How is it that she’s now talking freely about something that she, ostensibly, willingly signed and took consideration for agreeing to not talk about.

I’m sure this has all been covered before but I just can’t remember how it all squares.

I've always wondered what the remedy would be for violation of an NDA related to hush money. If a politician pays a women $1,000,000 to sign an NDA and not disclose her allegations of rape against said politician, she takes the money, and goes ahead and speaks about it publicly, does the politician then sue to recover the $1,000,000 plus additional damages? Does that go to a jury?

"Ladies and gentlemen of the jury, the bitch took money and signed a contract to not disclose publicly that my client raped her, and she should be punished for said disclosure." Would a jury really punish a rape victim? I guess the defense would be that it wasn't really rape but to keep her from even making an accusation, but a trial on the matter is just as damaging if not more than what the NDA was meant to prevent. It also feels like an illegal contract. I'm happy I don't practice in this area.

Nobody needed hindsight to recognize the problem with a decent replacement if she held on too long-  and her age and the type of cancer that she had pretty much takes away the need for hindsight.  People were screaming about it at the time.  Anyone here who has tried to pry an elderly parent out of their home for their own good will cosign that it is almost impossible for them to do it of their own volition.  Same deal with the stakes being much higher.

But please don’t act like the Turtle’s plan was unknowable when he had already publicly stated that his goal was to defeat anything that Obama wanted to achieve.

A federal judge Tuesday indefinitely postponed the criminal classified documents trial of former President Donald Trump, a court filing shows.

The trial on charges that Trump willfully retained classified national security records after leaving the White House and then hid them from federal authorities was scheduled to start May 20.

But U.S. District Judge Aileen Cannon wrote in Tuesday’s court order that it “would be imprudent” to finalize a trial date “at this juncture” when various pre-trial issues have yet to be resolved.

Cannon pointed to pending questions about how classified information will be handled in the high-profile trial of the former president, and “additional pretrial and trial preparations necessary to present this case to a jury.”

To move forward with the trial in May would be “inconsistent with the Court’s duty to fully and fairly consider” those issues, she wrote.

“The Court therefore vacates the current May 20, 2024, trial date (and associated calendar call), to be reset by separate order following resolution of the matters before the Court, consistent with Defendants’ right to due process and the public’s interest in the fair and efficient administration of justice,” Cannon ruled.

‘Every Dollar Counts’: Prosecutors Use Quotes From Trump’s Books Against Him
Donald J. Trump’s books provided prosecutors with passages they believe can help their case, as they argue that he knew that his company falsified business records to cover up a hush-money payment to Stormy Daniels.

Prosecutors cannot force Donald J. Trump to testify at his criminal trial in Manhattan, but that does not mean they can’t use his words against him.

On Tuesday, the prosecutors unearthed a series of damaging excerpts from books that the former president wrote, plucking out passages to help make their case against Mr. Trump. In essence, they called a past version of Mr. Trump to testify against his future self.

In his own words, Mr. Trump described how he kept a focus on minute details and watched every penny that left his accounts, corroborating a core component of the prosecution’s case as they argue that he knew that his company falsified business records to cover up a hush-money payment to Stormy Daniels, a porn star.

On cross-examination, Mr. Trump’s lawyer, Todd Blanche, suggested that a ghost writer had been responsible for these words.

Mr. Trump’s written words also described how he sees sexual potential in women that he encounters, a salient point in a trial tethered to encounters with women that he is accused of covering up. “All the women on ‘The Apprentice’ flirted with me,” he wrote.

Prosecutors introduced the damning excerpts by questioning Sally Franklin, a witness who is an executive and editor, to read excerpts from “Trump: How to Get Rich” and “Trump: Think Like a Billionaire,” both of which were published by Ballantine, a Penguin Random House imprint.

The jury heard Trump’s written words: “Every dollar counts in business, and for that matter, every dime.” The text continued, “Even in high end shops, I bargain,” adding, “I hate paying retail.”

This was not the first time jurors heard Trump in his own words. Last week, prosecutors played video clips of him talking, and they have questioned witnesses about Mr. Trump’s infamous statement on the set of “Access Hollywood” that he would grab women by the genitals.

But the judge would not allow prosecutors to play the tape for jurors, a decision that elevated the importance of the book passages, or any other opportunity to use Mr. Trump as a witness against himself.

It might not be the only opportunity for jurors to hear from the former president. Although the prosecution cannot legally call him to testify, Mr. Trump could take the witness stand in his own defense, though it is unclear whether he will do so.

For now, jurors heard his words via Ms. Franklin, who read ominous passages in which Mr. Trump spoke of how he treated his perceived enemies.

“For many years I’ve said that if someone screws you, screw them back,” she read from a book by Mr. Trump. It continued: “When somebody hurts you, just go after them as viciously and as violently as you can. Like it says in the Bible, an eye for an eye.”

As jurors listened, Mr. Trump’s smiling image on a book cover was plastered on screens across the courtroom, a sharp contrast from the scowl he sported throughout the testimony.

It's absolutely relevant becuase he claims he never had sex with her. Which also effects HIS credibility. Additionally, it goes back to "So you paid a woman to keep quiet that you didn't have sex with?"

Pecker already testified about a catch and kill story that was proven to be completely false. There was still a reason to pay to keep the allegation under wraps.

The crime here is related to the way payments were disguised, in order to not look like campaign related. That crime can occur whether the underlying story is true.

To be clear it is relevant. However, admissibility isn’t automatic because something is relevant. That relevance (probative value) has to be weighed against the danger of unfair prejudice.
