Kelly's contract has an offsetting clause where his BO would be offset by his earnings from other jobs. LSU doesn't have to pay the full amount. That's why they can negotiate it down to $20-30M based on some assumptions about how much he could make from other jobs during the reminder of the contract. Herman had the same deal. UT didn't pay him the full BO.

Okay, if Kelly agrees to a smaller buyout now - say $20M - does this renegotiated amount get reduced again if another program is dumb enough to pay a premium for his services? I also assume LSU didn't fire him "for cause" due to some obscure 'morality' clause. I'm just trying to understand how this works.

Good to know Jimbo's fully guaranteed, no offset language deal with aggy is still the dumbest contract ever.

I think they pay out the BO money monthly over the reminder of the original contract, so It's possible the payment gets revised down if someone pays him more down the road unless the settlement amount is fixed. Jimbo's contract had an immediate payment clause, I believe, which is the dumbest thing you can do.

Yeah, if Kelly decides he wants to keep killing kids in scissor lifts or even torture us every weekend as a TV know-it-all, then due to his contract's offset language its probably cleaner to negotiate a one-time payment, payable now with no future clawbacks. But if he decides to retire because he doesn't want to start someplace new at the age of 64, he should tell LSU to fuck off and keep sending those checks. Or offer to let them pay out the NPV of his contract and give them a small discount to motivate them. But that figure would be a lot closer to $40M than the $20M I keep reading.

Reaction from the firing of LSU head coach Brian Kelly continues to pour in, even over 24 hours later. Monday brought one from former Tigers defensive back Matthew Langlois, who did not speak highly of Kelly as a person. Langlois took to social media to explain what happened to happen after medically retiring from football.

“I was FORCED to medically retire before I could get a 2nd or 3rd opinion,” Langlois said via X. “When I was playing very well before my injury, I’d hear from Coach Kelly quite often. The second I got injured, not a word since. Genuinely one of the worst humans I’ve been around, ever.”

It would make no sense for him to take a reduced buyout that could still be revised if he gets another job. Any agent that would agree to that shouldn’t have their job.

Maybe we'll hear more stories like this.  But keep in mind that Bobby Petrino is currently employed.  Being a complete asshole does not disqualify you from getting a college head coaching job.

There doesn't have to be offset language, that's kind of built into the law.  But having a precise offset clause could help.

If there was a discounted buyout, you can be relatively certain that it releases or forecloses future litigation over offsets or mitigation.

The general scheme of contracts is this:  if a hiring party fires someone other than for cause, they owe the balance due under the contract.  And that means payable according to the terms of the contract, monthly, biweekly, whatever, over time.  This is offset by a duty to mitigate damages by the fired party, to reasonably find other, equivalent employment, the compensation for which offsets the amount due under the payout.

All of that can be altered by the contract.  That is, no balance due owed (unlikely); something less (specific amounts) than the balance due is owed;  or the entire balance due is owed ("guaranteed") without offset or mitigation. 

The coach's main incentive to agree to anything less than guaranteed or the common-law scheme of balance due less current salary (duty to mitigate), is to get a lump sum certain and/or to avoid litigation over the duty to mitigate.

I don't know if it was Pate, McElroy or Andy Staples but it was someone you would not imagine coming out just saying stuff about a coach by name without the word alleged. One of those folks just came out and said a couple of additional things about Petrino unrelated to the motorcycle incident as they were offended that Petrino was even being considered for the Arkansas job once again.

This was the answer I was looking for. Thanks for the legal clarification.

LSU pays $20M for Kelly to go away, but that doesn't change or get offset in the event Kelly finds another high-paying HC job.

Probably not, no.  People can agree to all kinds of stupid shit, but that seems unlikely.

LSU owes Kelly 90% of his remaining base salary and supplemental compensation, plus a pro-rated "longevity compensation" bonus to be paid on July 15, 2026. Kelly's contract was set to run through Dec. 31, 2031 or through the Tigers' final game of the 2031 college football season.

Kelly has a "duty to mitigate" clause in his contract, though, which means he must pursue other jobs for as long as he receives money from LSU.

So, Kelly would have had to wait six years to collect the entire buyout, which was reduced by 10% from his actual compensation, and was subject to a duty to mitigate, so a $20M lump sum probably makes some sense.

Petrino is a real, true piece of shit.

He can coach but after lying to Jeff Long's face directly during the motorcycle incident after Long told him he had the Arkansas DPS report was incredible. 

They should have never ever brought him back.

I have read that apparently, Kelly's contract has a duty to mitigate clause. If that is accurate, Kelly is required to take reasonable efforts to obtain employment elsewhere. Now, does this mean a comparable head coaching position, a coordinator's position? In any event, he just can't sit on his ass doing nothing.

Also, this past June, the Supreme Court of Louisiana issued a ruling that Orgeron's wife (he filed for divorce) is entitled to 50% of Orgeron's liquidated damages received under his employment agreements with LSU.  Her portion? $8,134,500! YIKES.

You may not be aware, but coaches aren’t generally known for their truthfulness or ethical standards.

Jimbo's contract expressly overrid even the common law duty to mitigate, lol. I'm surprised more programs aren't desparate enough to agree to this, and am curious if someone will get it this cycle.

Only reasons I can think of to talk less is lump sum due now, and removal of offset language.  Probably would take both for it to make sense.

If they are negotiating a BO that's less than 50% of the amount owed, I would guess that the offsetting language will be removed. Otherwise, his agent is an idiot. Kelly has had enough success as a coach to land another high paying job, so this $20M could be a nice windfall on top of his regular salary going forward.
