  1. Give us an example where two lawyers represent clients with two different versions of the truth, and these duties you refer to would lead to a determination before a jury/judge gets to hear the case presented.
  2. No it doesn't. It asks that the parties engage in good faith but presumes there will be fuck ups. And there are usually remedies for those fuck ups. As in every other human endeavor. You are holding a system designed to try its best to resolve the most difficult conflicts of opposing views of the truth and/or justice by pretending there is a magic eight ball that will come up with the same result in the separate hands of two lawyers and a fact finder.
  3. Heh. It's insane. I did it via audio (about 60 hours total, I think). Interestingly, I only tired a bit in the last 10 hours or so. Two round trip road trips from Dallas to SA, and then 30 minutes a night.

  7. Just finished the Caro biography of Robert Moses. Yet another example of how there has always been a majority of stupid/misinformed/passive voters that have to be herded correctly at one's peril. I think the most common voter attitude in the past was apathy and a bit of envy. The internets have turned that attitude to rage and lots of envy. You used to just have to have the big newspapers in your pocket. It's more complicated now.

  11. I don't think it would be a great system but you certainly could structure it so that there are two advocates who owe primary duty to some pre-defined definition of justice or truth. The potential for collusion and injustice and the death of truth in such a system would be greater than the current system.

  13. I don't think there is any higher standard than zealously representing your client within the bounds of the law. Unless the higher standard is "double secret zelousness". I actually think it's pretty easy to be moral as a lawyer just because the game you play does have lots of rules and guiding principles.
