While it's true that the DOJ has mis-attributed that statement to the SCOTUS order, it looks like Xinis may have given the DOJ some wiggle room in her April 10th order, which states "To this end, the Court hereby amends the Order to DIRECT that Defendants take all available steps to facilitate the return of Abrego Garcia to the United States as soon as possible." Still, disingenuous as fuck, but when dealing with this administration, Courts have to be exceedingly precise or risk getting stuck in the mud arguing over the meanings of words.

It means that Alito and Ruckus have signaled to Trump's folks that they are willing to rely on some sketchy interpretation of history to read in an unwritten qualification to the 14th Amendment. While the 14th Amendment seems pretty clear on its face, I look forward to reading a 75-page SCOTUS opinion explaining that, "Hey, because the 14th Amendment was adopted in 1866, it's clear that it was really only intended to allow former slaves born in the U.S. to be treated as citizens and nobody else, especially not those brown and yellow folks ... but maybe we're okay with the Eastern European people ...

  18. I'm confused. If the courts can't make the Trump administration do a damn thing and you don't care about winning an election, what exactly did you have in mind? You think we're going to spur the American people to action with the Abrego story, just based on the facts? I don't know how you'd get to that conclusion looking back at the past 10 years (notwithstanding a handful of rowdy old folks in Iowa). This is where I'm at. The story can't just be about Abrego, though. Too many folks are still convinced that Trump is not "coming for them or theirs." And unfortunately a lot of the middle still views the Dems as being hysterical. That's why I said they need to pick their battles here. There is absolutely a window to convince people that the danger that we've been talking about is really coming. It needs to be personal, though.

I think what he means by "carefully presented" is that they need to pick cases where the circumstances can't be cast as "the Dems just want to give illegal immigrants more rights than you have." If you look at the way the Fox Cinematic Universe is presenting the Abrego situation, it goes something like this: He came into the country "illegally" at some point. He was arrested for being an MS-13 gang member. Trump is deporting him because he is an illegal engaged in terrorism in the U.S. Trump just sent him back to his home country. Why do you want to protect a terrorist from being sent back to their home country where they can deal with him? It's all fucking lies, but the average U.S. citizen has no appetite for nuance, so this version of the story is going to resonate with some, especially for those scared of brown immigrants (which is unfortunately a lot). The risk is that if the Dems latch on to a couple of situations like this that can be twisted in the minds of a good chunk of the country, all of a sudden we have another "Russia Russia Russia" situation where, even as the Trump administration engages in more blatant misconduct, people don't bother to listen. Unfortunately, the Dems only have a few chances to make this stick - otherwise people will just tune out.
  20. Yeah, but I'm not sure that they move the needle electorally. The reality is that there is a sizable chunk of the voting population that is scared to death of brown immigrants, so framing this as an infringement of the rights of brown immigrants (illegal or not) may continue to push them away. I'm not sure how many of them you can win over on this topic, but I think the more reasonable play is to point out what the administration is doing (sending folks with a legal right to be here to a foreign Gulag to rot for the rest of their lives without any right to defend themselves), noting that "eventually they're going to come for you or your neighbors." The idea would be to lay out the Trump game plan in advance and note every step along the way as it happens, so they have credibility when they say "they really are coming for you next." It would be great if we weren't so selfish as a country that this would matter without it being personal, but the reality is it's going to get personal soon enough.

  23. Vladek's proposal in #3 makes a ton of sense. An alternative would be to say that any outsourced confinement (like at CECOT) must be reflected in a written agreement that formally requires them the return deportees at the request of the U.S. The Executive (especially this Executive) can't be given the opportunity to disappear folks and then just throw up their hands and say "Oops, but nothing we can do."
