f this sounds like a new addition to the case, it is! The Takings Clause has not come up in any previous litigation precisely because Judge Gonzales Rogers’ original opinion acknowledged that Apple had the right to charge a commission; the issue under the California Unfair Competition Law was that Apple’s commission was much higher than was justified precisely because Apple foreclosed competition. To that end, what would have made much more sense would have been if Judge Gonzales Rogers lowered Apple’s proposed 27% commission to something significantly lower; to simply wipe it out completely is what prompts this discussion.

Thank you for your attention to this matter!

Even a 25% Tariff it would still be cheaper to make them China than the US.

Also if it is against one company and not an industry isn’t it a sanction not a tariff?

Lulz at Tim Apple giving Trump $1M for his inaugural committee, making repeated trips down to mar-a-lago to polish Trump's nob, etc... Love to see it. Fuck you Tim. Try having a spine next time.

Quoting myself to say he just clarified, it is a 25% tariff on all smart phones not made in the US (not just Apple).

I think Apple has lost the plot. Their big selling point used to be that their shit just works. My wife just got a new phone and it's been nothing but a headache. Transferring from the old phone, re-setting up our kid's watch, and re-connecting it to our HomePods were all giant fucking hassles requiring hours of her time. We ended up giving up and connecting the watch to my phone, and hard resetting our HomePods to start from scratch.

I also just took my phone in to get the battery replaced and the Apple Store experience is such a fucking beating. Make an appointment and you still sit around waiting. Then the girl put a hard sell on me to buy iCloud to backup because "replacing the battery might erase all the data". Fucking how is that possible? Just put in the goddamn battery, stop trying to sell me shit I don't want or need. We bought my mom a watch and you have to wait around for 20 minutes for the privilege of someone acknowledging you and taking your money.

That said, Google and Microsoft are privacy dumpster fires, and Windows 11 is a disaster, so it's not like we have anywhere to go.

The fact that no one has said a word about the recent announcements from Apple says everything you need to know about the direction of the company. Transparent buttons and now CarPlay plays video? Great job Apple. Way to push out technology that's been on the market for a decade.

Next year I predict they'll make a CD player that doesn't skip when you jog with it.

To be fair not that many people pay super close attention to WWDC as it is a developer conference after all, sure there will be more buzz or discussion when the new software is close to release when they do their September event that is more directed at the average consumer.

Always amuses me when people get bent out of shape at Apple when they don't have some kind of big splash new tech every single year. If you haven't been paying attention they have been on the small improvements and polish track for a while and seems to be working just fine for them. Tend to appreciate Apples approach to only roll things out when they actually work well as opposed to most phone and tech companies who slap together whatever new trendy kit they can in their devices even if 99% of it is half baked and never really works well before they move on to the next "big new thing".

The funny thing is - that's literally been their feature release strategy for iOS since like the iPhone 3G. The new iOS features were pretty much alway stuff that android and jailbreak had had for years, and only grudgingly brought onboard once enough people asked for it.

I don't know if it's more jaded customers, or just less juice in the Apple, but it's notable that their old strategies aren't working anymore
