  5. Agreed, which is why I think that a simplistic “ban the AR”approach will not be very effective and shouldn’t be the focus. Focus on what makes an AR-15 such a concern and ban those features across the board. I’m talking about the high capacity mags.
  6. I did a little digging. The reports of abuse are still confidential, so the identity of reporters is not disclosed. The new change is that the report can not be made anonymously. As far as the provision for parents’ legal representation, my understanding is that there will be lawyers contracted for a reduced rate for low income families. These would be parents who do not fit the usual indigency standard who currently get a free court appointed lawyer.
  7. Providing attorneys to all parents who have kids removed is actually a great idea, IMO. With the anonymous reporting, I wonder if that information will still be redacted from court filings and reports? What I mean is, someone can no longer call in a report without providing that info, but that info is still protected, like it is now? I would hope so. Otherwise, that’s fucked. The whole system is borked. I’ve worked a ton on CPS cases and I can tell you that a lot of stuff goes the opposite way than you describe. Parents getting railroaded by shit judges with no regard for the family code or rules of evidence, etc. The problem is, to me, is that they are just so grossly underfunded, which causes carelessness and corner-cutting that consistently fucks up in either direction.

  16. The DA would be the one to charge him for that and not the judge. She isn’t pursuing that charge, probably because as a tampering case, that basis is weak as fuck.
  17. Apparently so. I’m not caught up in this thread yet, but if this is what she is doing, jury selection may take a year and even finding a workable trial date will be a shitshow. I don’t see this sniffing actual testimony until 2025. GA former judge said last night that they have a RICO trial going on now and jury selection took 7 months.
  18. Did he tell him not to testify? I thought the words were “Duncan is going to testify. He shouldn’t.” Pretty huge difference from a threatening/tampering standpoint.
  19. Does conceal normally require more than just “know about it and not tell someone”? ETA: I’m not sure that the case will even rely on this concept, since I would bet that Trump is on tape doing much more than just quietly listening and becoming aware of the plan. I’m sure that he is encouraging, assisting in planning, probably even forcefully taking credit for the whole plot, because that’s like his whole fucking deal.
  20. It’s an interesting issue, because generally, there is no criminal responsibility for not acting to stop a crime that you are aware someone else is going to commit.
  21. So I presume that you would like to do away with manslaughter statutes full stop then? And also “regular murder”? Your stance would necessarily rewrite all penal codes to be as follows. All homicides committed with anything above mere negligence will be life without parole in all cases. This would be the same punishment currently reserved for capital murder in most places. I mean, it wouldn’t make any sense to raise manslaughter to life w/o parole without also raising the punishment for standard 1st degree (in Texas) murders, right?
