  10. Yes. Liquidated damages expressly cannot be used as a penalty or punitively in most jurisdictions. They could be proper in these circumstances because a) the damages are hard to quantify in the first place and b) they could be a reasonable estimation of the damages. Penalty or punitive damages aren't usually available in breach of contract cases and are expressly excluded from "reasonable estimations" in the case of liquidated or agreed damages. I am just talking about breach of contract, though. Tortious interference can be used two ways, as an independent cause of action that might have more damages than a simple breach, or just as a way to make the interfering institution liable for the breach (so same damages, different party). Tortious interference can support punitive damages for fuckery. That's before we start creating statutory causes of action that attach extra consequences for fuckery.

  14. Funny how that works - we've had the same thing (which believe is also largely coincidental) several times. The two ranches that border us are both MLD, and they'd be DOA on those extended seasons, but it still makes me laugh when some unknown big dude shows up day or two after our season ends. Kids' gym seasons kick off this weekend and go for next dozen weekends, so I'm going to try and sneak 2 more single days out before buck season closes on the 19th. Been a really tough year for antlers on our place, haven't seen anything but nice young deer. I did see a monster on the wrong side of the fence one sit - the type you don't even need a good look at to know its a shooter. Lots of smaller broken up bucks chasing around last week. 4 more sits for horns then will finish off doe tags I guess. Quail has been strong to very strong so far. I've got 2 does and a couple of big boars down and that's it for the year so far.

For those of us who are unsure about prayer in general: Once you dig into it, I believe you find that you can pray, and it does work... and it doesn't require any specific deity or any supernatural entity. What it actually requires is imagination. That probably sounds screwy, but hear me out. I'm not sure I've ever met anyone who didn't worry about some things or something. It seems to be a purely natural "ability"... we pretty much all do it. When you break it down, it consists of little more than thinking about something bad happening... that is, imagining the bad whatever will come to be. That is the key here: imagination. Prayer is exactly the same as Worry, with one small, but hugely powerful difference. Where Worry consists of imagining something bad happening, Prayer is imagining something good happening. You don't need to specify how, just what. That's all there is to it. And just as Worry hangs around and pops up, from seemingly nowhere, just under your conscious thoughts, Prayer does exactly the same. You don't have to work at it, just plant that thought about good things amd let your imagination go.

  17. There's been a lot of Fallout New Vegas (obviously) fan service. Lots of familiar locations. I agree the plot has been pretty slow developing, hopefully it pays off. I guess Kumail just popped in for a minute but I hope we get some more of the Legion with Kevin McCallister. Not clear to me if those holdouts from the NCR are supposed to be the actual last of that organization still around, or just completely separated from a much diminished NCR? I'm still enjoying this but it is slow and I hope it comes back together. The junior executives are funny.
