His vote is in

I'm so glad he made. And as is with many folks at this age, in this situation, I fully expect that he won't make it to see election day. He might not make it to next week. But at least he'll have peace.

Not saying Fox News is turning on him, but having Walz on two consecutive Sundays, Harris’ interview today and Harris Faulkner straight up calling him out in an interview for using racially charged language

What?  First off, the alleged assault occurred in 1996, not 1975.  Beyond that, does the criminal statute of limitations have any bearing on a civil case?  (Not a lawyer . . . but your friend is.)

It does not. It’s been found as a matter of formal declaration that he committed sexual assault against her, but that’s nowhere near the same as a criminal conviction. Essentially all it really does, from a legal perspective (lawdogs feel free to chime in if I’m wrong here) is that it protects anyone who calls him a rapist from any sort of liability as far as a defamation claim. In other words if he sues you because you called him a rapist, your defense is “truth is an absolute defense; you’ve been formally declared as such.”

I don’t have hopes he’ll make it that long. But I hope he can hold on for 3 more weeks

The silver lining (if there is any) is that he in CO and his vote doesn't mean jack shit in the grand scheme of things.  If I can just get him to not vote at all... sew enough doubt... then I've done my job (for now)

By the way, if you ever want to read a book on how painting an entire people as genetically deficient, evil, etc. etc. can impact a country's policy, this is a sobering book...

This one too.

Hospice situations can be fluid. I bet he could have decided to drop off months ago, but didn't. Little things like refusing meds and food that basically shorten or prolong one's stay.

And yes, Black people treat Souls to the Polls like any other major service—church anniversary, funeral, pastor’s anniversary

There will be lunch served and it will be the best fried chicken, green beans, mashed potatoes, corn, pecan pie, greens, 7-up cake, taco salad, meatloaf, sweet potatoes, sweet potato pie, and sweet tea you’ve ever eaten.

Correct. Every question is answered with “ well what about “ and I end up saying just answer the fucking question. I got suckered into a $400 bet over the election Friday night over drinks. He just kept talking nonsense about morals and I finally brought up that he filed for bankruptcy on his business and left several people in bad shape. Naturally and rightfully so he wanted to bet $1,000 on election and I said how about $400 since you might actually pay that back.

we left the conversation on decent terms and I even sent him a text saying it was good to see him and he agreed and now he is flooding me with TikTok shit which explains everything. I hope my next response to him is “ give me my money “.
That bet is a win/win. Either you get paid or he'll avoid you going forward.

Very helpful - thank you!  His response was that they should not mess with SOL and I said that may be there is nothing that shows the law had Trump in mind and that two of the other big names impacted by the change were Democrats Andrew Cuomo and Eric Adams.

Appreciate the help with that.

I am telling you with strong confidence he is not irredeemable (thank God for spell check)

Some interesting data on Georgia:

https://www.georgiavotes.com/

Pretty sure the data is a lagging from last night.  Big take away from yesterday, the female vote was 30k higher than the male.

I've resigned myself to the fact that the Dems are gonna get jobbed in Georgia, somehow some way.

Can't speak to the background on the E. Jean Carroll case but why are we talking about a state court case here?

If the opportunity arises, that was a statewide law that affected every victim of sexual assault/violence in the state of New York.  It wasn't directed at Trump specifically.  Moreover, it's a private lawsuit by Carroll, not by any government agency, state or federal.

Edit to Add:  I see this has been covered somewhat.  But some additional perspective.  Most states have had fairly conventional SOL for sexual assaults, namely the usual 2, 3, or 4 years for assaults and similar personal injury torts.  There has also been a trend toward lengthening those SOL to 10 or 25 years or "never."  When that is done, there is often an issue of retroactivity, that is, does the lengthened SOL revive claims that were dead under the old, short, SOL.  NY compromised and, instead of making it fully retroactive, or fully non-retroactive, gave one year for those with "expired" claims under the old, short SOL to file their claims, otherwise they remain barred.

Here is my help back...

https://www.nytimes.com/2023/11/27/nyregion/adult-survivors-act-lawsuits.html

I used the following quote to point out Republicans supported the bill while expressing his concern on the impact of changes to the SOL.  BUT, it was not directed at Trump.

Will Barclay, the Republican minority leader in the Assembly, said that since Republicans had supported the original bill, which brought “alarming cases to light and provided victims with a path to justice,” they would consider an expanded window.

But statutes of limitations “exist for a reason,” Mr. Barclay added. “Unilaterally erasing the threshold would necessitate a deeper discussion, ideally with all stakeholders within the justice system.”

I like our chances, after yesterday, I really like them.  It's one thing to play funny on something really close, like a few thousand votes, but if we can stretch that to 30 to 40k, I don't think so.

One other thing I like, yesterday approximately 47k of the votes were from people that did not vote in 2020.  I just noticed that stat on the page I referenced earlier.

I hope you're right. Definitely the wider the margin in Kamala's favor, the harder it is to play fuck-fuck games.

Trump's Womens Issues town hall appearance this morning on Fox is chock full of goodness:

https://threadreaderapp.com/thread/1846567409315987655.html

FAULKER: How can we help people afford bacon?

TRUMP: There wouldn't have been a Ukraine and Russia. There wouldn't have been an October 7.

Trump seems to think humanitarian parole status for immigrants is the same thing as being on probation after you are convicted of a crime

Q: What policies would you implement to help hurricane-affected families and business recover?

TRUMP: We give hundreds and billions of dollars to foreign countries, many of which you've never heard of

Q: What can you do to make having children more affordable?

TRUMP: You never heard of Ivanka, right?

Happy for you that it's all so clear and simple.

And true.  You seem to be stumbling over this. These impacts are real.   You not caring about these people to be hurt defines you, at this moment.

Yep. That book really lays bare a frightening truth: the real fuel powering the engine of fascism is not the extremists. It’s common people too blinded by normalcy bias to see where all the baby steps lead. They aren’t what you would think of as evil or even bad people. They’re just optimistic or stupid or not paying attention, and it’s easier to assume things are under control and will always be fine. These frogs get slowly boiled until they have blood on their hands.

Agreed.  I find this most troublesome from people who believe the myth that "it has always been this way [no, it hasn't], therefore it WILL always be this way [which it can, but only if we choose the right path]."  You show them the parallels between Weimer Germany, with a rising Nazi party and they scoff.  I ask if they would like a one party, religious based government and point to Iran.  They scoff.  "That would never happen here."  Bullshit it would never happen here.  It's happening.

My dad tried using the 'weaponized DOJ line on me'.  I responded that we both know he committed all of the crimes he's accused of and that's the DOJ's job - to prosecute criminals.  He got silent after that.  I'm sure no minds were changed, but at least he STFU.

I hate this so much.  I have a lot of bones to pick with FBI/DOJ and state authorities on prosecutorial discretion and charging of criminal offenses, along with sentencing.

Those are legit questions.

But Trump has always been a grimy little pimp criminal and he raised his profile just enough to get stung for it when maybe others are not.  With all my objections to these various charging decisions, I don't have a problem with those against Trump.  Well-deserved.

But all of this boils down to fucking opinion, basically.

But let's not forget the "opinion" of the MAGAs that matter: criminal laws are NOT intended for white people with money.  Criminal laws have one purpose: to keep "those people" in line.

It might as well be engraved in stone in the MAGA party's platform: "We are the in-group who laws protect, but do not bind -- everyone else is an out-group who laws bind, but do not protect."

These people are fucking fascist pieces of shit, and I am resigned to the fact that they will never suffer enough punishment and pain to make up for the pain and suffering they inflict.

I've seen a lot of racism expressed because I'm mayonnaise white and the racists thought that I would automatically agree with them.  Like I'm part of their safe space.  When I push back, they shut up.  It's not guilt, they just don't want the push back.

I get this quite a bit too living in East Texas. People are outright shocked when they get push back. I think it's just something they very rarely encounter in their day to day.
