I said avenues, not guaranteed ways to prove every case. It just depends on what is available in that particular case. And, frankly, I don't know enough about that sort of mapping to know how long out from infection that sort of evidence could be gathered. Are viral fragments good enough? Do you really need to have an active infection?

In this instance I don't think Brisket is looking for monetary reasons. Frankly, there are none. Those sort of suits could never be economically viable (I guess unless Elon Musk or someone like that is the anti-vaxxer). The idea is to encourage better behavior in others by at least attempting to hold them accountable for damage caused by their reckless actions. The lawyer taking that case would basically be doing so pro bono.

I think that this does demonstrate quite well the immense threat of a bioweapon from a country like China, NK, Iran, etc.  Selective vaccination in advance and then release the contagion. Maybe you are really smart and can cover it up in the lab by splicing up a genome that can be traced back to animal origin. You sacrifice a portion of your population to cover the release, then clamp down with a fairly robust and pre-planned containment strategy. Your case rates probably look something like China's. /tinfoilhat

Because “Tort Reform” essentially put a price control on personal injury, which represents a subsidy paid by the injured and society at large  to the responsible party for every dollar unpaid  over the price control, in other words, command economy socialism.

i'm with the anti-sue crowd... slippery slope, can of worms, etc.  i'd rather see this enforced with institutions to employ or enroll only those who have been vaccinated.  schools have been progressively doing that in the past few years to mitigate the anti-vaxxers.

It all depends on the virus, but if we are talking about the coronavirus, experts are saying it will be non-detectable a few weeks after symptoms disappear. All that can be tested is antibodies against the virus, meaning that the person once had the virus. From what you and brisket are saying, that would not be enough evidence. And I don't think anyone is going to voluntarily have a cotton swab stuffed up their nose. The only possibility is if the lab was keeping samples of infected individuals. I don't know enough about a subpoena for confidential medical samples to know if that is possible. And if I were a patient, I would be furious if the lab had fine print in its documents that would allow for such a thing: If they are keeping samples, it better be specifically for research purposes.

Don't need to sue them. Just force sterilization upon them. 

I assume most of them were vaccinated. Shouldn't they be autistic?

I'm actually encouraged.  NY/NJ appear stable and should see major drops in deaths soon since hospitalizations have really fallen off.  Hopefully the other hotspots don't have full meltdowns.  Detroit is worrisome.

Just an observation. 
I live in "central" f/k/a "north" Dallas.  Traffic around here has been significantly curtailed, even on Central/75, Preston, Northwest Highway, etc.  Like 10% of normal, maybe 25.
Today I drove up to Princeton, east of McKinney, to ride a mountain bike trail.  The further north you got on Central (toward and into Collin County), the worse traffic got, to the point it was fairly indistinguishable from a normal day (well, I should check that, I don't know what Collin County traffic is like on a normal day, cuz I don't go up there very often).  Suffice it to say it was discouragingly heavy.
Maybe it was assholes like you who should be home that were out recreating instead?

NJ basically has the same number of tests and positives every day. They must have a set limit of tests that can be processed daily so only strongly suspected ill people are getting the tests.  I’ve read theories that perhaps 5x as many people actually have covid 19 but there aren’t any tests to prove that

Maybe what our public health organizations, such as the CDC and the FDA, really need is more lawyers threatening to sue individuals for individualized medical decision making.  Could have turned the corner on the botched test reagents and the regulatory red tape preventing private lab ramp up I am sure.  The answer to every good public health crisis is more lawyers.

They must have a set limit of tests that can be processed daily so only strongly suspected ill people are getting the tests.  I’ve read theories that perhaps 5x as many people actually have covid 19 but there aren’t any tests to prove that

In New Jersey or America? I’d double that 5 to 10 and probably make it 15x higher
