  1. Yes- and at @TwiceHorn points out the crisis is general to the population. But lawyers have a special role in society, and then they fail, it puts the rule of law at risk, which puts society itself at risk. Sigh. My point is that the legal profession does not effectively police itself, especially against bad actors who discredit the profession and weaken public faith in the legal system. Nothing more or less. I’m not sure where you’re getting the condition in bold. I certainly didn’t point to a lack of reporting as a problem, although it may be, I have no idea.

  4. It IS a noble and essential profession. I think we all know that even if we don’t caveat our criticism with that admission. But because it is noble and essential the profession should treat itself with reverence and demand that its members adhere to the highest standards, especially at the highest levels.

  9. Perhaps that’s why it looks like an ethical crisis from the outside. When the preamble of the rules say “it is a lawyer’s duty to _____” most people would think that fulfillment of the duty is the purpose of the rules, and the subsequent language is the descriptive text of some of the ways one would fulfill that duty, but not limited to those things. It seems odd to dismiss it as gobbledygook. And of course the preamble to the second amendment isn’t gobbledygook either to anyone even remotely familiar with the context and circumstances of the drafting of the bill of rights, but lawyers gonna lawyer.

Well gosh, you’ll have to take that up with the ABA, as that is a quote from the preamble to their model rules of professional conduct sec.5. If you don’t know what it means, I’m not sure how I, a simple tradesman peddler, would be in a position to tell you. My premise is that when the richest and most powerful clients or most prestigious and powerful firms are involved, there isn’t, “usually.” That you think that’s meaningless is an interesting (and revealing point), but would you say lawyers have an individual duty to uphold legal process? Can’t it? What’s the maximum time allowed for a crisis to unfold, counselor?
  15. Yep. And in a car you’re looking at 45-90 minutes depending on traffic. The LIRR through Jamaica is a game changer and takes the risk out of the trip. It’s 45-60 mins from midtown to the airport, period.

  17. Doctors think the same thing, which is why they support medmal caps. But I was talking about lawyers not vigorously disciplining members of their profession who choose to be a party to defrauding the court and choose to violate or fail to uphold the law. It’s not an impossible task to enforce standards. It’s merely difficult. CPAs and other licensed and chartered professionals deal with these problems and police them aggressively. It is the “learned professions” of medicine and law that struggle with this. Shady brokers pay heavy fines and often lose their livelihoods. Lawyers get gently chastened and keep working.

In addition to the tracking chip, it would also include a voucher to have your unique Saving America for Trump And Nation number tattooed on your right hand for visual confirmation at checkpoints.
