Need help from Surly Community

@956 Worldwide, I assure you this is not an asking for a friend situation or a troll job. I wish I could makeup stories like this.  I would be in a completely different profession and probably writing books on a beach somewhere in the South Pacific for a living.

I am intentional about staying off of social media.  This is an unbelievable situation that I’ve never personally experienced and have to be careful about who I talk to because of the seriousness of the alleged crime.  It may have not been the smartest thing to do but posting anonymously on a message board that I read quite a bit and know there are very knowledgeable posters seemed like the best way to get insights to help me determine the best course of action.

The responses have been very helpful.  Thanks everyone.

Cops cutting corners and lying criminals...twin themes here. 

Decades back I had a temp gig as a mail clerk at British Telecom in Shite Town, England. (Preston) Anyway I had this weird co-worker who always seemed a little off. One time we were alone on the elevator with our little carts of mail and memos and such and out of nowhere he asked me if it was common in America to have one undercover cop come out of nowhere, hand you a healthy-size little sack of cocaine, vanish, and then for a small squad of cops to arrive out of nowhere and arrest you for said cocaine.

He admitted this had happened to him. I told him he was being "stitched up," as they say over there, and a few days later I found out why through the grapevine: dude was strongly suspected of being a chronic flasher of little girls. The cops couldn't get him for that for some reason, so they clownishly set him up to take a serious drug rap. Dunno how it turned out -- my temp gig ended and I moved back to America a few months later, but that story illustrates both sides of the system to me.

All I know is that I’ve had email addresses for over 30 years now and I’ve never been sent a link that I could accidentally click on to see kiddie porn….because I don’t look at kiddie porn. You’re “friend” is lying to you and probably should be in jail.

I've had the pleasure of representing multiple people charged with this offense. 

If the local police are sending child porn to unsuspecting citizens, then they too are guilty of the crime and could all be arrested. 

Shit, the DAs even have complex procedures for handling, viewing, and marking the evidence that involves multiple clearances and a literal safe room.

@Anastasis, not a troll job.  Will do my best to keep this thread going or other posters can contribute with their stories/experiences.

Just found out this case won’t go to trial for the next 3 - 6 months because of the case backlog.

At the very least, I will report back and let everyone know the outcome of the trial.  Could be eye opening for many of us.

May have just given a lot of people ideas about how they can get even with someone they don’t like.  Just seems unbelievably too easy to ruin someone’s life these days.

Hey Bob, can I borrow your computer or phone for a second.  Downloads some kiddie porn and bam, cops show up at Bob’s door one day and Bob’s arrest and charges are then on public record and there is a digital footprint Bob can’t escape.

But seriously. This seems like a really stupid thread that was started by someone who wants internet attention for a hot second. I know everyone else see’s the bullshit here but….

1.) No way internet police are phishing rando’s

2.) The internet doesn’t work this way

3.) Dude’s a wounded vet from Iraq? Come on man. Disabled vet turn is a tired trope.

4.) His life is ruined, but his wife’s still around. Wife’s don’t stick around for child porn. And especially if you’re a poor and charged for that. They’re out of there faster than you can click a suspicious link in your inbox. 

5.) I’m just curious if this is all just a weird attention thing by OP or how many pages this goes before he start asking for $.

“To take the time to find all these screenshots, you know, it’s very disturbing. Very, very disturbing,” said the sheriff. “This is over the top.”

The goal was to get the husband behind bars so Hucks could win an upcoming child custody battle.

According to court documents, “Angel stated that Lacey drove her to the Wynnewood Police Department to make the report and gave her the phone,” on April 18. 

Moore told police she saw the husband viewing the pornography at his home.

“It was a plan that they said that they rehearsed,” said Sheriff Mullet. “She was never at the house. She never watched him look at a phone.”

Wynnewood Police quickly looped Garvin County deputies into the investigation.

“The wife just came up with this crazy story and it was believable at first,” said the sheriff.

The husband was arrested after the accusation, but was only locked up overnight. Investigators quickly pumped the brakes and connected the dots after no child pornography was found on the husband’s current phone.

Child allegedly slapped during Cinco De Mayo celebration at Oklahoma City park

Moore later confessed to the ruse and told police “she thought she was doing the right thing for Lacey.”

“The husband is upset, obviously,” said the sheriff. “Someone tries to take your life and away from your freedom.”

Moore bonded out of jail while Hucks is sitting in a cell with a $250,000 bond.

“It backfired on them and I’m glad that they were able to be in jail,” said Sheriff Mullet. 

The duo is now facing charges including aggravated possession of child porn, conspiracy to commit a felony, and violation of the computers crimes act.


And I agree with earlier posts - you need to step back & not make this your fight. This is such a horrendous accusation, you have to protect you & your family’s mental well-being first.

Although he might be falsely accused, you have to begin to accept the possibility he is guilty, no matter how much you think you know him. It really sucks since no matter what happens, there will be no winners. 

TLDR: Protect your family first & limit your involvement in his battle.

I’m not seeking any attention.  Everything has transpired over the past few days.  I have never dealt with something like this and usually have solutions or have people within my orbit I can go to for advice to figure out the best solution.  

I am usually super careful about who I let into my life and develop personal relationships with.  We have a house in a more rural community and it is impossible to avoid your neighbors.  Being from a big city and having an opportunity to spend more time in a rural community has changed my view on the world in many ways.  This friend of mine is a neighbor and because we see each other almost every day and hang out with them and our other neighbors frequently, it was hard not to develop a close relationship.

My friend and his wife are going to have to move away from the community soon.  There is no way they can go out in public and continue to be active because it is a fairly close knit community.

One of my other friends that is a childhood friend and who we told last night has been doing some research since his head is spinning and couldn’t sleep.  He minored in criminal justice, his stepfather is a retired cop, and he has found some things out.

it is not looking good.  I really do appreciate all of the honest responses.

@txhorns, I bought some property from them that they had just bought and they were planning to build their retirement home on in a few years.  As soon as I found out they listed it I bought it.  It is helping them at least raise some money for an attorney.  They can either buy the property back from me when the dust settles or I will sell it.

I have 4 kids now in the 19-25 range.  When they were in high school, I _required_ them to watch that video and regurgitate back to me what was in it.  It's never a bad idea for adults to rewatch it.

100% this. I’ve shown this video to my kids as well. Your friend screwed up 100000% by telling cops anything. 
Also who clicks links from randos that purport to have porn attached? Does your friend also send money to Nigerian Princes?

i agree with this...with a caveat that sometimes it's just assholes fucking with people. i have my own story about this...involving my dearly departed mother, who was pretty naive when it came to online shit, no matter how many times i told her 'DO.NO.CLICK.ANYTHING.EVER.'

anyway...apparently she clicked something else on her phone at one point...she called my sister in an absolute panic because "ohmyGOD!!! there are HORRIBLE THINGS on my phone! i don't want to see this!! what is happening?? what do i do, how did this get here, HOW DO I GET RID OF IT?? it's AWFUL!!" which...from her reaction it was clearly some form of porn, kiddie or not. but maybe?

anyways...she basically just took her phone into Verizon and threw it at the guy and was all "THERE IS HORRIBLE STUFF ON MY PHONE AND I CAN'T GET RID OF IT YOU NEED TO FIX THIS NOW!!"...and they did lol. 

obviously she clicked on some phishing link (like i said, wasn't the first time) and either downloaded some stuff or more likely it took over her browser...but it was definitely some scammer fuck. 

so yeah, there's probably no law enforcement designed phishing scheme, but sometimes there are just malicious, evil people out there, undoubtedly tied to somehow making $$$ (blackmail? 'security'?), who try to ensnare naive folks. not saying that's Clarence's friend (sounding more likely that it's not...) but i think it does happen.

Do you have any insight on why/whether/when the feds take over CP prosecutions?  State prosecutions seem quite rare.

The safeguards of the evidence don't really surprise me.  But, just a few years back, the feds took over and ran a forum or server for several months or years to try to snag all of the "subscribers" or whatever they were.  They got a lot of shit for that, rightfully so.  The big theory behind child pr0n excessive criminality is that each viewing of an image constitutes a further injury to the victim and that the distribution of it creates and furthers the "market" for it.  I'm not sure I 100% buy those rationales, but the feds certainly did their part on that one.  Fuckers.

And, reiterating what Pig said, he needs to get a lawyer with experience with these kinds of cases and stop talking about it.

Even if what he is telling people is true, any inconsistencies in what he said or what people recall that he said could be used against him in a prosecution.

He has hired an attorney.

I met with my friend yesterday because like everyone has said, the details of the story don’t add up.  

This didn’t originate with an email after all.  He searched for a site and went to a site that he has visited before that supposedly has legal content.  He didn’t share the name of the site and I didn’t want know.  That’s for his lawyer to investigate.  He said there were disclaimers that the content was legal.  This particular time he was browsing the site and he said he saw a link to something that had “Mega …” in the name.  I will let you use your imagination.  He said there was nothing to indicate it was a link to illegal content.  

When he clicked on the link a bunch of pop ups started opening.  He panicked and spent the next several minutes closing pop ups that were opening.  He said he didn’t see what images were in the popups.  He was focused on closing them.  It seems like he downloaded malware or a virus and didn’t know it.  All of this has been shared with local authorities which I told him was not the smartest thing to do but he said he had nothing to hide. I told him it didn’t matter.  Their job is not to prove your innocence.  

I thought this originated with an email that he received because it was what his wife indicated but she was distraught when we talked to her and didn’t have all of the facts herself.  My friend may have also told her this originated with an email because he was extremely embarrassed.  Also it was the email service provider that reported it and they shut down his email account not too long after the incident occurred. So the good news I suppose is that this was not some sort of sting operation and my friend was not being targeted based on prior activity on the internet.

So question to any IT experts that would know.  Could my friend have downloaded malware or a virus that attached illegal images to emails or sent emails with links to illegal content?  My friend is not IT savvy and had no idea that this is what may have happened.  The images that the cops had in their possession had some sort of digital watermark on them and that’s how they were detected.  My friend probably should’ve done what @mchookem’s mother did and basically self-reported it.  

I told my friend and his wife that they need to make sure a cyber crimes or cyber forensic expert is hired.  If his story is true then I would think it could be easily proven.  I also let him know that if he is lying to me that our friendship is over and I will find out if he is lying to me because all of the evidence that will be presented in court.  This is the time to be completely honest with me and that this is affecting everyone in his orbit especially since the cops have been monitoring his activity, who he associates with, etc.  He knows if he is lying to his closest friends and family he risks losing everything and isolating himself.

Also the local police department has been watching my friend and monitoring his activity over the past several months after they received the info from the email service provider.  Evidently this was the only incident of viewing or downloading illicit content that they found but they still had to arrest and charge him.

This is all I’m going to share for now until the case goes to trial but I did want to share an update because there is more to the story and wanted to clear up some of the misinformation that led people to believe this was a bs story.  I would still like other’s opinions especially the IT experts around here.

If he went to the cops at the beginning, that action alerted them that he was potentially into this sort of thing? Why you ask. Say you are doing something illegal online but you're smart enough to use an anonymous VPN.  Then one day you notice that the VPN wasn't activated after viewing that content. You freak out, decide to get ahead of the potential of the ISP turning you in. You call the cops and claim you did nothing wrong.  You might even tell yourself that you're done with that behavior.

Cops are skeptical and get a search warrant for the ISP. Then they catch you.

I'm sure that someone somewhere has been railroaded into this type of charge but I have to believe that is the exception not the rule.

You are not doing your friend any favors having him tell you the story - truthfully or otherwise.  He needs to stop talking to anyone but his attorney and his friends need to stop asking him about it or shut him off if he wants to talk.

Your friend continues to lie to you and/or you continue to lie to Surly. 

You work for an IT company bur come to Surly for IT experts? If this is a real story, your friend definitely watches child pornography and you should definitely stop communicating with him. But again, I would put money on this being made up for clicks.
