No argument from me.  It would be most interesting if trial dates were more freely available and rapidly scheduled (a first trial setting is often scheduled within a year, but no one realistically expects to meet it).

As things stand right now, a civil defendant can expect not to have to face a serious trial date for at least a couple of years in most courts in any case where much is at stake.  And you've seen what a criminal case can be like if the defendant is disinclined to plead.

There is some thought that in civil dispute resolution, the parties coming to a settlement is more economically efficient than trial.  Whether that's true or not, speeding the potential resolution (faster trial dates promote faster settlements and sometimes less expenditure on attorneys fees) would change the game considerably.

I have seen a couple of suggestions that Smith should ask for a stay in the two federal cases, to resume prosecution after Trump leaves office.  Merchan apparently is doing that with the sentencing in the hush money case.

There is a big material difference between staying a post-trial sentencing for four years and staying an untried case for four years, namely, the trial.  In the NY case, the trial has occurred and the evidence therefore is fixed.

Staying an untried case for four years is something else entirely.  Memories fade, evidence is lost, people die or become incapacitated, including hopefully Trump.  The one thing it does offer, though, is to force Trump to act to dismiss the cases or pardon himself.

I have admitted that the legal system failed to deal with Trump, because it is slow.  And one of the reasons it is slow is because it contains a lot of rules and procedures that favor the individual citizen in the face of the government.

There are also aspects of it that are influenced heavily by electoral and legislative politics:  namely its underfunding, generally, and Congress' unwillingness to enact laws that effectively enforce political and official ethics.  And, of course, the pardon and clemency powers granted to state and the federal executive.

It is also full of glory-seeking prosecutors who can't get out of their own way, or, if they can, commit grave injustices in the name of "wins" or "tough on crime."  Or some other personal aggrandizement.

I'm not looking for "mic drops" and never have.

I basically address misinformation about the legal system. The irrationals believe that's some kind of defense or normalization of fascism.  I get that the frustration leads to that conclusion, but if you look at what I say in a clear-eyed fashion, you understand that it is not.  Quite the opposite, actually, because if you change a legal system from its normal operation to contend with what seems to be a dire threat, you have a legal system that is perfect for fascists who get to determine what is a dire threat.  This will be exemplified by the attempted lawfare coming from the Trump administration.  

I've never said it was great and wonderful.  It's full of flaws that have been discussed ad nauseam.  Much like the entire American experiment, it's a piece of shit.  Until you compare it to all the others.

I do think that, given time to operate to its conclusions, uninterrupted by the foul desires of the US electorate, Trump would be multiply convicted and likely in prison.

I am also hopeful that the built-in protections for defendants will mean Trumplawfare fails.  But if it doesn't, because Trumpco manipulated the system, then you'll all get what you wanted:  a system where the ends justify the means.  You'll just get it in the wrong direction.

Ten months of jury selection. 27 original defendants, six went to trial, Young Thug finally pled guilty and got time served.  It did take "only" 2.5 years from arrest to plea, but Willis indicted Trump in August 2023, so guess where that gets us.  And more defendants and more of them likely to defend vigorously than a bunch of rappers.
