I’m not missing anything. I have not immersed myself in the opinion, and I’m not saying this was a singular determinative issue. I have no doubt they would find whatever was needed for their desired outcome. 
 

But, I’ve read reporting that the opinion states she failed to present evidence based in reasonable medical probability. And, as initially stated, IF SO, that was a huge mistake.

Reasonable medical probability of what? You keep thinking the missing ingredient was the phrase "reasonable medical probability" rather than considering what follows that phrase. Legally, the failure here is that doctor couldn't say that the "what" was "of risk of immediate death."  That is what the Supreme Court meant when it said her doctor was unable to testify that the statutory exception was met by reasonable medical probability/certainty.

and to Stassney's last point re: having to have difficult conversations...i quite literally just got off the phone with my niece, talking her off a ledge of fury bc she has been trying to get on birth control since the beginning of October, but due to some of her medical/physical history (eating disorder, no period since 16, etc) she hasn't yet been able to bc they want to do all kinds of tests first. which...okay, fine, it's her general health, but the consequence is it is impacting her relationship and ability to be intimate with her boyfriend bc she's stuck in Texas for at least another year and she's absolutely terrified of getting pregnant - see entire thread.

Bingo. Thus, the purposeful vagueness of the standard. A Dr could perform the abortion because the woman was within a split second of death, and 99% of drs will agree…but the Jesus Dr that Paxton has on retainer disagrees, that Dr testifies as such to grand jury, the treating Dr is indicted, and is now LITERALLY on trial for his life (conviction means a life sentence).
If you’re a Dr, are you EVER going to perform an abortion in this state, even if you KNOW it is necessary to safe the patient’s life? Nope.
And that’s how the GQP wants it. It’s terrorism by vague legislation. It will kill women. It will drive OB/GYNs from the state, and will mean that we can’t recruit replacements. Which is all well and good, because women need to pay for their original sin of tempting Adam in the garden of Eden. Wanton harlots, all of them.

I didn’t join this thread. Someone brought @ me into it with their assumptions, even though I’ve never posted once about giving af if you want to 86 your babies. Hell, I would prefer had most of your mother’s opted for that. Bunch of miserable fucks.  But sure, want to make assumptions and drag my name, fuck it. Enjoy it. I’ll take pleasure that many of you will the be the first of generations to be pushed out of your home. I’ll catch you in your new place a few times a year when the skiing gets right.

he's thrilled that productive, educated, lifelong Texans like me, Beau Vine, hornian, and whoever else have fled/will be fleeing Texas to have a better life for us and our families where we aren't subjected to the leadership of crooks and cretins and their litany of regressive tax, education, health, environmental and social policies. or something. bc he's a fucking asshole.

Ah.  I misunderstood "pushed".  Well, put me in that group, although I can't claim "lifelong", but I can claim "from grad school on" and I've been a very productive honorary Texan over the decades.  My wife and I are good for about one more year, and at that point, it's probably the outskirts of Santa Fe for us.  Fuck this state, fuck Paxton, and fuck "Texans" like fatty fat flattie or whatever his fucking name is.  Secede already, bitches.

I thought about that. I have 3 young daughters, after all. Then I remembered I can be in Colorado with 3 piss stops and about  $150 in diesel. And 10000000000000 airline miles if my truck broke down.  I figured we could probably get it figured out, God forbid.

Fucking stop, guys. Fatty used to be interesting to argue with because, while you knew he lacked the ability to accept new information and change his perspective, it at least gave you a window into the effectiveness of right wing propaganda on a seemingly normal dude.

First of all, that is hit and miss.  I’ve learned lots on here, and even “changed my perspective”.  Fuck I even abstained in ‘20.  Secondly, I’ve told you (royal you) a million times if I’ve told you once. I get my news here, and MAYBE 15 mins of M Berry a week, maybe 15 mins every 2 weeks.  And that is typically filled with him trying to tell big dick stories about singers he met when he paid them to perform.  So, I guess the propaganda still reaches me, as it’s argued here.  I haven’t watched a non-sports event on TV in my household (excluding movies) in probably a year.  I don’t really gaf about it enough to read here, and then somewhere else. I thought I made it pretty clear upthread, but like most things, I’ll be just fine.  

You may be, but they are going to have an infinitely harder life. OBGYN’s are leaving and are not being replaced. You may be able to fly your 3 daughters to an out of state OBGYN for check ups, but others can’t. What happens when Texas out laws birth control and they may need it?

If I had a daughter, we would already be gone. As it stands, we will be around to vote against these assholes for a little longer and then bounce if it does not improve here.

I’ll repeat something I said on a different thread- multiple college counselors have told me that in the last two years they have seen a surge in kids who are not only completely uninterested in going to a flagship state university in Texas (i.e. Texas,  Aggy and Tech) but see going to college out of state as a way to establish residence somewhere else. It’s only December, and Tech and Aggy are already beginning to clear their waiting lists. It’s both boys and girls, although more intense with girls.

We’re looking at a brain drain, and if this doesn’t resolve within 3-4 years we will lose a generation of our brightest future Texans.

Can somebody walk me through how to post a voicemail audio on here.  Obviously without giving away my number, but just the clip/tip?  I called from one of our trucking domiciles in Texas to the Lubbock County folks about our trucks being stopped to check for women trying to get to New Mexico or Oklahoma for abortions.  One of the commissioners returned the call and was deadly serious and assured me it was all for show and no interstate commerce would be effected.  It'd be funny to hear if it wasn't baked into so much tragedy.  I was even gonna fuck with the law enforcement folks there and call in fake leads on trailer numbers filled with women trying to get outta Texas for abortions, but I stopped short since some trigger happy Lubbock Deputy would probably make a big mistake and get nervous and start shooting at a driver.  But just listening to them just say the stupid shit out loud is a start.

I hope Kate Cox came to California for her abortion (mostly to see Paxton go apoplectic about California). Maybe they’ll start “pregnancy checks” at Texas airports and on I 10. Just complete the transition to Gillead already.

And then I hope she and her family move here, where she can be free to make medical decisions about her body, and maybe get the third child their family has wanted.

From outside Texas looking in, there is no way I’d let my daughter (or sons) move to that fucking state (as well as about 20 others). Yeah Texas is gaining residents. Congrats. But if the type of residents you are gaining are brain dead MAGA morons who keep electing these assholes, it doesn’t bode well for Texas’ future.

I keep thinking “surely this will open people’s eyes” after every piece of crazy Texas legislation or court ruling, and yet it doesn’t seem to have an impact.  Texas seems a million miles from my experience there in the mid-90s, and not in a good way.

This is a pretty crazy look into fartys inner thought process. By his framing, all (D)s are pure takers that do not contribute to society, and political power is driven through high birth rates. It's just pure, uncut right wing talking points, and he is so fundamentally intellectually dishonest he'll never admit as such.

It’s only December, and Tech and Aggy are already beginning to clear their waiting lists. It’s both boys and girls, although more intense with girls.

We’re looking at a brain drain, and if this doesn’t resolve within 3-4 years we will lose a generation of our brightest future Texans.

The irony is that in general, the "taker" states are mostly red.

Our entire extended family lives in Texas.

I will consider myself a failure of a parent if my children stay here.
