Trans Rights and Title IX question

With the Gavin Grimm decision today in Virginia, the gist of which is that trans students are protected under Title IX, could an appeal of this decision eventually lead to a ruling that finds Title IX unconstitutional in that schools will no longer be allowed to discriminate based on gender (which Title IX allows for today)?

Title IX is specific legislation around the rights of women in education. If a court rules that gender can no longer be legally determined, would that in effect end Title IX?

No.

This case was literally a court enforcing Title IX, so deriving from it that Title IX is somehow unenforceable is a fairly bizarre conclusion.

Title IX prohibits discrimination on the basis of sex in educational programs funded by the federal government. The court ruled that transgender discrimination is discrimination on the basis of sex.

Title IX regulations do allow for separate bathrooms/locker rooms on the basis of sex. In this case, the student, who was born female, had received an amended birth certificate designating him as male. But the school district policy assigned students to bathrooms based upon their genitalia, not birth certificates. The court ruled that such a policy constituted transgender discrimination under Title IX. The court did not reach whether assigning bathrooms based upon birth certificate would violate Title IX.

I am not saying this sarcastically, but seriously. We're using amended birth certificates as our proof of sex now? If Joey gets cut from the basketball team and wants to become Jane to play with the girls, all he has to do is pay the $10 fee for an amended birth certificate and their is nothing that can be stop her from playing with the girls? 

In this scenario, how can Title IX continue to last?

Holy shit, this is not how it works.  This literally does not happen.  No one is going to decide on a whim to change their sex just to play a sport or creep in another restroom or anything like that.  Please, go speak to a trans person and get educated.

Who said the person doing it was actually trans and not just a person working the system? You don't think people work the system all the time? How could you keep this from happening?

What happens in an accident when the patients ID says the new preferred gender instead of their biological one.  Would this situation create any issues for doctors treating a non responsive patient?  If all they have to go on is the ID's gender, would their be a situation where they improperly treat a patient due to not knowing the biological sex?

I assume they have different protocols in regards to drugs and chemicals when treating men and woman (not talking about a broken bond here).  Curious if any medical professionals can see this as a possible problem treating patients if they don't know the biological gender/sex?

The reason Title IX can continue to last, even under your scenario, is because the lawyers and judges and administrations that deal with Title IX aren't (for the most part) retarded mouthbreathers like you. That's why.

For the vast majority probably not, but there has to be more than a handful of athletes who put winning above anything else.  Some people will really think outside the box when it comes to an obsession.

What if it's the difference between you having to pay $200k for a college education or not? Again, how are you going to be able to keep men from self-identifying as women and then keep them off the team?

The Olympics moved to testing testosterone levels in women and that got roundly criticized.

Does anyone think that there is currently an issue with someone pretending to be trans just to get a competitive advantage in a sport they shouldn't be allowed to participate in based on their gender identity actually matching their biological sex? Like, seriously? Is that a thing someone here actually believes?

Or do you really just want to make life even more difficult for people who already have a mountainous struggle ahead of them?

Because it's not just a matter of self-identifying but also of being treated for gender dysphoria and taking testosterone suppressants for at least one year.
