  2. Yes, the bond, when properly made, stays execution on the judgment. He does not need a bond to appeal, but if he doesn't file one, he is exposed to execution on the judgment. As others have mentioned, the bond is more for the judgment creditor in this case since Trump's chances of success on appeal are slim. But it seems to me that if he played paperwork games with this bond and the deadline has passed, he is exposed to execution on the judgment at the judgment creditor's discretion. But to the extent NY and Texas are similarly situated in the law, he did not need it to file an appeal. He wanted it, albeit in a smaller amount. Whether he/his lawyers are playing stupid games, the logical outcome, to me, would be that there is no bond at present and he slow rolls correcting this at his financial peril (which I know is a hypothetical to most and my analyzing it like it's normal leaves this open to dismissive retorts on that basis; but speculation is not what I do).

  4. I'm not a bankruptcy specialist (although I am married to one). I also can't predict the future. I'll hang onto the hope, and as you suggest, I'll let you know. But you're not wrong about his past and your assessment of him as a person. The fact remains that he needs a Chapter 11 plan to be approved. If he can't get the plan confirmed, the options are either that the bankruptcy is dismissed or converted to a Chapter 7 liquidation (if I understand the basics correctly). My impression of bankruptcy judges, particularly from what I've heard about the Southern District, is that their tolerance for bullshit isn't terribly high. That said, 11s are complicated and I realize they don't move swift enough for Surly justice.

  6. The bankruptcy has not been dismissed. The judge appointed a mediator, and the hope is that it gets wrapped up this month. Once that plan is in place, hopefully, the Sandy Hook families get paid and he has to learn how to live under the strict confines of a bankruptcy plan.
  7. There seems to be the notion that keeps getting floated (not by you) that Trump is being allowed to appeal despite the deficiencies in the bond. I wasn't aware that a bond was required to appeal. He's appealing because he's appealing. The bond isn't a permission slip to appeal. If he doesn't fix the issues, James can collect before the appeal is done. If she chooses to wait, that's her decision.

  13. Third puppy visit for the little man, Archie, the Craigslist, parking lot rescue. Worms we've been treating since the first visit persisting. Best vet in the world (seriously), is treating it as a resistant hookworm now, no charge. Gave him a Vit. B shot too. He's gaining weight (23 lbs), but still a bit under for his age. It doesn't bother him (see video), which is great. But looking to get this and any resultant anemia sorted.

  20. Without saying who (obviously), what sorts of clients/cases are these. I'm obviously in a different part of the state (different world, let's face it), but I don't tend to see a lot of a political undertones on much of what we see around here. That is to say, what kind of civil cases get an obvious yea or nay from the MAGA juror?

And I check my personal politics at the door when I do my job because politics has no place in the interpretation of the law. It's also why I push back at the notion that the overall system is broken. Ain't nothing broken leaving my desk. It might be "wrong." Occasionally it has been declared as such by some guys and gals down in Austin. But even when it's declared "wrong," it's not emblematic of a broken system.
