In a perfect world, once the dismissal is affirmed Comey will file civil Malicious Prosecution charges against Bondi, Halligan, and the DOJ and be allowed to conduct discovery.

I have no idea if the prosecutorial immunity that no doubt exists is qualified or absolute.  But a discovery fight would be fun to watch

Briscoe Cain is tan rested and ready…and can be a blonde if you really want that…

He looks like Pat if it was a lawyer.

Neither is Lindsey Halligan.

If she keeps doing Trump’s bidding she’ll end up being a criminal, lawyer.

Why is Leavitt and her tits even commenting on this? She’s a spokesperson for the White House, not the DOJ.

And yes I know why.

These both apparently are "without prejudice," which means they can be brought again with a properly appointed USA.

That means at this point one confirmed by the Senate or appointed on an acting basis by the district court.

The limitations and tolling issue might preclude that for Comey, unsure.  Not for James, though.

But, it would seem that it's going to be hard to get a lackey confirmed in the interim.  And the district court is unlikely to appoint one.

This is insufficient embarrassment of the Administration, imo.

But, this is going to impact Trump's practice nationwide of having "acting" USA's that are unconfirmable.

And of course problematic for actual federal crimes sought to be prosecuted.

I can't remember where I heard it (maybe The Bulwark) but they said that this was the cleanest outcome for Halligan - now they don't have to have any more hearings on the botched indictment.

It's also an off-ramp where they could just blame the "deep state" and move on, but these are idiots so I expect them to keep digging the hole until it comes out in China.

It does allow them to sweep this shit under the rug.  Arguably this maybe what's behind the attack on Senator Kelly - try and get the base distracted from Comey/Leticia.

basically, the Trump administration was working a run around of the rules for interim positions for US Attorneys. Hannigan's predecessor, Erik Siebert's status was as interim US Attorney for the Eastern District for nearly 9 months without Senate Confirmation.

Quote

Shortly after Trump’s inauguration in January, acting Attorney General James McHenry named Siebert as interim U.S. attorney. When that appointment expired in May, the judges of the Eastern District of Virginia named Siebert to continue in that capacity. He resigned on Sept. 19, amid the row over Comey’s potential indictment, though Trump later claimed he fired Siebert. (The Justice Department’s brief is evasive on that point, saying simply that Siebert “vacated” his office.)

According to DOJ, Siebert’s exit — whether forced or voluntary — cleared the way for Bondi to name Halligan to the post on a temporary basis, restarting the 120-day clock.

Lawyers for Comey and James say that, following a vacancy, the law gives the attorney general one appointment of up to 120 days and subsequently the post can only be filled by other means, such as a court-directed appointment.

“If the Attorney General could make back-to-back sequential appointments of interim U.S. Attorneys, the 120-day period would be rendered meaningless, and the Attorney General could indefinitely evade the alternate procedures that Congress mandated,” Comey’s lawyers wrote.

i guess my question is why did the Senate never have a confirmation vote on Seibert? He was named Interim US Attorney in January by the acting AG and The Trump Administration had formally nominated him May.

If they had, Seibert's firing by Trump & Halligan's appointment by Bondi would have been a-ok, yeah?

And so it is 2 -0.  Hallelujah, Jesus, so it is! And Doug Jones announced today he is running for governor of my state.  Represent, Doug!

Isn’t this the complete opposite of what the judge emphatically said?

Like that's ever stopped her.

The judge, however, maid no explicit findings as to Halligan's competence or lack thereof.
