It is not that either.  Not sure where you are going.  The Cox case can only be used as a precedent for women wanting abortions that refuse to follow the legal requirements to get an exception.  And SCOTX and the AG's office have said that avenue is closed.   And in that narrow window, the AG and SCOTX are correct.  We all agree the law sucks but it is standing law.

Paxton's sudden embrace of the minutiae of hospital policy is curious, if not disturbing.  

And "where I'm going with this."???   I'll tell you.  On 2 January, I'm in a caravan of trucks (hint, hint---the logo is a horse) with a half dozen women to New Mexico to receive medical care.  We should have the funding in place for their lodging secured by end of this week, Christmas at the latest.  I'll deadhead back and they can get bus or train tickets back from same pool of funds.  Nobody's gonna stop our trucks, not in pro-business Texas.  When they've recovered and rested, they can travel back at their convenience. 

I'm tempted to send photos of the trucks crossing the border to Paxton and Patrick as a "fuck you", but it would just draw unnecessary attention to the drivers who are trying to do a solid.

My internet hyperbole (and frankly, that of Brisket's as well) aside, this may actually and objectively be one of those moments in history.  Where one person represents the struggle and suffering of thousands or millions even.  And their stories are usually crushed by the media or history or revisionism.  But once in a long while, one narrative emerges because it just "checks all the boxes."  Plus it's just coming at a weird time in the election cycles of the federal level and even too early for Texas.  This just feels strangely different for some reason.  I'm sure it'll be old and forgotten news by the Sugar Bowl, but there's something here that feels unique.  But during this holiday season, I have full faith and hope that everybody will fuck up everything as per usual.

Fascists don't give a fuck about whatever lever they're using to exert power against their "under" groups. It's historically consistent for fascists to find something and abuse and weaponize it to their own ends. Well, what are you running---Class A or Class C?  Last time I checked with you heading west, you kept driving into the sunrise.  That's why we were worried.  

 

We have a few drivers volunteering with space in the cab.  It's just a small gesture but every little bit helps.

We seem to be getting to the point of "do you want comfort or solutions".  I don't disagree with your post in spirit.  I have readily agreed on the intent of the statute and think it is repugnant.  I am hopeful the Zurawski case will help.  But if it doesn't then a different approach is going to be needed or else we all just join the choir and bitch.

There is no way to get it repealed or changed. Because 1) it is EXACTLY how the GQP wants it, and 2) the Texas GQP could slaughter puppies on the Capitol steps daily and never lose a voter because Texans can’t vote for socialistcommunistlibrulhippiedemocrats. The GQP has license to be as cruel as you can imagine, and then double it, and that’s the entire fucking point. It’s not a byproduct or unintended consequence - it’s the essence of who they are.

So…all we CAN do is bitch, resist, work underground, and use this to hurt the GQP in national elections in areas where their support can be eroded.

This is 100% correct. I said basically the day after dobbs was leaked that no doctor will perform these procedures anymore.

It’s can be clear as fucking day that an exception applies, and doctors still won’t do it (without some sort of TRO, court clearance, etc.)

But why if it clearly qualifies as an exception?

Because the only GUARANTEED way to not get indicted for a 1st degree felony is to just not perform abortions.

Can’t imagine that many future OBGYN physicians would ever want to start a new practice in Texas. Of course, the GOP people in charge will never experience this problem because they’re not the ones on the lower end of the income scale who will face the doctor shortages.

many GOP voters will experience doctor shortages especially in rural areas.  And they will blame Obamacare.

You know this already, but all of this is because the Republican primary is the real election. Primary voters are going to pick the most conservative candidate, full stop. Ken Paxton coming out and saying someone isn't sufficiently conservative is a devastating attack in the context of a Republican primary.

But then so what in the general election? Of course the Democrat will point out that the Republican candidate is an unhinged reactionary, but your average Republican voter will just chalk that up to partisan mudslinging. In reality, Karen from the Woodlands and Billy Bob from Odessa know fuckall about the candidates for Court of Criminal Appeals (to be fair, I barely do either). They see an (R) and a (D) on the ballot, know that they're Republican voters, and mark the person with an (R).

The question is how far can the state Republican party go before people start to notice, care, and vote accordingly? I'm a pessimist at heart, so I tend to believe the line is pretty fucking far. My guess is that to the extent that people even pay attention, there's a lot of the same rationalization we saw with Trump - "listen, I don't necessarily agree with everything Ken Paxton does, but I could never vote for a Democrat that wants to flood our country with transgender illegal immigrants and allow abortion on demand at 39 weeks".

Re: Brisket -- Yeah it's fucking stupid and crazy. The court ruled against Paxton because that's the only result the law dictates. You think the CCA is bad now, wait until Paxton's candidates get in and don't know what the fuck they're doing at ALL. 

I'd add just as an aside --while Judge Hervey is conservative, she does a shit ton of work for actual innocence projects, along with pushing legit forensic science training and education for the judiciary and bar. A net positive for the criminal justice system. 

I really can't wait for the finding out portion of the equation for Kenny. I'm really sure now that it must be just around the corner.....
