Interestingly enough, I am literally reading case law on Federal Claims takings issues, including when the underlying act is not authorized by Congress.  This is different, as it's a question of executive (not Congressional) authority, but there are dual tracks here: one might be able to enjoin the unauthorized act as a whole, in addition to bringing a takings claim.  And even on the takings angle, there's an interesting question of what was taken?  Was it the opportunity to license the song, which probably isn't worth much?  Or, is it a diminution of value claim (by playing my song over some nazi shit, you harmed its marketability in the following amount)?  Frankly, I'd love to see one of these artists take on this fucking administration and get as broad an injunction as they can.

28 USC 1498 purports to govern such claims for patent and copyright infringement and the copyright section purports to include statutory damages (17 USC 504 of up to $150,000 per work infringed).  But from limited observation, 1498 is not completely successful in creating the full scope of statutory remedies for patent and copyright infringement against governments, the sense being that you're going to come up short, relatively speaking, if you have to sue the gubmint.

One of the more powerful claims that can go along with the copyright is the "false light" claim that can be recognized under the Trademark Act, but I'm not sure those are viable against the government.

Not sure whether I agree with Will on anything anymore, but I'll give him props for that.  He could always turn a phrase.

Pretty sure MAGA discredited George Will years ago.  He's too much of an intellectual RINO.

I think I knew that.  He's been pretty quiet though.

You know.....I'm actually pretty close to coming back around on making weed super-illegal again.  Because it's inspiring the biggest idiots the planet has ever seen to spread their idiocy like fucking wildfire.

It was fine when these losers were just in their basement pondering "what if, like, Jesus came back as this Cheeto . . . and I accidentally ate him?"  Now that fucking brain-dead stoners have been elevated to society's greatest "thought leaders?"  It ain't so fine.

I know plenty of pot smokers, and only one of them is that stupid. My ICE agent cousin, otoh, would love to round up those who smoke pot, as well as brown and black folk, and he has never inhaled pot.

The entire concept of Jesus is just as brain dead ridiculous as this. Only difference is you grew up getting your head filled with that middle eastern mythology created by people you dont know. Where this just came out of someone you know is a dumb, shitty person.

So people have been listening to the dumbest and most deceitful among us for thousands of years.

Christians: the ultimate, destructive groomers. It should be illegal to take children to church u til they're 18.

Trump pardoning Texas Dem Henry Cuellar, who was facing trial for bribery. What ever could be going on here??

I mean....

will-ferrel-we-are-laughing.gif

It's pretty fucking clear at this point....and just think about the pardons issued in JUST THE PAST WEEK:

Defrauding people for literally hundreds of millions of dollars?  That's a-ok now.

Trafficking drugs at literally the nation-state level, using the apparatus of the nation state to do so?  A-ok.

Naked corruption and accepting foreign bribes to influence US policy?  A-ok.

Jesus fucking Christ, you remember how all these MAGAts yelled "HE'S GONNA DRAIN THE SWAMP?"  There is literally no "swamp activity" left that he hasn't said is now super-duper fine and ok for fuckheads to do.  It's not just amazing that the idiots voted for him thinking that he would drain the swamp, what is amazing is that he is doing the 180 degree opposite....and the moron class think that means he's draining the swamp.  Dumbest.  Fucking.  Timeline.  Ever.

Virgin computer??  I may not know where AI is going, but one thing I am sure of is once AI is advanced enough to be our messiah, there will be an option to stick your dick into it.

I think it's additional proof that the pardon power needs to be restrained (which returns to my idea that the Dems should be proposing a constitutional convention).

Should definitely require senate consent at a minimum. Founders definitely didn't think this one all the way through.

I've heard plenty of dumb nonsense from this man over the years, but this particular clip more than any other has convinced me he that he has some kind of brain damage.

It’s about as nonsensical as any other messianic return. Jesus come back as AI? Preposterous! Jesus come back whooshing around in the clouds? Yes yes, of course.

There's lots of shit they didn't think through, in large part because people making decisions for others 300 years into the future is an impossible consideration and why originalism is fucking stupid as a legal philosophy.

The main flaw of the Constitution is that it's way too difficult to amend; that said, the Dems need a big project to run on and excite their base and this one is nebulous enough of an idea that it could steal steam from MAGA ("We finally get to be have our racist/nationalist impulses enshrined in law forever!"), the Christian right ("We finally get to force all of those non-believer heretics to follow our beliefs!") and the few other remaining Republicans ("We finally get to abolish that damnable 16th amendment and I will have more money to pay for additional servants!").

If this doesn't piss you off, there is Ø hope for you.

Trump says he intends to 'fix' something that isn't in ANY need of modification. The Lincoln Reflecting Pool.

I can only assume Trump doesn't like this spot because it is where MLK Jr. made his famous speech?

Oh, & he ALSO wants an "Arc de Trump" somewhere in D.C.

It is insanely crazy that these vast # of things fall under one main topic instead of standalone things.  The destruction of America [both physically / figuratively AND institutionally] continues with willing participation from idiots & assholes.
