Is it possible to sue a large corporation in small claims court? If so, how do you do it and if not, what are my other options?

I have a 2024 Genesis SUV and a check engine light came on. It is supposedly a common issue (maybe even a recall) but I haven’t verified that yet because I don’t have the repair information yet.

Genesis would not have the local Hyundai dealership look at it and paid to have the car shipped to a Salt Lake City Genesis dealership which is approximately 9hrs away. They said the will submit a request to send the car back to me and to keep my receipts for my car rental. I’ve had the rental for 5 weeks and now Genesis says that I need to pick up the car because they denied the return shipping. It is a $600 flight and 9hr drive back home.

I am okay with that loss but if they deny my car rental for over a month - about a $1400 bill - I am going to be pissed. It would have been much much cheaper and much much more convenient to have Hyundai fix the recall and pay for it out of pocket.

And by worth it, I mean assume we have similar temperaments and socioeconomic status.. it’s just easier for you to strenuously object.

That was my “how” part of the question? And I’ll add, is it worth it?

If you are dealing with a particular corporate entity that you can discover from correspondence, they probably have a registered agent in Texas that you can look for/up here.  https://comptroller.texas.gov/taxes/franchise/account-status/search  It's probably Hyundai Motor America.

Small claims courts tend to contemplate personal service in the county they sit, by constable.  But I think they'll do it by first class mail, CMRR, to in state registered agents, also.

They are somewhat likely to settle with you rather than have to hire an attorney to make an appearance and actually defend.  But you never really know.

@TwiceHorn Wouldn't it be a good idea to read ALL of his contract docs to see if there is any  language as to WHERE any lawsuits are to be tried or if a mediation (binding or not) in a mutually agreeable setting & has to occur prior to a suit?

Obviously Iam not a lawyer & didn't sleep @ a Holiday Inn last night.

PS: I might be incorrect,  however I think he's now in Idaho.  Ref: "9 hours from SLC".
