Well, he does raise sort of an interesting point. The law rightly presumes or assumes that consent is lacking in employer/employee sexual relationships (and in other situations where the power dynamics disfavor one party). This is because consent often is lacking, or at least compromised, but further that we want to penalize and deter such relationships. But that is a bit of a legal fiction that is indulged so we don't get lost in the details of every such relationship and whether there was or wasn't consent. In the absolute sense, though, both parties retain some agency, depending on the particular relationship and parties involved.

Hindsight is 20/20. He was OC for their National Championship team. Ryan Day, Lincoln Riley, and Marcus Freeman were all promoted to HC at their respective blue blood programs when their predecessor left or retired. None of them were fresh off of a national championship either. He was every bit if not more qualified than any of them. Just because Moore crashed out in spectacular fashion doesnβt mean he didnβt βdeserveβ to be promoted when Harbaugh left.

Well, the kind of evidence I am referring to is documentary evidence (texts, photos, email) and witness testimony (I saw em). As long as they kept their comms off school systems (email, etc.) the University and their lawyers would have no way of legally obtaining for example cell phone records. I think there have been statements that Moore did not "cooperate" with the investigation, which would seem to mean didn't cough up his cell phone or personal PC. It would seem likely that UM also provided cell phones and service to at least Moore if not her and other staffers and it seems they would retain rights to do deep dives on those, but personal or "burner" phones and accounts would have to be voluntarily provided. There's no burden of proof for something like this until somebody sues. But the above wouldn't satisfy a criminal burden if there was any it's about 50/50 on a civil case, depending on what kind of credible excuses Moore could offer for the more objective evidence. But taking seriously adverse employment action based on evidence like the above would be somewhat dangerous for the institution and invite a civil case.

The previous coach is involved in cheating and recruiting scandals that involved him lying to the NCAA and being suspended twice for major violations. He is not fired. The second coach has sex with an employee and is fired for it. Michigan not being consistent with its conduct policy because the previous coach was winning against Ohio St is going to open the door for racial bias allegations. Itβs not racism driving these decisions but the win at all costs mindset and I for one am happy to see them get all of the criticism they can get even if it is misdirected.

What is interesting is that the 'investigation' seems to have consisted of simply asking each of them if they were having an affair, to which they answered no. Last week, she purportedly provided 'ironclad evidence' to the law firm to prove she did have an affair. I wonder what it was and why they couldn't identify it earlier? Michiganders on YouTube saying it was openly talked about this fall and even national sports commentators are now coming forward. Michigan Man Rich Eisen is now saying he was informed about it but didn't speak about it. Also, the school reported that they investigated him two other times. I'm no lawyer and I'm not privy to the details, but it sure seems like they didn't try very hard. Michigan vloggers are questioning the significance of everything happening AFTER National Signing Day, lol.

Portugal. The Man at Brushy Street Commons. That was an absolute blast. This is their environment. The performance and energy was 1,000% better than their large venue shows. Much more punk than usual. They still need some better lighting on stage though. Hopefully they continue to do these small venue second nights on future tours.

Here's a question I don't know the answer to. Petit jurors are instructed to avoid media relating to their cases and are often sequestered to avoid that and other external influences. Grand jurors sit for longer periods than most petit jurors, and are charged with evaluating numerous cases, not just one. Therefore, it would be difficult and impractical to make any attempt to isolate them from media. So, I don't think they are, at all. But I don't know for sure. As we have discussed In other context, details of criminal investigations before indictment are usually kept pretty quiet and a grand jury drops out of most cases post-indictment. So, in a general case, media exposure isn't that big a deal. But it would surely seem that the media coverage of the first indictments and attendant shenanigans would make it very difficult to secure an indictment in any of these cases unless you were able somehow to assemble a purely pro-Trump grand jury.
