Ah yes, the ol' one and a half billion dollar baby split.

Ahem, the defense paid 12.5 million *less* than half the 1.6 billion in claimed damages. “I’ve got great news, Rupert. We can be done for less than half the claim.” “How much less?” “It doesn’t matter, it’s the best we’re going to get- and it’s not the full $800million”. Cigars all around

Wouldn't a settlement have to come with a pretty massive apology, directed at Fox viewers? Dominion would be cooked moving forward without it (and probably is anyway).

“Money is accountability," said Stephen Shackelford, Jr., the attorney scheduled to give opening statements for Dominion on Tuesday.

It might have been less if they went to trial and lost the case.

Do we have to acknowledge publicly that we knowingly lied and apologize for the damage we caused?

No.

Okay then.

So Fox pays a bunch of money to make Dominion go away.  In the process, the pay more than their competitors could ever afford so when Dominion goes after them, they have to go bankrupt.  Fox keeps doing what they do.  Dominion is now rich and Fox leaves them alone for now.  Does that pretty much sum it up?

Also, hard to blame Dominion.  They are rich now.

This. Yeah we all wanted to see the spectacle but that was never happening. They were as guilty as shit and didn’t have a snowball’s chance in hell surviving that case were it to have gone to the jury, and they knew that. The best they could have hoped for was to settle with terms that allow them to be as swagger-ish as possible about it.

That last line in the tweet was a good move, though. Fox loses either way with it.

One of the legal types that I follow mentioned that it may suck for everybody wanting something more, but Dominion still has lawsuits against a bunch of other people/companies and now that they have a large settlement, they will probably not settle with most of  those other people/companies, especially the types like Sydney Powell and Giuliani - they wouldn't be able to get much money out of a settlement with them anyways.

He also mentioned that Fox News is going to have to be extremely careful going forward because they've laid out how to defeat Fox News, they've already gotten a bunch of texts/emails/voice recordings/etc. in the public record of Fox News hosts fucking around when they knew they were pushing bullshit, and so if Fox News does this again, Dominion can be right back in court, and it's opened the doors for future lawsuits from other companies/individuals that Fox News may try to fuck around with.

He thinks it could shake up the guests that Fox News has on in the future, or at the least they would have to put disclaimers up or not let them run away with bullshit conspiracy theories.

Fox about to go extremely tech savvy and start changing their coms systems, they will be wiping their servers monthly to get rid of any paper trail. The stars will start using phones that are also wiped to give reasonable doubt about what they have said. This will only make them more paranoid and remove evidence before discovery

Yep.  This will not change a single aspect of their lying.  They’ll know to not put everything in emails and texts next time.

Dominion fucked our democracy by settling.

If they start doing that, it's going to get really fucking dicey for them because they will run afoul of various laws/compliance requirements that require communications be archived in a  format that can't be erased, etc.

What everybody will most likely do is move a lot more conversations about this kind of stuff to verbal discussions or phone calls (where the content isn't recorded).

Neither of those are admissions that they lied.

I know. I was agreeing that what little they were saying about it was muddled at best.

EDIT: and you can bet that the terms of the settlement most definitely do not include a forced admission by FNC. At best what it contains is a provision that orders them to shitcan any further attempts to advance said lies.

Anyone who thinks this settlement will cause either a) Fox News to change their journalistic standards to report more accurately and stop perpetuating GQP-friendly theories, or b) Fox consumers to question the validity of what they view on Fox is getting fucking high on their own supply.

Oh it certainly won’t. If the D’s are smart (ha!) they’ll accept invites to come on their network and they’ll constantly remind them that Biden won the election, Trump lost, and Trump lied about it. Just keep poking at that bear until it bites back. But of course we know the D’s love to miss opportunities, so they probably won’t do that.

1 - Fox was going to be found liable.  That was a done deal.

2 - that doesn't mean that Dominion's damages model of $1.6 billion was a surefire winner.  In fact, the DAMAGES portion of the case actually did have plenty of holes that Fox could have poked in it.  So, Dominion easily could have had a result where they won on liability but got far less than $1.6 billion, including something well below $787 million.

So, in terms of civil litigation (which this was), it's pretty damned close to a home-run for Dominion.  At least a standup triple.

Did we get the public humiliation of Fox by a final judgment that we wanted?  Nope.  Did we get the admission of liability that we wanted?  Nope.  But civil suits are, in the end, about money.  And Dominion just got a LOT of money.  A LOT.  Dominion is now perhaps the most successful voting systems company in history, by virtue of this judgment.

I wish we'd have seen Rupert skewered on the stand, and Fox found liable by public judgment.  But even Fox was smart enough that it was never gonna happen.

Has a single person said that?  They’re all laughing right now.  Rupert likes his pound of flesh though so you can bet internally he’s making sure Tucker Fuckface and Hannity Cunt are getting a very clear message.  Stop being so sloppy you fuckup clown pieces of shit.

They fucked around and found out for $787 million dollars, and that's just Dominion and not Smartmatic.

Like ChiTownDoc said, Rupert has probably read them the riot act about who they bring on the air and who and what they promote, because if they bring in Sydney and Rudy and others like them and start pushing more bullshit about Dominion over the next year and into next year's elections, you can bet Dominion's lawyers will be gearing up for another payday.

Rupert is not happy about giving up $787 million.  The next lawsuit with them will be for a lot more money.

And then there's Smartmatic, who could get a lot more.

Dominion, however.....those fuckers are in "light our cigars with $100 bills" territory now.  Good for them.  I'm still a litigator, it still makes me happy when folks get PAID, even as the Republic crumbles around us.
