Best practice for employers is to have the non compete up front and when it comes to severance on the back end follow a standard policy so you avoid disparate outcomes that could lead to discrimination claims. 1-2 months is fairly standard anything over that is pretty “generous” though some employers do a number of weeks increasing based on tenure.

  15. @horn4life yes we like our tankless. We added a circulating pump we can turn on remotely 5 mins before we take a shower or bath and it makes it even better. We also have two tankless to eliminate long hot water run. Allows everyone to use hot water when they want and no issues with depleting a water tank.

You can definitely run a house including an HVAC unit off these. we are going to move HVAC and heating appliances to a box that is grid or generator powered (1-2 Predator 9500), and use grid or solar for the lights, plugs, data closet, water pump, electric controls to the water heater, circulating pump, and refrigeration. we had our first outage for 4-5 hours this past cold snap (routine with PEC) and we didn’t like the load on solar reserves with an overcast sky.
  17. Infuriating. This is why we can’t have nice things. It would take no effort to design this at construction to be installed on an inside garage wall. Problem solved. pisses me off. you’re a good dad. I hope you got the hugs and I love yous you deserved for helping her out. I suspect this is a build from at least 10 years ago but any new build for a home in Texas has to be built to withstand 10 degrees and no power for several days. Don’t put a generator on it if you can’t afford it but have the electrical at least thoughtfully designed so you can add back up later - just have two boxes - critical and non critical and the ability to add a transfer switch. Be close enough but within code to the gas line so you can add a generator near there later. Have all exterior water lines run in a way you can drain them easily - just put the hose bibs on a separate loop you can shut off. Tankless water heaters need to go in the garage. Have a house water shut off that’s not at the street. Most of this work simply takes thought not extra materials or time and if it does take extra materials or time it’s marginal. It’s time builders start building for this shit.
  18. I’m not sure it wouldn’t. I know what a down the middle noncompete looks like and can evaluate basic enforceability. Outliers I don’t always know for sure so as a corporate lawyer helping an exec I assume they are enforceable unless I have a noncompete lawyer tell me it isn’t. when that question becomes important I ask one of my colleagues. Often times it’s not important because it’s a down the middle assumed enforceable non compete - in a severance agreement that’s often just restating an already in place non compete. In this case it probably warrants a closer review except if the guy wants the money and has no plans to compete the answer doesn’t matter. it goes back to lawyering 101 - never ever leave your wing man, oh wait that’s something else, never ever agree to a provision you are not comfortable having enforced against you. if this agreement is drafted correctly, if the non compete isn’t enforceable, then the $25k should be returned. Sounds like the guy wants the $25k so he better not compete.

  20. not sure what was wrong with me last year, we didn't sail much at all. anyway, just fixed that. we don't own the boat it's more of a boat club but I've put 6 dates on the calendar starting mid-February. they also have an upgrade membership that would get me a further discount as well if I start booking more. so my preferred boat (they don't have luxury sailboats) is a 35 foot, 2017, dual helm, Beneteau, gently used. 2024 we are getting back to it. still have the surf boat but I'm getting a little more chill as I peek over the horizon at 50 years.
