It’s not necessarily “personal” cash, it’s Trump Organization cash. The point being the same: whatever cash he/the organization has on hand needs to be available for regular and ongoing debt service.

My point is my understanding from my readings is his debt is on his real estate assets and the servicing of that debt would be out of property cash flows. If there was not debt coverage he’d just bk the spe that owns the asset, or at least that’s been his history. I’d be surprised if he put up a warm body on the recourse on those loans.

I’m not seeing where he has a lot of personal backed debt he has to service with whatever cash he has or might come into.

So.....why not garnish those bank accounts (Trumpco accounts) when the cash flow hits them?  I've done that in Texas to satisfy a judgment: find the account, wait till the money hits for the month, then hit it with a writ.  All the money in the account goes to my client.  And the owner of the account doesn't have that cash any longer, to service debt or for any other purpose.

I have it on good authority that not even Donald Trump himself, the greatest business mind of our time, knows the difference between non-recourse and recourse debt.  He literally does not understand, after 50+ years in the industry, how his position stands with regard to his properties, leases, and organization.

I have unpacked a lot of securities fraud in my day.  I have no doubt he will sell himself and our country down river to buy his fat ass some time.  But usually this kinda thing is done over a long period of time and with a degree of cleverness.  You're all about to see it unfold in a very short period of time, in broad daylight, with 35% of the adults you know cheering it on...

Good question. Not sure. My question would be if there is a partner in the spe with Trumpco, would that partner’s portion of the cash flow be subject to the judgement and confiscation? Also would the loan agreement and lien trump (pardon the pun) the judgement? I’m not a real estate attorney. I just pay a bunch of them.

Or said another way, the bank probably thinks operating cash goes to debt service before it gets distributed to a trumpco account

wtf? what is their reasoning here?

I mean they aren't trying to fuck up the political campaign and a Bond of this nature is actually unheard of/difficult to obtain. I am guessing the extension is to really let them figure out if there is a way to do this without liquidating assets first because that seems semi-permanent and it's not about destruction/dismantling a political campaign. He's already banned from doing business in NYC, the judgement is there and looming with some type of resolution in sight and the appeal has little/no shot of going in favor of Trump, because there wasn't really much shenanigans and they have him dead to rights on the fraud aspects. Essentially there's no harm done from letting him look for money for a little longer just to really drive home the fact that they are going to come up with it on their own or the NY AG will come up with it for them.

This is actually working against Trump instead of for him from an optics perspective. They are giving him every chance in the world to make things right, and he keeps fucking it up.

Yeah, the number was massive, and I don't think there are much shenanigans on that one. I expect the appeals court to reduce the number somewhat anyway, but he's still fucked. It'll be extra hilarious and pathetic though if he can't get a bond for that amount either, so stay tuned.

Here's the order.

Case Nos. 2024-01134 -2- Motion No. 2024-01025 2024-01135 It is ordered that the motion is granted to the extent of staying enforcement of those portions of the Judgment (1) ordering disgorgement to the Attorney General of $464,576,230.62, conditioned on defendants-appellants posting, within ten (10) days of the date of this order, an undertaking in the amount of $175 million dollars; (2) permanently barring defendants Weisselberg and McConney from serving in the financial control function of any New York corporation or similar business entity; (3) barring defendants Donald J. Trump, Weisselberg and McConney from serving as an officer or director of any New York corporation for three years; (4) barring defendant Donald J. Trump and the corporate defendants from applying for loans from New York financial institutions for three years; and (5) barring defendants Donald Trump, Jr. and Eric Trump from serving as an officer or director of any New York corporation in New York for two years. The aforesaid stay is conditioned on defendants-appellants perfecting the appeals for the September 2024 Term of this Court. The motion is otherwise denied, including to the extent it seeks a stay of enforcement of portions of the judgment (1) extending and enhancing the role of the Monitor and (2) directing the installation of an Independent Director of Compliance. You think the optics of siezing a lot of major assets of the front running political candidate for the Republic party is good optics vs being lenient and reaffirming they are fucked and need to take it serious and giving them opportunities to do this without severely impacting his ability to do stuff unrelated to this case?

I don't know this gentleman, but this is spot-on.  He was going to catch a break, financially.  But he was worried, and will continue to be worried, as fuck.  The Trump Organization will fail on its own in the near future.  His political career will come to an end at some point.  The idea is to stress the fuck out of him, even if only at a subconscious level.  He barely knows what's happening except for the grift.  The idea is to run him ragged and make him gone.  Forever.

Remember that he struggled to even get the bond for the Carroll case - is he really going to be able to get a $175 million bond?

He doesn't currently have the money IMHO. This isn't much of a help.

he was granted relief at the hearing.  you know what they call that in truthsocial world? EVEN TEH CORRUPT JUDGE could not deny that HE ILLEGALLY PLACED AN OUTRAGEOUS (BAD) BOND on my beautiful properties WHEN I DIDN'T DO ANYTHING WRONG.  WE SECURED A HUGE WIN TODAY AND IT IS ONLY THE BEGINNING OF THE WINS that will make this CORRUPT case fall a part.

Fuck everything.  That orange cocksucker will get away with everything and become a moronic dictator.  U.S. courts can suck my cock.

This was always going to happen.  When fascists go up against institutionalists, the institutionalists win.  Because institutionalists play by rules.  Fascists don't.  It's like a fight between a boxer who will stick to Marquess of Queensberry rules vs. a WWE heel who will swing 2x4s, chairs, and baseball bats at his opponent in or out of the ring.

The fascists always win.  That's how chapter 1 goes.

They cause pain, suffering, and blood.  That's chapter 2.

Then, they fall, in a paroxysm of even more pain, suffering, and blood.  That's chapter 3.

We're still in chapter 1.  Buckle up.

It would.  It would clearly be an SPE account where the bank has control and even then likely several layers before it hit any "Trumpco" account. This isn't some mom and pop operation.   And the banks lawyers aren't morons.

I am fine watching this play out the way it’s played out.

I was thinking about it a bit.  It's almost like the aggy roller coaster.  Sometimes, they have to win a little, get their hopes up, then their revisiting inevitable defeat is that much sweeter.  The never defeated, just ran out of time thing fits well here too, as does his affinity for things that happened in 1939.

TLDR; Trump is aggy
