Is there no argument to be made that it should be reviewed de novo? That is, because Trump team has submitted no sworn facts as the party that petitioned for relief, the legitimacy of Cannon's stay is more in the way of a pure legal issue, rather than an application of the law to a known set of specific facts? Just a thought

In fact ---on matters including due process, 8th amendment, and criminal law, SCOTUS has many times looked to what state legislatures have been doing as a proxy for the will of the people, which it has indicated is a relevant consideration. Now that SCOTUS itself has gutted the Voting Rights Act and refuses to review any gerrymandering, what is a proper way to gauge the will of the people? Well luckily, there's now no need to consider things other than what centuries-dead white slaveholding men thought in the 18th century. Win/win!

  9. yeah, anecdotal but I had to have a conversation with a Cali family on a boat tour last month in Puerto Vallarta. They saw the Texas gear my crew was wearing, and made assumptions about us. Started saying how they were looking for a vacation home in Galveston bc Cali is SO terrible, the homeless, needles etc., and why all the people leaving Cali who would still vote the way they did back home when they're leaving for something better is so stupid etc. And the dad was a hulking L.A. county deputy who made a point to mention his firearms and had sinister tatts all over his body, including his knuckles. Mom lamented that prices in Galveston had shot up so much the last couple of years. I tried to tell them, housing/taxes aren't low in places like that, property taxes can be insane, and they wouldn't have it.... "but but you don't have state income tax HERR DURR everything so much better there derp"

All such laws (which of course, should be a higher age), are never going to be foolproof and you'll never rid this country of the scourge of gun violence we have entirely. But they are layers to obstruct, delay, give time to reconsider, to come to the attention of law enforcement, etc.
