I fully understand and don't disagree which is why I put hold the party responsible accountable first. Yes, on the broad stroke the criminal justice systems service is in the name of the state on behalf of the people not the individual, but as with all items the devil is in the details. I like to believe you and Twice both believe that our criminal justice system is in place to bring forth justice, dont you? Let's take a look at the legal definition of justice as described by the Cornell Law School that I hope we can agree is a fair arbiter of the word, legally. https://www.law.cornell.edu/wex/justice Justice has three meanings: (For purposes of discussion and because the second two were covered by both you and Twice I'll focus on the first) Justice is the ethical , philosophical idea that people are to be treated impartially, fairly, properly, and reasonably by the law and by arbiters of the law, that laws are to ensure that no harm befalls another, and that, where harm is alleged, a remedial action is taken - both the accuser and the accused receive a morally right consequence merited by their actions So, I would argue that while the criminal justice system absolutely does serve the people in a broad aspect, in the name of justice it also strives to serve the victims (and those accused) of the crime to receive a morally right consequence, to use the Cornell Law definition. Likely this falls into a semantics discussion but I ask, what is a criminal justice system without morally right consequence and justice for the victims? Who are will killing in the name of? -

What, exactly, would you say is the purpose of the US criminal justice systems if not to serve the interest of the deceased and their family in a homicide? In my world view the entire purpose of a homicide investigation is to hold the party accountable for the crime and help bring what little closure is possible for the family in the name/memory of the victim. I would further argue that many homicide detectives take this obligation to the victims and their family seriously and personally. Its on record and well documented that many such investigators have continued said obligations long after the case has grown cold and post the end of those careers. Not just to punish the murderer but in the memory of the victim and the victims family. -

The entire US/state police and penal system was designed to do something about it. Saying there is nothing to be done about it? I bet the Metcalf and Anthony family would disagree that nothing is being done about it. That said, how many times have you seen Austin Metcalf's name in the thread? What if any details have been discussed about who he was, what he liked, his passion, his life, his dreams. Your take that he's dead who cares is exactly what is/was wrong with the vast majority of criminal investigation documentaries and news coverage. Name 2 victims of Ted Bundy, name 1 from Jeffery Dahmer, 1 from John Wayne Gacy, hell name a victim of Epstein. I'm betting you can't because historically the focus has been on the life of the predator. Fortunately, there is a strong trend surfacing to talk in more depth about the victims of these events rather than just the perpetrators. Their lives and what the perpetrators took from the world rather than JUST the criminals themselves. Forgetting the victims of crime and dismissing them with statements like "the victim is gone and there is nothing anyone can do about it" is diminishing the suffering of the families, not honoring the life of the victim and dismissive of the criminal justice systems part in the story. Why are there memorials for 911, OKC bombing, and a multitude of other deaths? Saying they are dead and there is nothing anyone can do about it disturbs me greatly. -

I'm certainly not going to claim that Texas doesn't have fans that fall into the demographic you're claiming. I know it does. That said there are a goodly number of posters on this board that rarely, if ever post on sports or other topics at all. They mostly stick to CR and Daily Texan. Given the nature of those subs its going to draw the racist trolls that really give zero shits about the University of Texas or Texas Athletics. Is that 100% of them, absolutely not, but I think its the majority most likely. -

The one thing this case has absolutely confirmed, above all else, is the number number of vultures ready to pounce on the cultural "race wars" in this country and the adage a fool and their money are soon to part. One teenage kid stabs another at a track event killing him. Were race variances not involved it's likely a minor story. But before the funeral the internet has taken up arms and sides. The parents of the alleged assailant starts a gofundme. Because "race wars" idiots are fleeced by the parents to the tune of half a million dollars. So as not to have the foolish funders look dumber than themselves the parents align to criminal that is running his own grift. Mean while the internet has the racist white idiots jumping on the opportunity to promote their bullshit cause and I'm guessing also fleacing idiots of their money. At the same time, the father of the victim is swatted for showing up to the social media circus put on by the parents of the accused, no doubt prompted to do so by their own flimflam man whose likely charging them ridiculous sums to come up with this strategy. While all this is occurring right here are Surly someone is actually questioning whether or not stabbing someone with a knife qualifies as "intent to do serious bodily harm". It would be comical if it weren't so common, predictable and based in such a sad event... and all the while.. A young man is dead and he is the lowest priority of discussion in this entire mess. -

This is all pretty accurate. I'll refresh what I said before. Slashing major arteries not protected by bone and lots of muscle is a far better edged weapons strategy. That why any anyone well trained in edged weapons uses a karambit and goes for throat, wrists, inner thigh. Couple of specific areas covered only by a small amount of skin that can end someone's life in minutes or seconds depending on depth of slash. It's also why many serial killers use knives, death from stabbing is usually not fast and typically requires multiple stabs. It's well noted this suffering and repeated abuse is part of the reason serial killers use it. -

No reasonable, logical person believes that trying to stab someone with a knife is not intent to cause serious bodily injury. I grant you're neither reasonable nor logical, but again you're reaching for any straw you can find in a storm. I love that you ignored all the other points and went back to hanging your hat on "Can one really conclude that a person intended serious bodily injury when stabbing them with a knife." It's truly comical. The answer, because you clearly need it is yes, it's completely logical and with the legal definition of Texas law for someone to draw that conclusion and pretty much any jury, judge, prosecutor or sane rational person would as well. At this point you're either trolling or seriously the lack intellectual mental capacity for actual logical and worthwhile engagement. Good luck in your future endeavors. -

No, I dont have to make assumptions. I'm going off only the known facts at this point. As for intent, you and I covered this already about 3 pages back. But here we go again Texas Law: If you pull a knife out and thrust it in the direction of someone that qualifies for the intent to cause serious bodily injury. If that intent leads to their death it is murder by Texas law. Unless there is clear evidence of self defense which to this point I've seen zero (you've provided none) and him being in the tent and not attempting to leave further leans in the not self defense direction so does bringing a knife to a track meet. Also, his confession supports this as well. So your going against known facts, the actual law as it is written, a confession and all reasonable logic to ask your intent question. This is the second time we've covered this, you and I directly. You keep clutching at straws and provide zero links or support for any of your positions. It is pretty typical behavior for you. -

Your illogical attempts at semantics are amusing. Yes, room temperature IQ folks will conclude that if person a pulls a knife out on person B and person B ends up dead from a knife wound that c- person A was trying to stab person B. What an odd, illogical leap of faith with no ties to reality. You keep on reaching out there I'm sure spaghetti monsters, lochness and aliens are next on the possible reasons this occurred. I've noted in every.single.post.on.this.thread. that more evidence or facts may surface that alters my (and other people's) perception of the case, but given the information we currently have it definitely looks like murder. The statements of the suspect is a fairly decent reason to come to that conclusion. And before you go there, yes, I've already noted its not impossible it was coerced. So, am I not to believe the words of the person who, ya know, did the fucking stabbing? -

The premeditated aspect only comes into play on a murder charge as it relates to Capital Murder, which has a different legal standard than Murder. Again, unless he was attacked and defending himself, or some other yet unknown facts present themselves, if you stab someone with a knife, and they die, by Texas legal code, that's murder. -
