit stain that is Donald Trump on trial. I get it. Everyone gets it.  And I also get that you think everything is simple.

    I wish that the practice of law was as simple as ‘ignorance of the law is no excuse’.   I hate to break it to you, but that simplistic catch phrase would exclude, for example, legitimate defenses like constitutional challenges to statutes (or gag orders) being vague and/or over-broad.   You wanting to dumb it down to simple black-and-white choices does not make it so.

    Now, regarding the corrupt SCOTUS, I’d like to borrow that torch…

    The judge never explicitly warned Trump he would be jailed if he did it again until the hearing on the nine contempt charges. The judge then spent time saying what was appropriate and what was not, so there would be no mistake about what he expected.   This is all a precursor to the inevitable jail time, but was absolutely necessary to remove multiple avenues of appeal.  

    I’ve already explained that there were contempt allegations brought before the judge told Trump what he could and could not do - and that he would be jailed if he did it again.  Today’s contempt allegations could not be considered in jailing him because they were all turned in before Trump was warned by the judge and told in detail what would not be allowed. 

    Your post where the judge tells Trump three times do it again and you are  going to jail - and then doesn’t - is bullshit.  Just don’t make up stuff about the trial.  Others read this thread for actual news. 

    I will bet a C-Note right now that Trump gets jailed before this thing is over. Feel free to accept. Loser donates to Surly.

  11. I’m still waiting on my PSA results but my CEA (colon cancer marker) was bigly normal and the radiologist said of my CT this morning, “No definite metastatic disease” and “liver unremarkable”, so I’m not bitching at all and I speak with my Onc Wed. 

    i’m still anemic as fuck five years post-chemo, and one other blood test marker today is abnormal and associated with prostate and multiple myeloma, so awaiting prostate results.  My father died from that so I’ve been keeping an eye on that PSA for sometime.

    Edit: PSA Normal and cholesterol 143.   i’m so healthy right now, I fully expect to be hit by a bus tomorrow.

    In contrast to the first contempt ruling, in which Merchan found nine of 10 statements were indeed willful violations of the gag order, in today’s ruling, Merchan held that only one of the four alleged statements -- the one about the jury — is violative. 

    But he refused to find that the two statements about Michael Cohen and the one about former National Enquirer publisher David Pecker were reflective of criminal contempt. 

    In particular, Merchan wrote that he was not convinced that the statements about Cohen were not political speech as opposed to attempts to intimidate a witness. In other words, Todd Blanche’s presentation of Cohen’s April 2024 tweets seem to have persuaded Merchan that it was at least possible that Trump was, in fact, defending himself against Cohen’s near-constant attacks”

     

    Merchan is making any gag order complaints appeal proof by this.  Trump will eventually get his fund raising moment.

    If I recall, those are the last of the pre-direct warning gag order violations.  The prosecution turned in those prior to the rulings in the first batch of violations, where the court said next time jail.   Because of ex post facto reasons, the court did not give jail for these - as Trump had not received the “next time jail” talk yet, and so the fact they were turned in before the warning to Trump its just money. 

    It is now set up for the next offense being jail.   Maybe an overnight stay? I guess it depends on the content and number.    in an event, the appellate record will be clean and show we had more than enough chances.

  15. I have two buddies, one female, one male, who have taken this stuff.   The doc who prescribes it gives the shot in her office initially, and then sends you home with the stuff. They tell me the doctor buys it from some Canadian compounding source and they get it for about 350 bucks a month.    it seems like the Wild West as far as pricing - and each medical provider has their own marketing ideas and very possibly very different clientele with very different insurance coverage

    Prosecutors displayed evidence showing that Hicks forwarded the email (which included a transcript of the tape) from the Washington Post reporter to other Trump aides: Kellyanne Conway, Steve Bannon, Jason Miller and David Bossie. She wrote: "Flagging." Followed by two bullet points: "Need to hear the tape to be sure." And "Deny, deny, deny."
    Honestly, that is the sort of stuff that paid political PR people do in the normal course of dealing with potential scandals.   I do not personally consider this egregiously unethical, as it is not sworn testimony or communication, and the reason you keep those people around. See James Carville and Clinton.
    But it may stick in some jurors ‘ minds that the Trump coalition, as it were, will always lie to protect itself and to cover up bad acts.  IOW, this is exactly the same kind of negative, campaign-injuring news as the Stormy and McDougall situations, and so Trump and his toadies can be expected to deny, deny, deny the truth of what the prosecutors say he did here. 
    There is zero chance that this exhibit will not be referred to in the prosecutors’ closing.
