Supreme Court upholds rule allowing state, federal charges

By MARK SHERMANan hour agoWASHINGTON (AP) — The Supreme Court is upholding a constitutional rule that allows state and federal governments to prosecute someone for the same crime.

The court’s 7-2 decision Monday preserves a long-standing rule that provides an exception to the Constitution’s ban on trying someone twice for the same offense. The case had been closely watched because a ruling for the defendant in this case might have made it harder for states to pursue criminal charges against defendants in the Russia investigation in the event they are pardoned by President Donald Trump.

The court ruled against federal prison inmate Terance Gamble . He was prosecuted by Alabama and the federal government for having a gun after an earlier conviction for robbery.

Justice Samuel Alito wrote in his majority opinion that 170 years of precedent supports the idea that “a state may prosecute a defendant under state law even if the federal government has prosecuted him for the same conduct under a federal statute.”

New York authorities already have indicted Paul Manafort , Trump’s former campaign chairman.

---> So Trump could spring Manafort from federal prison, but it would not protect him from being prosecuted on similar state charges, which WERE filed by New York.

Re Roger Stone, recall he was investigated for some crimes that to date have not been charged:

IANAL, but of those, being investigated for wire fraud appears to be one that could bring state level charges.  No idea what state would be involved.  Whether it's NY state or FL would seem significant.

Manafort had to have chill run down his spine today.  Would love to see Stone get the pardon proof squeeze.

With that ruling, probably the last thing Manafort wants now is a federal pardon.

Although since he’s in Rikers already it may not matter much. Dude is fucked and really should just start offering to sing to save his hide. Not seeing a whole lot of other options for him at this point.

Breaks my heart.

Are you pro choice since dotard aborted those companies?

You stated that Trump went bankrupt. You confused a corporation (in the case of the Trump Casino, publicly owned) with the individual. Individuals tend form corporations in order to achieve large scale objectives that involve great numbers of people and concentrations of capital and labor. They are used when large numbers of people join together to express their will or achieve an objective.

The American Federation of Teachers is a corporation. The AFL-CIO is a corporation. Catholic Charities is a corporation. Moveon.org and Media Matters are corporations.

The Donald, Inc. has filed for bankruptcy six times.

So much winning.

Donald Trump has never declared personal bankruptcy, but he has sought bankruptcy protection for businesses controlled by him several times — as he (or whoever populates his Twitter account) is fond of pointing out:

Manafort destroyed his credibility so bad I don’t know what he could offer...

Paul J. Manafort, President Trump’s former campaign chairman who is serving a federal prison sentence,

had been expected to be transferred to the notorious Rikers Island jail complex this month to await trial on a separate state case.

But last week, Manhattan prosecutors were surprised to receive a letter from the second-highest law enforcement official in the country inquiring about Mr. Manafort’s case. The letter, from Jeffrey A. Rosen, Attorney General William P. Barr’s new top deputy, indicated that he was monitoring where Mr. Manafort would be held in New York.

And then, on Monday, federal prison officials weighed in, telling the Manhattan district attorney’s office that Mr. Manafort, 70, would not be going to Rikers.

...

The former Justice Department officials and current state prosecutors, who regularly handled the transfer of federal inmates to state custody, said they were surprised that the second-highest official in the Justice Department would take an interest in the case. The decision is usually made by the warden at the prison where the inmate is being held.

Banana republic bullshit

This. I suspect only he could actually do it. I seriously doubt he will though.

Mueller went after Manafort first for a reason. So far it doesn’t appear its worked all that well, unless the ultimate goal was to totally fuck over Manafort. Not bloody likely.

Yes you have proven your point. Thanks to loans from the Russians, trump individually never filed for personal bankruptcy.

Instead his companies he controlled filed bankruptcy six time, which obviously caused legitimate lenders to stop lending to him, which led to the loans from the Russians, which led to the trump presidency, and which explains why trump totally kisses Putin’s ass to this very day.

You've made your point.

Manafort is worthless as a witness. Even if he says he's cooperating and telling the truth, you can't trust anything that can't be independently verified.

Depends on what he has to say. I bet it’s a lot. He’s not a Michael Cohen.

House Dems are --->  Deutsche Bank has lent Trump Org hundreds of millions of dollars for real estate ventures.  Yes, that same DB that got fined for being the conduit of a Russian money laundering scam right around the time trump was getting sworn in.

I personally dont give a shit what Maddow has or has not covered. Do you obtain all your opinions from what the media might deign to share with you?

I prefer a seldom used technique called common sense, something often rejected by sychophants and other assorted suck ups. Sometimes the obvious answer is staring you right in the face. You have to be willfully blind not to see it.

You should try it sometime.

Well since now that you mention it, I guess my theory as to the russians lending trump a shitload of money to stay afloat doesn’t hold water.

I mean after all, if trump got the money from Deutsch bank, it certainly didn’t actually come from the Russians. No way could they have managed to pull off that particular caper.  Just not feasible.

My apologies to the texashammer. He was right all along.

It really is amazing how easy it is for the top 000001 percent to fool the rubes when it comes to payoffs. Hell even Rick Perry easily pulled it off in Texas and he’s a moron.  Its not that hard rubes. The game has been rigged, and it aint for your benefit. Stop looking to con men trump for the answers as they are in on it to.

THIS IS WHY PUBLIC HEARINGS ARE NEEDED.

Make them not answer in front of the world.

i think the whole point is that people will answer in private (with transcript released afterwards).  if this was the inevitable conclusion to this, then why the fuck did she even agree to testify in the first place?

Keep in mind Stone's trial date is set for early November, which is forever given the pace of things.  Given that Trump has to be itching to give Stone a pre-emptive pardon to obstruct justice covering his own arse, I'd think having a formal impeachment inquiry/process occurring prior to and during Stone's trial would be both a pardon deterrent and synergistic for for the impeachment process.

The democrats are a joke at this.

This is what happens when testimony happens behind closed doors.

The witnesses can get away with anything with zero accountability.

Make them lie or clam up in front of the American people.

They just don't show up at all and it winds up where it is now. They won't lie or clam up in front of cameras until a court makes them.

Nadler and Pelosi know this though. They're playing games with all of this.  They're acting like they have very little power when they have the House and public record.  And they could unify their talking points and pound on these every opportunity they get as well as create opportunities to show showcase Republican practices and pound on their points even more.  If this is all just a game, then they're playing along as well.  I wish they'd treat it like the threat to our nation it is.
