The limitations and tolling issue might preclude that for Comey, unsure.  Not for James, though.

But, it would seem that it's going to be hard to get a lackey confirmed in the interim.  And the district court is unlikely to appoint one.

This is insufficient embarrassment of the Administration, imo.

I can't remember where I heard it (maybe The Bulwark) but they said that this was the cleanest outcome for Halligan - now they don't have to have any more hearings on the botched indictment.

It's also an off-ramp where they could just blame the "deep state" and move on, but these are idiots so I expect them to keep digging the hole until it comes out in China.

It does allow them to sweep this shit under the rug.  Arguably this maybe what's behind the attack on Senator Kelly - try and get the base distracted from Comey/Leticia.

basically, the Trump administration was working a run around of the rules for interim positions for US Attorneys. Hannigan's predecessor, Erik Siebert's status was as interim US Attorney for the Eastern District for nearly 9 months without Senate Confirmation.

i guess my question is why did the Senate never have a confirmation vote on Seibert? He was named Interim US Attorney in January by the acting AG and The Trump Administration had formally nominated him May.

If they had, Seibert's firing by Trump & Halligan's appointment by Bondi would have been a-ok, yeah?

I think here's the thing.

Technically speaking, within a US district, only the United States Attorney or an attorney specifically authorized by the AG under 28 USC 515 to bring charges (a "special attorney"), is authorized to indict.

Assistant US Attorneys act in the name of the US Attorney.

So if there is no validly serving/appointed US Attorney or special attorney, valid indictments may not be brought in that District.

I think if you look at other indictments across the board, you'll see a signature block that is:

___________________________

United States Attorney for ____________ District

by _________________________

Assistant United States Attorney

If the US Attorney doesn't sign his or her self.

 

So, they're having the conundrum that dipshits worldwide have when they fuck up.  Should they pretend Halligan is the validly appointed/serving US Attorney and fuck up other indictments, or does appointing someone else unfuck future indictments but undercut the notion that Halligan is validly serving.
