I mean Watson is in the wrong but you can no longer practice your profession because someone touched your hand with their penis once, come on.

The emails produced by Hardin show that the demand wasn’t being viewed as extortion or blackmail but as a legitimate effort to resolve the case.

“[I] wanted to check in on this to see if Ms. Solis wanted to either help us understand the rationale behind the $100k demand or come back with a different figure,” Scott Gaffield wrote on Watson’s behalf. “As I said to [attorney] Cornelia [Brandfield-Harvey] last week, we don’t believe that the alleged facts show that Deshaun did anything wrong with regards to Ms. Solis, but we are nevertheless happy to continue the conversation around a reasonable settlement figure because we believe he can learn a lesson about having put himself in this situation.”

In other words, Watson’s camp was willing to consider paying something to settle the case because, as Gaffield said, “we believe he can learn a lesson about having put himself in this situation.”

Amazingly, Hardin’s team voluntarily disclosed this communication, which otherwise was confidential and never meant for public consumption. It shows that Watson’s representatives viewed the claims made by Ashley Solis as something that weren’t frivolous but that instead provided a useful opportunity to teach Watson a “lesson about having put himself in this situation.”

Hardin is going to spin this as "don't put yourself in a situation to get extorted or exploited."  Sort of like the NBA teaching rookies to make sure to take the used condom with them after shagging a groupie.

Sure. My only caveat to this is why was he still trolling on Instagram for massage therapists after he knew he was getting sued?

Their defense is going to be that he has a fetish and all these girls consented to participating in the fetish.  They can't run from his weird sex addiction.  All they can do at this point is argue consent and make these girls look like prostitutes.  I'm guessing the strategy at this point is to lean into it and hope that Watson can pull a Louis CK and make a comeback when most of the anger blows over and the media moves on to the next pervert/rapist.  It's friggin' ugly, but this isn't Rusty's first sex case.  They're all friggin' ugly.

Earlier Mike Florio suggested his attorney(s) take this to a mediator and try to consolidate. It’s the Lauren Baxley plaintiff. They are fucked if she’s the one that went to HPD.

I have to assume that flying someone in from Atlanta or wherever to sexually assault them is some sort of federal crime. Do we know if the FBI is looking at this at all?

yeah the FBI takes these things very seriously

I don't understand the fetish, but either he's too stupid to just hire actual prostitutes to roleplay the massage, or it has to be real for him.  He's not going to have evidence of consent for all these girls.

He probably doesn't need it for all of them. He just needs enough to create doubt that this was forced on these innocent LMTs.

It's a really fucked up situation.  Rusty Hardin must have gotten PAID.  I'm talking 7 figures up front, easily.

The thing is, you've gotta pick a direction and go with it, and it appears they've gone with (mostly) consent.  There must be too much corroborating evidence out there that they know about to stick with a pure fabrication defense.

Reasonable doubt is the standard for criminal cases, not civil.

What Is the Burden in a Civil Trial?

In a civil case the plaintiff makes the original allegations in a complaint and bears the initial burden. The defendant then files a responsive pleading denying some or all of the allegations and the burden shift to them to prove their defenses or counterclaim. Below is the burden in a civil trial:

The Lowest Standard: Preponderance of the Evidence – The rules of civil procedure used by all U.S. Courts require that a plaintiff prove her case by a preponderance of the evidence. This roughly means a greater than 50% chance, based on all the reasonable evidence, that the defendant did the wrong that caused the damage. The defendant doesn’t have to do anything to defend their case if the plaintiff fails to prove their case by a preponderance of the evidence.

What Is the Burden in a Criminal Trial?

In a criminal trial, the burden of proof is always on the prosecution, as the defendant is presumed innocent. If the prosecution fails to prove guilt, the defendant does not need to prove anything. Below is the burden of proof in a criminal case:

The Highest Standard: Beyond a Reasonable Doubt – A much higher burden than preponderance of evidence. The standard is that there is a great likelihood the accused committed the crime. Most courts refuse to attach any numbers to the phrase "beyond a reasonable doubt," but some people believe it means 90%, 95%, or even 99% sure.

Rusty Hardin is one of the best. He’d be at the top of my list if I decided to commit a crime. Andrea Yates? FYI my friend from Amarillo worked at NASA at the time that Andrea killed all five kids and my friend said they all knew it was Russell or his wife because both of them were odd.

The fact that we didn’t pull an Old Yeller on that bitch Yates still makes me sick.

I’m still stunned that Watson was doing all of this during a pandemic. I mean, even if these allegations are false, what a fucking asshole.

I think each accusation is it's own trial.  Having consent for women A doesn't win you the trial against woman B.

What I can’t get is why after knowing you were facing at least one lawsuit for inappropriate behavior during a massage that you’d solicit another one or more? The fuck? NDA’s don’t mean anything if you break the law.

He's cheap. He'd rather pay $300 for some amateur porn than $3k for semi pro. Then he wants to nickel and dime the $100k. Assuming each plaintiff takes the same amount, he keeps it quiet for just over $2million. Hell, Rusty has probably already sent him a bill for that much.

[Preface: Sexual assault is always wrong and Watson is an idiot at minimum, indecent exposure or some kind of assault at worst]

Is he stupid or just a mentally imbalanced addict? Criminally, can they argue mentally incompetent if he did it all during the pandemic and kept doing it after he knew he was being sued and investigated.

Civil and criminal...It is generally wrong to shame an alleged victim so I won’t, but would it be difficult to convince jurors that it was ambiguous at best considering most or all of these women are amateurs or semi-pro’s advertising their services on Instagram, and it is very common for young women to throw themselves at professional athletes? If you looked at some of their pages and had to play “escort or legitimate masseuse?” there would be some head scratching by a reasonable audience.

Obviously not a lawyer, but it seems to me that the text messages from Watson acknowledging that he made the women feel uncomfortable will be what complicates things for him.  Even if you give him the benefit of the doubt (which he has not earned) and say that he went in with the best of intentions, this clearly shows that he understands that his actions are inappropriate.  Deshaun continuing to repeat the cycle even after these text messages show that this isn't a simple misunderstanding on his end.

And I would imagine the success rate of "she looks like a whore on social media, what did she expect" defense has plummeted in the last few years.

Feeling stupid, ashamed and guilty. If you go forward, you are an opportunistic slut/gold digger/should have known better. If you wait you are a gold digger/liar. No one will believe unless there is video or DM’s that vindicate the accusers.

Deshaun deserves the presumption of innocence. Period. I do not care for this attack a person’s character for money type deal where we don’t get to see who the victims are. Having said that, if he did do all that stuff then fuck him. That’s a predator.

Another angle is that since his behavior appears to be compulsive, what team is going to believe he’s done doing this? I sure as hell don’t think he’s done.

He's definitely not going to stop, but with money it would be easy enough to control.  Get consent, keep the # of girls to a minimum, and pay them well.  With his money there are plenty out there that would be fine with that arrangement.  At that point there is no story.  Unless part of his thing is dropping his load on unexpecting ladies, professional athletes mixing with IG girls isn't anything new.

Did Rusty represent Yates? I thought that was George Parnham.

You are correct. George was the lawyer. For some reason, I thought Rusty wrote some of the briefs. I posted inappropriately.

Apple owns it now, otherwise Dre would be going full blown world tour with Watson after dropping guest tracks on his new album.

To be fair I think all sides of whatever argument are paralyzed by the  sheer (had to look up sheer to make sure that was right) number of massage therapists. fucking a!

Honestly, I haven’t hear anyone (save one poster) say shit. I feel like every athlete wants to defend but is like “damn.” I feel like if Dre weren’t apple he would say the same.

The problem is the number of massage people. Most everyone I talk to is like wtf?

100%. There is nothing in this story that will prevent him from playing. You can beat the shit out women and easily still play. Murder people and still be the face of the league for over a decade. Rape women and still play.
