Maybe. This guy posts so much stupid shit on here, I also struggle to believe it's not an act just to rile people up.  Then I remember who was twice elected to office, and it becomes more believable that people are this misinformed and proudly belligerent about it.  The current state of education in this country is likely to exacerbate this problem, rather than alleviate it.

Yes, but see, if you ignore the plain language of the Constitution, as well as 100+ years of consistent Supreme Court and appellate court jurisprudence, then it does NOT apply to non-citizens!

Also, I am a strict constructionist of the Constitution and love it very very much!

Taking the position that "non-citizens" don't get due process is as ludicrous as saying "people guilty of a crime don't get due process."  You can't tell which side of the line those people are on....until you make a determination....that can only be accomplished via....DUE PROCESS.

Otherwise, all the admin has to do is unilterally declare that DalTx is not a citizen, nab him, toss him on a plane, and bury him at CECOT for the rest of his life.  Arguing his position is as dumb as it fucking gets, but "as dumb as it fucking gets" is absolutely the name for our current timeline, so here we are.

In yet another facet of our fucked-up immigration policy, first time unlawful or improper entry into the United States is indeed a crime, albeit a misdemeanor.  https://www.law.cornell.edu/uscode/text/8/1325

Second and subsequent unlawful entries are a minor felony.

You are correct that the process of removing or deporting unlawful entrants is a civil matter, but it can also result in criminal charges.

Historically, though, we have not criminally charged first-time or even second-time unlawful entrants.  Only chronic re-enterers get charged criminally.
