  2. Ok. So we have a separate preliminary hearing on the “threat to the republic” legal standard? What burden of proof should be used and should that question go to a jury or nah? What would be the elements to meet that burden? Only POTUS elections? Does the timing relative to an upcoming election matter? What if the defendant is not yet the named nominee for said election?

  4. THIS! I guess some would propose a solution along the lines of just having judges state: “ I know that there are rules and shit, but I really think this defendant is a danger to our country so I’m going to just do some shit that I never do otherwise, possible outside what is allowed by law.”
  5. What if someone smoke during pregnancy? Or drinks a glass of wine. All of these things have some possible detrimental effect on the fetus. Is that grounds for the state taking legal custody of someone’s child?
  6. That might figure into it. Pretrial diversion isn’t just reserved for cases with “proof problems” though. I’ve gotten LOTS of them for clients with cases that were clearly slam dunks for the State.
  7. I dunno. Ask my low income client that got a pretrial diversion just like this for his charge of felony domestic violence-strangulation. To be clear, it IS a generous offer from the State, and I don’t like it. It’s not the anomaly that some people think.
  8. The fact that his regular gig is as defense counsel has zero to do with the result. I say this as someone who has worked on both sides of the system. I’m not defending the agreement, but him being a defense attorney getting the blame is a weak take.

  12. NSIAP, but in Texas, A person with a felony conviction can vote if they have finished the full terms of their sentence. This includes any periods of incarceration, parole, community supervision, and probation.
  13. Yep/. Also, you’re leaving out the potential charges for mass murder when fertilized embryos are destroyed. They can’t be frozen forever and currently, a lot of couple donate them for medical/scientific research.
  14. If you believe that the system needs to be changed in order to prevent all of this shit, please propose some rules that we can adopt going forward. Also make sure to state whether these rules are to be universal or only applicable when a defendant is coming up (within some specific timeframe) on an election for public office, etc. I’m all for fixing problems, but I’m not sure how you fix the timetable fuckery that you take issue with.
  15. Like to Barr redacting the Mueller report? * The issue surrounding a redacted internal memo within the DOJ, where they discussed Mueller’s findings and conclusions? I’ll concede the “front-ran” portion for sure, at which point Mueller went public to counter that. Barr’s “thing” was twisting the conclusions and findings of Mueller in order to justify a decision to NOT prosecute DOTARD. What you are suggesting is something entirely different. What you are suggesting would be a scenario where there’s really no point to a special counsel at all. Just handle it all in house.
  16. So, when he gets asked “hey, what’s up with that special counsel report we have been waiting on?”…would Garland just reply, “I’m not going to release it because it was a terrible hatchet job. I’m not going to let you see it so just trust me, the attorney general, when I tell you I’m making the right call here.”? Seems problematic.
