Serious answer: You could live in a community that has deed restrictions addressing things like property use, setbacks, and construction design, but those deed restrictions to not create an HOA that enforces those restrictions. Some older communities that were created by less sophisticated or sloppy developers have similar deed restrictions that do not create an HOA to enforce restrictions, collect assessments, etc. I've encountered a few of those communities, and in some instances the neighborhood has created their own HOA, which is purely voluntary and does its best to monitor compliance, but that HOA does not have the legal authority to file a lawsuit to enforce the restrictions. Under the law, an individual owner in the community has standing to sue, but someone who is concerned about a violation rarely is mad enough to spend their own time and money pursuing an enforcement lawsuit. And as troph mentioned, with or without an HOA, if there are enough similar violations around your neighborhood, the offending owner could have a waiver/abandonment claim for that particular restriction. There's no magic number of violations for that to happen. The rule is generally, can a person driving through the neighborhood observe enough violations that they form the reasonably belief that the community does not enforce that restriction.

  3. Same, at least for the Anderson location that is closer to me. Several years ago there could be a line out the door on a Saturday at noon. Now, not so much. Even at the fancier "craft" burger level, there's a lot more competition in Austin.

  17. My daughter considered Reed as part of her private school applications. As she and I researched it more, it seemed like the Rice of the PNW -- a lot of really smart kids, but a pretty lame social environment. She applied to L&C and got some generous scholarship money, but wanted to go to a bigger state school with robust athletics. I have a good client who went to L&C, and while he really liked it, he said that area of Oregon gets much worse rain than other parts of the state. (See below). My daughter is a rising sophomore at Oregon, and absolutely loves it. I thought a Texas girl who loves the sun would have a tough adjustment, but she said the weather was okay. The rain was mostly a constant drizzle such that students don't even bother carrying an umbrella, and instead rely on waterproof jackets and backpacks. And maybe this year was a little different, but she got a fair amount of sunny days in the middle of the rainy season. I was actually surprised to get from her so many photos in the Fall and Winter that showed sunny blue skies.
