One of the problems with bail is that it's really an afterthought for everyone but the defendant.  It had become kind of a cookie-cutter thing for everyone involved, with the cookie cutter being highly in favor of pretrial detention with sizable bail.

 

I have no idea how common it is, but my wife bills her criminal cases, up to and including murder, by the hour. Some are court appointed, most are not. 

Well, I guess she sometimes charges a flat rate for first time DWI's and trucker speeding tickets and such, if the clients are of, shall we say, more limited means. 

 

Regarding bail: I think she basically agrees with you. She is currently representing a man accused of murder. Based on the specific facts of the case which I'm not going to go into, he presents a zero risk to the community, and a very very small risk of flight. Someone sitting in jail is losing their job and perhaps losing their house, their kids aren't getting to school on time if at all, their elderly parents aren't getting taken care of, etc etc etc.

I think that player offing himself is going to be the final straw on this one. I know that's a corrupt community up there, but got damn this whole thing has to be too much even for them. 

But then again... these types of people have surprised me a ton on what they'll condone in the last decade.

Well, that's certainly unusual, to my knowledge.  IIRC, you're in pretty far west Texas, where you might think most criminal defendants are of limited means.

Oddly enough, with a smaller client, billing by the hour might tend to align costs with objectives better than an all-inclusive flat fee.  But there's a big risk of non-payment if the work is billed after it's done.

Using bail as an example.  Under pre-reform schemes, there might be a sort of standard amount of bail in a court/jurisdiction for a certain crime that tends to be imposed in a cookie-cutter fashion, as in "oh, agg assault, that'll be 50k, please."  And opposing that bail or asking for a reduction, might not be a very high-percentage of winning, absent some special facts.  So prepping and making a bail-reduction motion takes four hours at $250, or $1000.  While the bail itself is $5000.  Could be very worthwhile if there are facts that support the reduction, but the attorney fees are sunk.

But if you have a $10k all-inclusive flat fee, a low-percentage bail motion probably gets ignored in favor of trial prep/seeking a plea.

This thread hasn’t had “news” until the announcement yesterday. Only discussions of billable hours and legalese.

Near the end of that video of him speaking at the board meeting he says something about "this community is hurting. What happened with that young man yesterday". The tweet said a Celina football player committed suicide the day before the board meeting, so it seems that would be what he's referencing. 

But that hasn't been reported anywhere I could see so who knows what's happening. 

Elliott was put on non disciplinary paid leave to keep him from interfering with the investigation. 

A group of parents filed suit this week alleging Elliott and the school admin "ignored previous behavior" from his son and put their kids at risk. 

That's about it as far as I can tell. Seems to be a lot of people there who think it's a Paterno type situation, but they're keeping things close to the vest right now.

right the suicide had nothing to do with this/football/pedo. the boy came home sullen, went upstairs, and the parent found him hanging in what appears to be a super tragic and sad case of teenage depression, hurt and sorrow and overwhelming emotions etc. 

so while unrelated, still a double whammy of back to back painful episodes for the community and Celina seems to be going through it right now. have a lot of friends who sold in frisco @ 3-4x what they bought in for and bought in cash mansions with olympic sized pools out there with a lot of acreage but that town in general has seen exponential growth.

in Louisiana, you don’t need to take continuing legal education credits if you are over 65.   Which seems to me to be the exact opposite of what should be happening, with the olds (myself included) being required to take even more CLE - much of it focused on technology stuff. 

Tl:dr  the Louisiana Supreme Court is run by wankers

The Texas State Bar allows you to report a certain amount of CLE hours as "self study."  This is perfectly above-board.

Reading posts on Surly for that purpose also gets you self-study continuing education credits from the State Psychiatry Board.  Their official stance on using Surly posts for that purpose is "approved, but not recommended."
